HD. lA+k RECOMMENDED ACTION: That the City Council INTRODUCE Ordinance No. ds -3 77 amending the Green Valley Master Plan by the amendment of various sections which add suggested modifications made by the California Coastal Commission. ITEM EXPLANATION: The Green Valley Master Plan was approved by the City Council in February 1996. The City submitted the approved master plan to the California Coastal Commission for adoption as the implementing ordinance for the Green Valley section of the East Batiquitos Lagoon/Hunt Properties segment of the Local Coastal Program. The California Coastal Commission approved the master plan with modifications as outlined in the attached Planning Commission staff report and draft City Council Ordinance. The applicant accepted the suggested modifications at the California Coastal Commission hearing, staff is in concurrence with the suggested modifications and the Planning Commission has recommended approval of the attached City Council Ordinance incorporating the suggested modifications into the Green Valley Master Plan. FISCAL IMPACT: Accepting the California Coastal Commission suggested modifications will not have any City related fiscal impacts. EXHIBITS: I. Ordinance No. MS- 3 ‘7 7 2. NS-377 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING THE GREEN VALLEY MASTER PLAN BY THE AMENDMENT OF VARIOUS SECTIONS WHICH ADD SUGGESTED MODIFICATIONS MADE BY THE CALIFORNIA COASTAL, COMMISSION CASE NAME: GREEN VALLEY MASTER PLAN CASE NO: MP 92-O 1 (A) WHEREAS, Carlsbad Partners, LTD. filed a verified application which was referred to the City Council; and WHEREAS, said verified application constituted a request for a Master Plan and Local Coastal Program Amendment as provided by Chapters 21.38 and 21.52 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the City Council did consider said request for a Master Plan and Local Coastal Program Amendment and approved the Master Plan and Local Coastal Program Amendment; and WHEREAS, The California Coastal Commission considered the Master Plan on May 7’h 1996 as an amendment to the Local Coastal Program to adopt the Master Plan as the implementing Ordinance for the Green Valley area of the East Batiquitos Lagoon/Hunt Properties segment of the Carlsbad Local Coastal Program and approved the Master Plan with suggested modifications; and WHEREAS, the verified application has been referred back to the Planning Commission as an amendment as shown herein for acceptance of the suggested modifications made by the California Coastal Commission; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 3rd day of July 1996, consider said request for a Master Plan 2, Amendment on property described as: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 - - A portion of Section 2, Township 13 South, Range 4 West: and a portion of Section 35, Township 12 South , Range 4 West, San Bernardino Meridian, City of Carlsbad, County of San Diego, State of California. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to MP 92-01 (A) and recommended approval thereof. NOW, THEREFORE, the City Council of the City of Carlsbad, California does ordain as follows: SECTION I: That the Green Valley Master Plan, being Ordinance No. NS-348 shall be amended as follows: A. Section A(5), under General Communitv Develonment Guidelines, on page IV-l of the Master Plan is amended to read as follows: (5.) B. (9.1 C. (13.) D. (1) Temporary runoff control devices shall be installed immediately after grading operations have started, but must be in place prior to the beginning of the rainy season (October 1 st), monitored and maintained throughout the rainy season. Section A(9), under General Communitv Develonment Guidelines, on page IV-2 of the Master Plan is amended to read as follows: Required hydroseeding, landscaping, and irrigation shall be installed after April 1 and be completed prior to October 1 st of any year. General Communitv Develoument Guidelines, on page IV-2 of the Master Plan is amended by the addition of Section A( 13) to read as follows: Conversion of all non-prime agricultural lands to urban uses shall require the payment of an agricultural mitigation fee pursuant to Section 30171.5 of the Coastal Act. Section D(l), under Open Space and Biological Habitat Enhancement Plan on page V-5 of the Master Plan is amended to read as follows: The expansion of the riparian woodland includes approximately 20 acres of new native riparian woodland. Some of this acreage is mitigation for the disturbance of pre-existing habitat that is caused by the two road crossings. Mitigation for riparian impacts shall be at a 3: 1 ratio and mitigation for wetland impacts shall be T.l -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 - at a 4: 1 ratio by the creation of new habitat from existing upland area onsite: E. Under Section E, titled Biological Mitigation Propram, the second paragraph on page V-8 of the Master Plan is amended to read as follows: The primary goal of the mitigation program for the riparian woodland, wetlands and upland habitats of Green Valley is to create new habitat areas to offset areas lost due to construction of the proposed project so that the net loss in both quantity and quality of the various habitats does not occur. Additionally, it will protect the pre-existing habitat areas