I ITEM EXPLANATION: Carlsbad Boulevard between Walnut Avenue and Mountain View Drive has a posted speed limit miles per hour. However, speedmg citations written by Carlsbad Police using radar in this road sei are being dismissed in court. Tratfic Commissioners in the San Marcos Court have indicated tix segment of road is a speed trap because they believe the posted speed limit is not justified by the I of the Engineering and Traffic Survey on file in court. Although the subject segment quaIifies as a Business District per the California Vehicle Code (CV( CVC also requires that the roadway be posted in accordance with the results of an Engineering and TI Survey. Othenvise, the roadway is a "speed trap" per CVC Section 40802 and a driver stoppec police officer using radar is considered to be unlawfully detained. This 0.73 mile segment of Carlsbad Boulevard has adjacent land uses of commercial, residential, retirement home, park and the Army and Navy Academy. Along the frontage of the Army and Academy signs are posted to indicate that the road has a speed limit of 25 miles per hour when cl are present. The fi-ontage of the Carlsbad by the Sea retirement home also would have a 25 mile pe prima facie speed limit per CVC Section 22352 when signs are in place after the local agency dete. that the senior signing should be implemented. The local agency is not required to erect any sig donations from private sources covering these costs for signs are received. Speed surveys were conducted on Carlsbad Boulevard at Cypress Avenue and Oak Avenue. The I speed at these locations were 35 miles per hour and 33 miles per hour, respectively. Sections 22357 and 22358 of the Cal;fo&a VeGcle Code mthoAzes 1OCa authorities to establish a facie speed limit on the basis of the results of an Engineering and Traffic Survey. Staff presenl results of the survey to the Traffic Safety Commission at their May 6, 1996 meeting. The Commission discussed the Engineering and Traffic Survey extensively. Factors included survey were the accident history, adjacent land uses, driveway locations, roadway features, trafl pedestrian volumes, critical speeds and adjoining speed zones. Pacing as opposed to using radar for speed enforcement was also considered by the Traffic commission. However, it was pointed out by the Police Department that pacing would not be effec this segment of Carlsbad Boulevard under the existing roadway and traffic conditions. Based upon the results of the Engineering and TrafEic Survey, by a 3-1 vote, the Traffic Commission recommended that a 30 mile per hour prima facie speed limit be established upon C Boulevard from Walnut Avenue to Mountain View Drive. NS-362 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 10.44.030 TO REVISE THE EXISTING 25 MILE PER HOUR PRIMA FACIE SPEED LIMIT UPON A PORTION OF CARLSBAD BOULEVARD TO ESTABLISH A 30 MILE PER HOUR PRIMA FACIE SPEED LIMIT FROM WALNUT AVENUE TO MOUNTAIN VIEW DRIVE. The city council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended b: amendment of Section 10.44.030 to read as follows: "10.44.030 Carlsbad Boulevard (a) Upon Carlsbad Boulevard from the north boundaq of the City to its intersection Mountain View Drive the prima facie speed limit shall be thirty-five miles per hour. (b) Upon Carlsbad Boulevard from its intersection with Mountain View Drive to its interse with Tamarack Avenue, the prima facie speed limit shall be thirty miles per hour. (c) Upon Carlsbad Boulevard from its intersection with Tamarack Avenue to a point 1,40C south of the southerly boundaq of the right-of-way of Manzano Drive, the prima facie speed limit sb thirty-five miles per hour. (d) Upon Carlsbad Boulevard from a point 1,400 feet south of the southerly boundary o right-of-way of Manzano Drive to the south boundary of the City, the prima facie speed limit shall be miles per hour."
