Introduce Ordinance No.idS-37& to establish a NO PARKING restriction c Carlsbad Boulevard between Cherry Avenue and Redwood Avenue between tt-, hours of 2:OO a.m. and 6:OO a.m. introduce Ordinance No. b’s - 3 33 to establish NO PARKING from 1O:OO p.m. t 2:OO a.m., seven days a week, on a portion of Hemlock Avenue. Introduce Ordinance No. NS -3 3 Y to establish NO PARKING from 1O:OO p.m. t 200 a.m., seven days a week, on a portion of Redwood Avenue. Introduce Ordinance No. fi2 --S??S* to establish NO PARKING from 1O:OO p.m. t 2:OO a.m., seven days a week, on Sequoia Avenue. introduce Ordinance No. dS-3’10 to establish NO PARKING from 1O:OO p.m. t 2:OO a.m., seven days a week, on a portion of Garfield Street. Direct staff to establish a red curb parking restriction on the south side of Tamarac Avenue beginning at Carlsbad Boulevard and continuing ninety feet easterly. Direct staff to contact Coastal Commission staff to discuss having the hours c parking in the lower Tamarack Avenue parking lot extended from 1 1 :00 p.m. to 2:0( a.m., seven days a week. 2. 3. 4. 5. 6. 7. In response to concerns by citizens about parking impacts in the vicinity of the Sand Ba Cafe, the City Council asked staff to investigate alternatives to alleviate the problem. Stai conducted parking surveys on the streets surrounding the intersection of Tamarac Avenue and Carlsbad Boulevard. The findings were presented at a public meeting helr on May 29, 1996. About 30 citizens attended the meeting, with most living in thl immediate area. An additional meeting was held on July 8, 1996 with five residents livin( in the vicinity of the Sand Bar Cafe to discuss solutions to the identified problem. Residents living in the vicinity of the Sand Bar Cafe have indicated that some individual that walk through their neighborhood to their cars are intoxicated or otherwise are actin! loud or boisterous or are causing vandalism problems. This activity takes place late a night and disturbs the peace and quiet of the neighborhood. Two options are available to keep vehicles from parking on the public streets in the Sanc Bar Cafe vicinity. One option would be to establish a parking district and issue parkin! permits to residents. The other would be to not allow parking to occur on streets in tht vicinity of the Sand Bar Cafe during designated times at night. Option 1 would be to establish a residential permit parking program. A residential permi parking program would require each resident desiring to park a vehicle upon the street tc obtain a parking permit. Visitor vehicles would also be required to have a permit. 0 0 Page 2 of Agenda Bill No. /3, 3 L\I'.s Option 1 has the following advantages: I. From responses at the May 29, 1996 public meeting, a residential permit parking program would be accepted by many of the residents if a permit district were established. It prohibits all on-street parking in the district during certain hours, except for vehicles displaying valid parking permits. Residential permit parking is authorized by California Vehicle Code Section 22507 if the City Council adopts an ordinance to establish the program. Adverse nighttime impacts from individuals walking through the neighborhood to their parked vehicle can be eliminated, thus maintaining the attractiveness of residing in the neighborhood through improved safety, tranquility, aesthetics and other values found in a residential neighborhood. 2. 3. 4. Disadvantages of Option I are many, but several major ones include: 1. 2. Residents with valid permits are not guaranteed an on-street parking space in froni of their residence. Generally, residents within the parking district must bear the cost of parkins enforcement, annual permits and decals, administration and installation an( maintenance of the signs. All vehicles, including residents' vehicles, parked on-street without a permit will bc cited for a parking violation. Sufficient police resources to routinely patrol the district and issue citations are nc available. Police officers would only be able to enforce the permit parking on time available basis. The Senior Volunteer Patrol cannot be used to issue th citations. 5. To train a non-sworn officer and pay for routine patrol of parking violators would b very expensive. 6. Establishing this program could lead to other requests from other areas in the City Option 2 would establish a NO PARKING zone between 1O:OO p.m. and 2:OO a.m., sevc days a week. Vehicles parked during this time would be towed away at the owner expense. Each option has pros and cons. However, after discussing with the Carlsbad Polic Department the administrative, enforcement and cost impacts that would result from residential permit parking program, staff recommends Option 2. Option 2 has the following advantages: 1. 