RESOLUTION NO. 96-134
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CALIFORNIA, ORDERING THE FIRE CHIEF TO ABATE NUISANCE BY HAVING WEEDS, RUBBISH AND REFUSE REMOVED
WHEREAS, at its meeting of April 16, 1996, the City Council did herein consider a1
objections to the proposed removal of weeds, rubbish, and refuse on certain property
located within the City of Carlsbad; and
WHEREAS, notice of said meeting was given to all affected property owners as
required by law; and
WHEREAS, the City Council of the City of Carlsbad did hear all objections if any, I
proposed removal of weeds, rubbish, and refuse, and at the conclusion of the hearing di
overrule any said objections, if any, except as follows:
NONE
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad as follows:
1. That the above recitations are true and correct, and
2. The City Council of the City of Carlsbad does hereby direct the Fire Chief of thc
of Carlsbad to abate the nuisances on the identified parcels as described on Exhibit I, at
hereto and by this reference incorporated herein, except as stated above, by having the
weeds, rubbish, and refuse thereon removed.

RESOLUTION NO. 96-270
A RESOLUTION OF THE CI'lT CQUTVCIL OF THE CITY OF CARLSaAB
CALIFORNIA, CONFIRMING THE REPORT OF THE FIKE CHIEF SHOWING COST OF WEED ABATEMENT AGAINST EACH PARCEL
OF LAND IN SAID REPORT, CONFIRMING THE COST, AND
PROVIDING FOR COLIdXTION ON THE REGULAR TAX BILL
WHEREAS, on April 02, 1996 this City Council adopted Resolul
No. 96- 115 pursuant to Government Code Sections, 39501 through
Section 39588 declaring weeds, rubbish, and refuse on the real prop
described therein to be a public nuisance; and
WHEREAS, pursuant to said resolution, a hearing was held by si
Council, and thereafter said City Council adopted Resolution No. 96-1
directing the Fire Chief to abate the nuisance by removal of the weed
rubbish, and refuse on the real property described in said resolution;
WHEREAS, California State Government Code Section 39560, c
requires that a report of the cost of such abatement be submitted to 1
Council for consideration and confirmation following a public hearing
the Fire Chief has kept the required accounts and has submitted his
to the Council for confirmation; and

WHEREAS, at the appropriate time and place said report was I and considered for confirmation by this City Council, at which time i
protests and objections were heard, and this City Council gave all pe
present an opportunity to be heard in respect to any matter relating
abatement work; and
WHEREAS, all persons desiring to be heard have been heard b

NOW, THEREFORE, BE IT RESOLVED by the City Council of thc
Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the abatement work, the report submitted to this CC
and the posting of the Notice of Time and Hearing on said report we1
and regularly performed in the manner and time required by law.
3. That all protests and objections, other than those heretof
allowed and deleted from said report, if any, were and are hereby OVE
and denied.
4. That said report, a copy of which is on file in the office of
City Clerk, and by this reference made a part hereof, is hereby confir
and each of the amounts set forth therein are hereby assessed against
parcel of real property shown with said sum and shall constitute a spc
assessment and a lien against such parcel of land.
5. The City Clerk is hereby directed to forward a certified cc
this resolution, together with a copy of said report to the office of the
Diego County Auditor on or before August 10, 1996.
