RECOMMENDED ACTION:
Adopt Resolution No. 969‘&& authorizing the destruction certain files.
ITEM EXPLANATION:
This agenda bill is part of a continuing Record Management Progri for City departments. Adoption of the Resolution will complete t
destruction of obsolete and unnecessary files in the Pol
Department.
Government Code Section 34090 provides authority for destruction
documents that are more than two years old and are no lonl
required. This section also requests the consent of the City Attorr and the authorization of the City Council prior to the destruction of E
documents.
Section 34090 does not authorize the destruction of the following:

Records that affect title to real property.
Minutes, Ordinances or Resolutions of the City Council or a
City Board or Commission.
The documents listed as Exhibit “A” to Resolution No. %--d4&
have been reviewed in accordance with the provisions of t
Government Code, and meet those requirements and the City Attorn
has consented to their destruction.

None.

RESOLUTION NO. 96 -242
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING
THE DESTRUCTION OF CERTAIN FILES.
WHEREAS, the documents listed on Exhibit “A,” attack
hereto and made a part hereof, have been reviewed by the Chief
Police; and
WHEREAS, the Chief of Police recommends that all documei
listed on Exhibit “A” are more than two years old, are no Ion,
required, and meet the requirements of Government Code Sect
34090 for destruction; and
WHEREAS, maintaining all obsolete files, correspondence a
papers is uneconomical; and
WHEREAS, the City Attorney has consented to the destruction
those documents listed on Exhibit “A”;

NOW, THEREFORE, BE IT RESOLVED by the City Council of 1
City of Carlsbad, as follows:

Expired Bicycle Licenses 1987-1989
Background investigations and related reports, not resulting in employment being offered, including those associated with reserve officers and volunteers that have been sealed for over
two years.
Internal affairs investigations that been sealed
for over five years.
I do hereby consent to the destruction of the above documents
currently on file in the Police Department.
