Street Tree Maintenance Zone assessments will increase by 1% in Fiscal Year 1996-97, the
Median Maintenance Zone assessments will remain the same as last fiscal year, and Street
Lighting Zone assessments will show increases and decreases due to the adjustment of the
formula.
As shown in the following tables, a typical single family residential parcel which benefits from
street lighting, street tree maintenance and median maintenance would have an anticipated
assessment of $70.48 for Fiscal Year 1996-97, compared to $73.10 for Fiscal Year 1995-96.

* Assessment rate represents a single family residence within a code with largest number of
single family resident parcels.
Although the "average" assessment for a parcel will show a decrease, various parcels will
experience significant increases or decreases in the amount of the assessment for street lighting
due to a revision in the assessment methodology. Adjustments are being made to create a more
equitable assessment formula in order to balance the amount of the assessment with the benefit
received so that similarly situated properties are treated the same.

ENGINEER'S REPORT PURSUANTTO "LANDSCAPING AND LIGHTING ACT OF 1972"
WHEREAS, this City Council has previously formed STREFT LIGHTING AND LANDSCAPING
DISTRICT NO. 1 (hereinafter referred to as the District) and has levied assessments within the
District for prior fiscal years, all pursuant to the Landscaping and Lighting Act of 1972, being
Division 15, Part 2 of the Streets and Highways Code of the State .of California, commencing with
Section 22500 (hereinafter referred to as the Act); and
WHEREAS, this City Council has previously adopted a Resolution ordering the preparation and
filing of an Engineer's 'Report*, all in accordance with the provisions of the Act.
WHEREAS, at this time there has been filed as a part of the 'Report", certain pians and
specification for the maintenance of the improvements, an estimate of the costs of maintenance,
a diagram of the District, and an assessment roll containing a spread of the estimated costs of
maintenance within the District, all as required by the Act and as previously ordered by this Ci
CounciL
NOW THEREFORE, pursuant to the direction from this City Council, this Report is hereby
submitted to this City Council pursuant to the provisions of the Act. This Report is applicable for
the fiscal war commencing July 1 , 1996 to June 30, 1997 (hereinafter referred to as the Fiscal
Year}. This report is prepared in 2 parts (Street Lighting and Landscaping), each of which
consists of the following 3 sub-parts:

Part Ill.
PLANS AND SPECIFICATIONS for the maintenance and/or servicing of the
improvements during the Fiscal Year. The pians and specifications show and
describe the general nature, location and extent of the existing and proposed
improvements to be maintained and/or serviced during the Fiscal Year. The
pians and specifications also indicate the class and type of improvements to be
maintained and/or serviced for each zone within the District.
A DIAGRAM of the District. The Diagram shows the exterior boundaries of the
District, the boundaries of any zones within the District, and. the lines and
dimensions of each lot or parcel within the District. Each parcef is identified by
a distinctive number or letter. The lines and dimensions of each Iot conform to
those shown on the County Assessor's map for Fiscal Year.
AN ESTIMATE OF COSTS AND AN ASSESSMENT SCHEDULE showing the net
amount to be assessed upon assessable lands within the District, describing
each assessable lot or parcel within the District by reference to the Parcel
numbers contained on the County Assessment Roll, and assessing the net
amount upon all assessable lots or parceis by apportioning the net amount
among the several accessible lots or parcels in proportion to the benefits to be
received by each lot or parcel.

Annual assessment Increases wfll be caused by reasons of increases in the
costs of tabor, materials and utiiity cost increases as applied to energy rates
and water fees. Assessments can be annually modified and increased to reflect
an annual modification in the cost of labor and materials based upon the
Consumer Price Index, San Diego, as published by the Department of Labor as
computed for the first Index in March of each year with additional modifications
for related energy and water rate increases.
All lots and parcels of land known as public property, as defined under Section
22663 of the Act, have been omitted and ate exempt from any assessment under
these proceedings.