from the impacts associated with construction of the proposed project. The specific details of the- mitigation and monitoring will be developed at the time of development permit review. F. The Master Plan is further amended by the deletion of those portions of pages V-8 through V-12 in Section E Biological Mitigation Program beginning with Goals of the Mitigation Program. G. Pertaining to Planning Area 1, Development Standards, under Section VI(B) on page VI-7 of the Master Plan is amended to read as follows: Use Allocation No urban development of construction improvements, including grading, is permitted in this planning area except as noted below. Permitted Uses Open space compatible urban support uses are permitted as follows: . . . Trailhead parking at grade.. . Pedestrian/bicycle Trail A portion of the Citywide trail system shall be located along the riparian buffer corridor, either adjacent to and partially within the street right-of-way of Street “A”, or within the buffer area adjacent to the riparian woodland. The portion of the, Citywide trail system located in this planning’area shall be permanently reserved for use by the public through an offer to dedicate a trail easement to the City of Carlsbad at the time of approval of subdivision of the site. In addition, all pedestrian trail improvements shall be constructed concurrent with site development and open and available for use by the public prior to occupancy of any structures. Trailhead Parking The Citywide trail System Plan shows a secondary staging area on the Green Valley property. This staging area is proposed to be located near the intersection of Street “A” and Calle Barcelona and will consist of a small parking area of six (6) spaces and a connection to the pedestrian/bicycle trail. H. Pertaining to Planning Area 2, Development Standards, under Section VI(C) on page VI- 15 of the Master Plan is amended to read as follows: Building Height 1. Buildings shall be limited to a maximum height of 35 feet including any roof mounted equipment and screening elements. 2. Non-habitable architectural design features may extend to a maximum height of 45 feet, but may not exceed three (3%) of the total roof area. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. AGENDA OF: JULY 3,1996 Project Planner: Christer Westman Project Engineer: Mike Shirey SUBJECT: MP 92-01(A) - GREEN VALLEY MASTER PLAN - Amendment to an adopted Master Plan to accept suggested modifications of the California Coastal Commission. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3944 RECOMMENDING APPROVAL of the suggested modifications approved by the California Coastal Commission based on the findings and subject to the conditions contained therein. II. INTRODUCTION The Green Valley Master Plan was approved by the City Council February 1996. The City submitted the approved Master Plan to the Coastal Commission for adoption as the implementing ordinance for the Green Valley section of the East Batiquitos Lagoon/Hunt Properties segment of the Local Coastal Program. III. PROJECT DESCRIPTION AND BACKGROUND Coastal Commission staff suggested modifications to the text of the Master Plan. Those II’ modifications are summarized as follows: The full text is shown in Exhibit “A”: 1. Designation of the rainy season as to begin on October 1 vs. October 15. 2. Require payment of the non-prime agricultural lands conversion fee. 3. Require a 4: 1 vs. 3: 1 mitigation for wetland impacts. 4. Allow further details of the mitigation program to be developed at the time of development permit review. 5. Require the trial and trailhead parking within Planning Area 1 to be built and available to the public prior to occupancy for any structures. 6. Limit architectural features to 3% of the total roof area of any building. MP 92-O 1 (A) - GREE,-JALLEY MASTER PLAN JULY 3,1996 PAGE 2 IV. ANALYSIS City staff reviewed each of the suggested modifications with Coastal Commission staff and concurred with their recommendations. Each of the suggested modifications is relatively minor. 1) The designation of October 1st as the beginning of the rainy season is consistent with Coastal Commission policies and does not adversely affect implementation of the Master Plan. 2) The payment of the conversion fee was identified as a Coastal Program requirement in the City’s environmental documents, however, it was not specified in the Master Plan. Inclusion of the requirement only reinforces those references. 3) The Coastal Program specifies 3:l as an appropriate mitigation ratio, however, Coastal Staff felt that the wetland disturbance was significant enough to justify a greater mitigation ratio. 4) The City adopted the Green Valley Master Plan EIR with a substantial Mitigation and Monitoring Reporting Program. Coastal’s modification allows for more specific details to be incorporated into the Mitigation and Monitoring Reporting Program without the need for formal amendments to the Master Plan. 5) The Master Plan was approved by the City with the provision that the trail be built concurrent with other improvements in the beginning phase of the project. However, the City approval also allowed the trail to be operated as a private trail if the City did not accept the trail offer of dedication. The Coastal Commission required the trail be open to the public regardless of the acceptance of the dedication. Because the applicant accepted the Coastal requirement to take on responsibility for a public trail, City staff accepted the modification. 