2. 3. 3. 4. Posted signs notify all drivers of the parking restriction and tow away. Residents and Police Department officers can readily see that a violation h occurred. The City of Carlsbad would not need to fund, implement and administer a residential permit parking program. 5. Similar types of parking restrictions have been implemented in Carlsbad to control problems associated with drivers going to and from their vehicles. Disadvantages of Option 2 include: 1. Vehicles parked between 1O:OO p.m. and 2:OO a.m. in the NO PARKING TOW AWAY zone would be authorized for towing and removal from the street by i Carlsbad Police Officer. This could result in complaints to the Police Departmen and other city departments as the fine, towing charge and storage cost art substantial. 2. A vehicle cannot be towed unless a police officer authorizes the vehicle to bc towed. Therefore, police officer availability is an issue. 3. Initial installation of the signs is costly and signs could be subject to continuou replacement due to vandalism. Staff also recommends that vehicles be allowed to park until 2:OO p.m. on Carlsba Boulevard between Cherry Avenue and Redwood Avenue. This would lessen th potential for vehicles to park outside the boundary of the NO PARKING TOW AWAY zon and in the residential neighborhood. Currently, signing only allows vehicles to park o Carlsbad Boulevard until 12:OO midnight. Drivers and passengers of vehicles parked on the south side of Tamarack Avenue acros from the Sand Bar Cafe occasionally cause loud noise or disturbances. That actio disturbs residents of the condominium project on the corner of Carlsbad Boulevard ar Tamarack Avenue. Installing red curb will eliminate four on-street parking spaces. At this time, vehicles can legally park in the lower Tamarack Avenue parking lot until I l:C p.m. If approval is obtained from the Coastal Commission to permit parking until 2:OO a.r each day of the week, more off-street parking is available for longer hours and vehick would not need to use the residential streets to park. CONCLUSION: To help eliminate disturbances in the neighborhood, the option of establishing N PARKING time limits would cause the least overall impact to local residents. Success each option, however, is a direct function of the availability of police officers to issue tl appropriate citations. A new individual could be hired and trained as a parkii enforcement officer for enforcement of the parking restriction. If it is the desire of the City Council to establish a residential permit parking program, st; should be directed to return with a work plan. Included would also be the requirc implementation ordinance and fiscal impact of the program. FISCAL IMPACT: Installation of 48 NO PARKING TOW AWAY signs will cost about $5,000. Staffing a administrative costs for the residential permit parking option, if selected, would have to determined and as part of the work plan to be presented to the City Council at a futr meeting. The NO PARKING option would require a patrol officer from the Poli Department to enforce the restriction on a time available basis as part of their work shi Training and utilizing a part-time parking enforcement officer could result in annual COI up to $20,000. First it was the noisc ordinancc proposal which almost turned into a liasco for the city. The poorly written document and inadequate research by CiLy staffers reflected badly on the Councit, making it appear ~fial the tail was indecd wagging thc dog. Thankfully, Council saw through the deception, and canncd the poorly thought out pruposal. When it was realized that it wasn't the noise fiom the Sandbar Cafe that was the problem. but rather thc noise and behavior of the patrons going to thcir vehicles latc at night, it was suggcstcd that perhaps a solution LO parking on the streets shmuld be considered. Whai I heard that Council was considering the possibility of'having thc hours of parking extended ibr thc Beach parking lot and Carlsbad Boulevard, 1 was happy that someone was using their hcad. As you know, there are only three meal residents living in the vicinity of the Sandbar Cafe who want the Sandbar Cafe closed down. Enactment or^ this ordinance would be a furtherance of that crusade. The parking restrictions wauld single out one property owner in the discriminatory and it would constitute a taking of her property. In my opinion, enactment: of the ordinance would be an abuse of the city's police powers. As a sidenote, if the ordinance is enacted, we are in favor of all efforts being made by the City of Carlsbad to obtain conditional hours of parking in the lower Tamarack Avenue state lot.