DESCRlPTlON OF IMPROVEMENTS TO BE MAlNTAlNED
The improvements to be maintained and serviced are generally described as street lighting, street trees and landscaped and hardscaped street medians as caused by new development and city
improvement projects, all as set forth and described in this Engineer's Report,
New development has added 108 street lights to be included in the City's Fiscal Year 1996-97
maintenance inventory.
The City's street tree inventory remains constant at approximately 21,000 trees, with the exception
of replacement of damaged trees. New development improvements do not include trees in
public street right-of-way areas.
The additional street median area to be maintained in Fiscal Year 1996-97 is 3.14 acres due to
the addition of median improvements to portions of El Camino Real, Palomar Airport Road and
Cannon Road.
Alf Street Tree Benefit Zone assessments are projected to be increased by 1%; Street Median
Benefit Zones are projected to remain the same as the previous fiscal year, and adjustments to
the Street Lighting Benefit Zone formula, as detailed in the Engineer's Report, are projected to
increase 54% of the zone assessments, which includes new parcels added this year. This leaves
1% of the assessment parcels at the same rate as the last fiscal year, while 45% will decrease.
STREET LIGHTING
Pursuant to direction from the Ci Council, submitted herewith is the 'Report', consisting of the
following documents pursuant to the provisions of Division 15, Part 2, of the Streets and
Highways Code of the State of California, and specifically Section 22500 et-seq., the Landscaping
and Lighting Act of 1972.
PART 1. PLANS AND SPECIFICATION
The plans and specifications for the maintenance and/or servicing of the street lighting
improvements during the Fiscal Year are on file in the office of the Assessment District
Administrator, available for public inspection, and incorporated herein by this reference as though
set forth in full. Said plans and specifications show and describe the general nature, location and
extent of the existing and proposed improvements to be maintained and/or serviced during the
Fiscal Year. The plans and specifications atso indicate the class and type of improvements to
be maintained and/or serviced for each zone within the District.
PART If. DfAGRAM
A diagram of the Street Lighting District. Said diagram shalf show the exterior boundaries of the
Street Lighting District, the boundaries of any zones within the Street Lighting District, the lines
and dimensions of each lot or parcel within said Street Lighting District and each parcel shall be
identified by a distinctive number or letter. The lines and dimension of each lot shall be identified

METHOD AND FORMULA OF ASSESSMENT SPREAD FOR LANDSCAPING
STREET TREE MAINTENANCE
Street Trees are in the street right-of-way, generally between the curb and sidewalk and/or
property line in the areas indicated in Exhibit 6. Each property receives approximately the
same benefit. Therefore, staff established a benefit formula in which each parcel is given an
equivalent dwelling unit (EDU) based on the average size of a single family residential lot in
the City of Carlsbad (7,500 square feet or .I 7 acres). Thus, each single family parcel is given
an EDU of 1.0, while most other parcels are given an EDU based on the following formula:

MEDIAN LANDSCAPE MAINTENANCE
This service generally benefits all parcels and residents in the City. Accordingly, all parcels
share in the cost. However, parcels which front upon streets which receive median landscape
maintenance services generally receive more benefit from landscape median improvements
than other parcels. Thus, all parcels in the City share in the cost of median landscape
maintenance using the same EDU formula proposed for Street Tree Maintenance and those
parcels which front on streets with landscaped medians are assessed twice the amount of
other parcels not fronting on the median streets.
These formulas were approved by City Council at the June 6, 1989: regular meeting.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA CONFIRMING THE DIAGRAM AND ASSESSMENT
AND PROVIDING FOR THE LEVY OF THE ANNUAL ASSESSMENT IN
A SPECIAL MAINTENANCE DISTRICT
WHEREAS, the City Council of the City of Carlsbad, California has initiated
proceedings for the levy of the annual assessment for a landscaping and lighting
district created pursuant to the terms of the Landscaping and Lighting Act of 1972,
being Division 15, Part 2 of the Streets and Highways Code of the State of California
(the “Act”), in a special maintenance district known and designated as Street
Lighting and Landscaping District No. 1 (hereinafter referred to as the “District’’);
and,
WHEREAS, at this time two public hearings have been held relating to the
levy of the annual assessments, and this City Council is now satisfied with the
assessment and diagram and all other matters as contained in the Engineer’s
Report as now submitted for final consideration and approval.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
RECITALS
SECTION 1. That the above recitals are true and correct.
PROTESTS
SECTION 2. That all protests and objections of every kind and nature be, and
the same hereby are, overruled and denied.
CONFIRMATION
SECTION 3. That the final assessment and diagram for the proceedings, as
contained in the Engineer’s Report is hereby approved and confirmed.
SECTION 4. That the public interest and convenience requires, and this
legislative body does hereby order fhe maintenance work to be made and
performed as said maintenance work is set forth in the Engineer’s Report, and as
previously declared and set forth in the Resolution of Intention.
SECTION 5. That the assessments contained in said Report for the next fiscal
year are hereby confirmed and levied upon the respective lots or parcels of land

