RECOMMENDED ACTION:
Adopt Resolution No. ?‘& 175 approving the Final Map for Cat&bad Tract No. 90-09(A)-
1, Aviara Planning Area 5, Unit 1.
I ITEM EXPLANATION:
Engineering staff has completed checking the Final Map of Carlsbad Tract 90-09(A)-1, also
known as Aviara PA 5 Unit 1. This is the first phase of the 131 detached, clustered, single
family homes. This subdivision is within Local Facilities Management Plan (LFMP) Zone
19 and is located south of Alga Road at its intersection with Batiquitos Drive. It is comprised of 7 lots with uses as follows: 5 residential lots, 1 open space lot, and 1
recreational lot. The 5 residential lots will contain a maximum of 28 detached, clustered
air space ownership single family homes.
The Final Map conforms substantially with the tentative map as approved by Planning
Commission on Nov. 15, 1995 per Resolution No. 3835. The Final Map also conforms to
the General Plan and all the applicable requirements of the Municipal Code and City
Standards. The applicant, Western Pacific Housing - Aviara, LP., A California Limited
Partnership, is requesting the recordation of said Final Map.
This map has been found to be consistent with the Growth Management Ordinance. The project density is 5.4 dwelling units per acre which is within the density range of 4-8
du/acre specified for the site as indicated on the land use element of the General Plan, and
is at or below the Growth Control Point of 6.0 du/acre.
This map has been found to comply with the requirements of LFMP Zone 19. Currently,
all public facilities within, or impacted by, Zone 19 meet or exceed the adopted
performance standards. For a more complete analysis of the public facilities impact for this
project, please see the attached Local Facilities Impact Assessment Form.
The developer entered into a Park Agreement with the City of Carlsbad on June 1, 1989. This Park Agreement provided for dedication of 24.2 acres of land by Aviara for park
purposes in conjunction with Aviara’s Phase I project. A Park Credit Accounting Ledger
was established as part of the Park Agreement to monitor the Park Dedication Credit. An
updated copy of this ledger is included as part of this Council agenda package. The 28
residential units contained in CT 90-09(A)-1, is part of Aviara Phase 1 project which
dedicated the 24.2 acres of park land, therefore there is no dedication requirement at this
time. The Park Credit Accounting Ledger attached hereon has been updated to reflect this new project.
The site has been previously graded as part of Aviara Phase I mass grading. In conjunction with the mass grading operation, the applicant has entered into an agreement
with the California Coastal Commission, creating a deed restriction over the open space
areas within the subdivision. This deed restriction prohibits any encroachment into said areas in perpetuity. Also in conjunction with the mass grading, the applicant has
contracted with a licensed environmental consultant to provide construction observation
and monitoring services for the mitigation measures required by the tentative map.

FISCAL IMPACT:
This project will generate the following fees at building permit issuance:
1. Traffic Impact Fees (28 Units @ $54O/Unit within CFD) $15,120.00
2. One-Time Special Development Tax for CFD No. 1
(28 Units @ $4,666.1352 per Unit) $130,652.00
3. Sewer Benefii Area Fees
(Area L, 28 units @ $776 per Unit) $21,728.00
4. Water Service Connection Fee
(28 Units @ $2,400 per EDU) $67,200.00
5. Sewer Connection Fees
(28 Units @ $1,806 per Unit) $50,568.00
The applicant has paid the Master Drainage Fee as conditioned for map approval as
follows:
4.67 AC @ $34 = $159.00
The inclusionary housing requirement has been met by the applicant through the Aviara
Master Plan agreement with the City to participate in the Villa Loma affordable housing
project.
The exact amount of Public Facility Fees are unknown until the applicant submits an
application for Building Permits. Public improvements for this project include, drainage
system, potable water system, reclaimed water system, and sewer system all to City
Standards. The public street improvements serving this project are all existing. No
detailed economic impact analysis of this development has been conducted. While
increased operating expenses related to this project are expected to be offset from the
increased tax or fee revenue, no exact percentage of offset can be predicted.
This project is located within Community Facilities District (CFD) No. 1. Upon recordation
of the Final Map, the CFD No. 1 special tax will be apportioned to all lots within the
subdivision. Because this is a residential subdivision the owner will be required to pay the
one-time special development tax upon issuance of each building permit within the project.
This project is within Assessment District No. 88-l (Alga Road). The developer has signed
an agreement to provide notification and disclosure of the assessment to potential home
buyers.

RESOLUTION NO. 96-195
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A FINAL MAP FOR CARLSBAD TRACT
NO. 90-09(A)-1, AVIARA PLANNING AREA 5. UNIT 1.
WHEREAS, Western Pacific Housing - Aviara, LP., a California Limited Partnership, have
submitted a Final Map known as Carlsbad Tract No. 90-09(A)-1 to the City of Carlsbad for
approval; and
WHEREAS, the Tentative Map of Carlsbad Tract No. 90-09(A)-1 with conditions, was
approved by the Planning Commission on Nov. 15, 1995, pursuant to Resolution Number 3935;
and
WHEREAS, the City Engineer has determined that said map substantially conforms to said
conditionally approved tentative map; and
WHEREAS, the conditions of approval for said Final Map have been completed or
secured; and
WHEREAS, the developer has offered the General Utility and Access easements for
dedication to the City of Carlsbad; and
WHEREAS, the Final Map conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and
WHEREAS, the City Council of the City of Carlsbad determined it to be in the public
interest to approve said Final Map.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said Final Map known as Carlsbad Tract No. 9049(A)-1 from Western Pacific
Housing - Aviara, LP. which is on file with the City Engineer and is incorporated herein by
reference, is accepted.
3. That the City accepts the dedications shown on the Final Map.

4. That the City Clerk is authorized to sign the Certificate of Acceptance on the Final
Map.
5. That the City Clerk is authorized to cause the original Final Map to be recorded in the
Cffice of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the map to Orange Coast Tiile Company
for recording in the Office of the County Recorder.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 4th day of JUNE I 1996 by the following vote, to wit:
