ITEM EXPLANATION:
It will be necessary to use specialized legal services for the drafting and impler
Carlsbad’s Habitat Management Plan. Attorney David E. Moser of the law firm of R
Doyle, Brown & Enersen, is a recognized legal expert in dealing with these issues i
Endangered Species Act. He has already drafted the City of San Diego’s model imy
agreement for its habitat plan which will be of considerable assistance in our cas
Moser has been working with the various resource agencies and they are comfort;
with him on this complicated issue. The “Habitat Management Plan - Propos
Services” is on file in the City Attorney’s office.
FISCAL IMPACT:
Services will be provided as needed at the direction and under the supervisior
Attorney’s office at the rate of $205/hour in the amount not to exceed $30,000. .
budget does not include funding for these services. Staff is recommending that
authorize the transfer of $30,000 from the general fund reserves into the City Attor
to cover these costs. The use of general fund reserves is recommended due
recurring nature of these expenses. In certain instances it may be possible to reco
of these legal costs and others associated with the program through the implement

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING THE PROPOSAL
FOR LEGAL SERVICES WITH THE LAW FIRM OF
MCKUTCHEON, DOYLE, BROWN & ENERSEN FOR THE
DRAFTING AND IMPLEMENTATION OF THE CITY'S
HABITAT MANAGEMENT PLAN
The City Council of the City of Carlsbad, California, does hereby r(
follows:
1. That certain proposal for legal services with the law firm of Mci
Doyle, Brown & Enersen for the drafting and implementation of the Habitat Mal
Plan is hereby approved.
2. That the amount of $30,000 is hereby transferred from the Ger
Balance to the City Attorney's professional services account to support the cos
services.