in the District in the amounts set forth in said final Report. It is hereby further
determined that all assessments have been apportioned properly in accordance
with the benefits that each parcel receives from the proposed maintenance works
of improvement.
ANNUAL ASSESSMENT INCREASE
SECTION 6. Future assessment increases will be caused by reason of
increases in the costs of labor, materials and utility cost increases applied to energy
rates and water fees. Assessments can be subsequently modified and increased,
as authorized by Section 54954.6 of the Streets and Highways Code of the State of
California, to reflect annual increases in the costs of labor and materials based
upon the Consumer Price Index, San Diego, as published by the Department of
Labor, computed for the first index in March of each year, and those above
referenced changes will not constitute new and/or increased assessments
requiring additional notification.
FILING AND RECORDING
SECTION 7. That the above referenced diagram and assessment shall be
filed in the office of the City Clerk, with a certified copy to be filed in the office of
the Administrative Coordinator-Special Districts. Said diagram and assessment, and
the certified copy thereof, shall be open for public inspection.
SECTION 8. That the City Clerk is hereby ordered and directed to
immediately file a certified copy of the diagram and assessment with the County
Auditor. Said filing to be made no later than the third Monday in August.
ENTRY UPON THE ASSESSMENT ROLL
SECTION 9. That after filing of the diagram and assessment, the County
auditor shall enter on the County Assessment Roll opposite each lot or parcel of
land the amount assessed thereupon, as shown on the assessment.
COLLECTION AND PAYMENT
SECTION 10. The assessments shall be collected at the same time and in the
same manner as County taxes are collected, and all laws providing for the
collection and enforcement of County taxes shall apply to the collection and
enforcement of the assessments.

RESOLUTION OF INTENTION AND REPORT
NOTICE IS HEREBY GIVEN that the CITY COUNCIL of the CITY OF CARLSBAD,
CALIFORNIA, has approved a "Report" of the Engineer and declared its intention to levy and
collect annual special assessments to pay for costs of operation and maintenance during the
Fiscal Year 1995-1996 within an existing special assessment maintenance district known and
designated as STREET LIGHTING AND LANDSCAPING DISTRICT NO. 1 (hereinafter referred
to as the "Maintenance District"). For all particulars, reference is made to the "Report of the
Engineer" as preliminarily approved and on file with the transcript of these proceedings.
DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED
The improvements to be maintained and serviced are generally described as street lighting,
street tree and median landscaping improvements, including additional street lighting,
replacement of street trees and median landscaping improvements caused by new
development, all as set forth and described in the Engineer's Report on file in the Office of the
City Clerk and open for public inspection.
PROCEEDINGS
The proceedings for the annual levy of assessments within the Maintenance District are being
taken pursuant to the "Landscaping and Lighting Act of 1972" (Division 15 of the Streets and
Highways Code of the State of California).
PUBLIC MEETING AND PUBLIC HEARING/PROTESTS
Notice is hereby given that a public meeting and a public hearing are hereby scheduled in
the regular meeting place of this legislative body, being the Council Chambers, City Hall,
Carlsbad, CA, on the following dates and times:
A. Public Meeting: June 18, 1996, at 6:OO p.m. B. Public Hearing: July 23, 1996, at 6:OO p.m.
At that time the legislative body will hear all testimony and protests relating to the proposed
proceedings, and then determine whether to levy the proposed annual assessment. Any
interested persons may file written protests prior to the conclusion of the public hearing. Any
protest must contain a description of the property sufficient to identlfy the property owner and
state the grounds for the objection.

