RECOMMENDED ACTION:
That the City Council adopt Ordinance No. NS-354, approving ZC 93-04.
ITEM EXPLANATION:
At its meeting of April 2, 1996 the Council introduced Ordinance No. NS-354 approving the
Zone Code Amendment rezoning the Ocean Bluff from L-C to R-l and added the requirement
that the developer provide evidence of consultation and written consent from SDG&E for
grading within its transmission easements. The ordinance has been amended to reflect this
added condition. The Council should satisfy itself that this amendment accurately reflects
your intentions in this matter.
FISCAL IMPACT:
No fiscal impacts will result from this project since it is consistent with the Zone 20 Local
Facilities Management Plan, which ensures that all public facilities required to serve the project
will be provided in accordance with the Growth Management Ordinance.

SECTION I: That Title 21 of the Car&bad Municipal Code is amended by
the amendment of the zoning map as shown on the map attached hereto and made a part

I= a@ c-3 l7 SECTION III: The Council further finds that this action is consistent with G la the General Plan and the Housing Element of the General Plan in that it is consistent

20 with residential land use and affordable housing goals and objectives.
21 SECTION IV: Prior to approval of final map or issuance of grading
22 permits, whichever occurs first, the applicant shall provide evidence of consultation and
23 written consent, if required, from SDG&E for grading or other improvements within
24 SDG&E transmission easements impacted by the project. Failure by SDG&E to approve,
25 conditionally approve, or deny the applicant’s documented request within 60 days of the
26
fling of the applicant’s request with SDG&E shall satisfy this requirement. 27
28 EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it
to be published at least once in a newspaper of general circulation within fifteen days after
its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad
City Council held on the 2nd day of April , 1996, and thereafter
PASSED AND ADOPTED at a regular meeting of said City Council held
on the 9th day of April , 1996, by the following vote, to wit:
