State law provides that compensation of City Council members may be increased b
in an amount not to exceed five percent for each calendar year from the operative
last salary adjustment. The operative date of the last City Council compensation
was following the general election of November 1990. The proposed ordinance \F
the current compensation from $607 per month to $816 per month.
FISCAL IMPACT:
Increase in Council salaries as explained above.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2,
CHAPTER 2.04 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 2.04.010 TO
INCREASE THE COMPENSATION OF THE MAYOR AND
MEMBERS OF THE CITY COUNCIL
The City Council of the City of Carlsbad, California, does ordain i

9 SECTION I: That Title 2, Chapter 2.04 of the Carlsbad Municipal
10 amended by the amendment of Section 2.04.010 to read as follows:

"2.04.01 0 Compensation.
(I) Each member of the City Council shall receive as salary the s
$500 per month as authorized by Section 36516 of the Government Code for c
50,000 and up to and including 75,000 in population plus the sum of $316 per I
representing an increase of 5% per year for each calendar year from the opera
of the last adjustment of salary, for a total of $816 per month payable at the sz
and in the same manner as salaries are paid to other officers and employees o
City.
(2) The salaries established by this section are exclusive of any :
payable to each member of the City council as reimbursement for actual and nc
expenses incurred in the performance of official duties for the City.
(3) This section shall become operative only on and after the dah
which one or more members of the City Council become eligible pursuant to SE
36516.5 of the Government Code for a salary increase by virtue of beginning a
term of office following adoption of this section."
21 EFFECTIVE DATE: This ordinance shall be effective thirty days :

Dear Ms. Baumann:
Thank you for your recent letter to Mayor Lewis regarding prayers at the beginning of the
City Council Meetings. I have been asked to respond to your concerns.
The City of Carlsbad requests members of the clergy that are invited to give an invocation
the beginning of a City Council meeting, make the invocation non-denominational in naturc
A copy of the letter sent to those clergy members is attached for your information.
With regard to the legality of opening a legislative session with a prayer, the United States
Supreme Court in Marsh v. Chambers (1983) 77LEd.2d 1019, found that legislative bodies
may begin sessions with short "legislative prayers" because of the voluntary nature of the
meetings. The Court found specifically, the atmosphere at the opening of a legislative
session permits adults to freely enter and leave with little comment, and for any number of
reasons, no attempt is made to force any person to listen or participate in the prayer. The court, therefore, found that legislative bodies may begin sessions with a prayer.
I hope this addresses the concerns outlined in your letter. Please feel free to contact my