- If there is a majority protest against the proposed increase in assessments, the proposed
increases shall be abandoned and the City Council may then proceed to levy the assessment
in an amount not to exceed the previous year's levy.
PROPOSED ASSESSMENT
All assessments have been levied in accordance with benefits received to all parcels within
the boundaries of the Maintenance District and the individual parcel assessments for each of
the benefit zones, street lighting, street tree maintenance and median maintenance are formulated by the following methods:
Street Lighting: (The street lighting formula has been adjusted for FY 1996-97 to reflect a comprehensive,
equitable benefit rate, thereby assigning similar benefit assessments to similar land uses.)
1. Most owners of residential units pay equal shares of the street lighting energy and
maintenance costs within their immediate area.
2. Owners of apartment buildings, condominium complexes with over ten dwelling
units, and commercial/industriaI parcels share the cost of the energy and
maintenance of the street lights within their immediate area, based on their front
footage.
Street Tree Maintenance:
Only parcels within areas with street trees within the public right-of-way that are maintained by the City are assessed within this zone. Parcels are assessed based on a benefit formula in
which each parcel is given an equivalent dwelling unit (EDU) based on the average size of a
single family residential lot within the City (7,405 square feet, or .I7 acre). Single family parcels are given an EDU value of 1 .O while most other parcels are given an EDU based on the formula:

Median Maintenance:
All parcels in the City share in the cost of median maintenance using the same EDU formula
as used in the above Street Tree Maintenance. However, parcels which front on streets with medians are assessed twice the amount of other parcels not fronting on streets with medians.
For Fiscal Year 1995-96 the estimated assessments for a Single Family Residence benefiting from the three maintenance zones is as follows:

ANNUAL ASSESSMENT INCREASE
Future assessment increases will be caused by reason of increases in the costs of labor,
materials and utility cost increases applied to energy rates and water fees. Assessments can
be subsequently modified and increased, as authorized by Section 54954.6 of the
Government Code of the State of California, to reflect annual increases in the costs of labor
and materials based upon the Consumer Price Index, San Diego, as published by the
Department of Labor computed for the first Index in March of each year, and those above
referenced changes will not constitute new and/or increased assessments requiring additional
notification.

Your letter of June 18 was forwarded to me by the City Clerk's office. 1 am happy to have the
opportunity to clear up any misunderstanding the public notice may have conveyed.
As new subdivisions are developed and added to the Street Lighting and Landscaping District
No. 1, the owners of the parcels within the new subdivision pay full cost for the operation and
maintenance of certain public improvements: street lights, medians and, if applicable, street
trees within their immediate areas. As a result, owners in existing developments do not
experience increases in their assessments.
In the public notice, the paragraph entitled "Description of Improvements to be Maintained"
was meant to serve a dual purpose: one, the continuation of certain benefit assessments for
existing developments such as yours and, two, to serve as notice to owners of newly
developed parcels about the existing district.
Our records show the individual benefit assessments for your property at 823 Caminito Rosa
(Assessor's Parcel No. 215-252-12) to be the following: For the fiscal year 1995-1996, Street
Lighting Zone $32.54, Street Tree Trimming Zone $35.74 and Median Maintenance Zone
$8.34. For the fiscal year 1996-1 997, Street Lighting Zone $26.04, Street Tree Trimming Zone
$36.1 0 and Median Maintenance Zone $8.34.