6) Limiting the architectural features of any building to a maximum of 3% of the building roof area will not have adverse effects on the ability to create architecture compatible with the area. V. ENVIRONMENTAL REVIEW The modifications recommended for approval will not have environmental effects greater than what was identified in the Certified Green Valley Environmental Impact Report. Therefore, the Planning Director has issued a Notice of Prior Compliance. ATTACHMENTS: 1. Planning Commission Resolution No. 3944 CW-bk \\ EXHBll- 4 1. MP 92-01(A) - GREEN VALLEY MASTER PLAN - Amendment to an adopted Master Plan to accept suggested modifications of the California Coastal Commission. Chairman Compas reminded the applicant, Commissioners, and the public that if the Commission recommends approval of this item it will be forwarded to the City Council for their consideration. Associate Planner Christer Westman explained that the above referenced amendment is a follow-up to the California Coastal Commission action of May 7, 1996. At that hearing the Coastal Commission approved the Green Valley Master Plan with some modifications to the text, including: \‘L MINUTES PLANNING COMMISSION July 3, 1996 Page 2 + Designating October 1st instead of October 15th as the beginning of the rainy season to avoid disturbance of lands that occur during grading. + Requiring payment of the non-prime agricultural lands conversion fee in accordance with the Coastal Act. + Requiring a 4:l vs. 3:l mitigation for wetland impacts to ensure wetland is sufficiently replanted. + Allowing further details of the mitigation program to be developed at the time of development permit review. Mr. Westman noted, for clarification at this point, that a newly redrafted City Council Ordinance, Exhibit A, had been distributed to replace Exhibit A of this item. The reason the Ordinance was redrafted was that a section providing clarification of the mitigation program process had been omitted. The modification was done at the request of the Coastal Commission who felt the guidelines contained in pages V-8 through V-12 in Section E of the Biological Mitigation Program were not specific enough for permitting agencies such as Fish & Game and Wildlife, when reviewing a project. Further, the Coastal Commission felt that such vague guidelines could potentially require not only a Master Plan amendment but also a Local Coastal Program amendment. Therefore, the Coastal Commission felt it was better to eliminate the guidelines leaving the specifics to the discretion of the environmental agencies who could better determine what the mitigation should be, thereby eliminating the potential for having to go through a Master Plan amendment and/or a Local Coastal Program amendment. + Requiring trail and trailhead parking within Planning Area 1 to be built and available to the public prior to occupancy for any structures. Mr. Westman explained that the City of Carlsbad approved the project with the requirement to complete the trail and had been in negotiations with the applicant to have them maintain it as a public trail. While the applicant was not willing to maintain the public trail, a compromise was made at both a Planning Commission as well as a City Council meeting. The applicant was conditioned to complete the trail and make an offer of dedication to the City as a public trail. However, if the City does not accept dedication and maintenance responsibilities of that trail, the applicant is required to maintain it as a private trail. Coastal Commission took it one step further and the applicant agreed to take on maintenance responsibilities for a public trail. There is a condition stated in a July 3, 1996 letter by the applicant addressed to Planning Director Michael Holzmiller citing their concern over the difference of opinion between the City of Carlsbad and the Coastal Commission on the public nature of the trail. The letter went on to say that the applicant agreed with the Coastal Commission conditions. Mr. Westman added that while there may be a conflict between the City requirement in their tract map of operating the trail as a private trail, and the Coastal Commission operating the trail as a public trail, operating the trail as a public trail under the Coastal Commission condition still satisfies the City condition of building, maintaining, and operating a trail, whether or not it is public or private. Maintenance of the trail as well as the surrounding open space area within the Master Plan is covered through the establishment of the Homeowners Association throughout the Green Valley development and also through the approval of the CC&Rs. + Limiting architectural features to 3% of the total roof area of any building, the intent of which was to limit the amount of building that would exceed the 35’ height limit. While the Master Plan allows for projections up to 45’, the Coastal Commission made the condition to restrict this to only 3% of the total roof area of the buildings in an effort to address the visual impacts that could result with architectural projections above 35’. 13 MINUTES PLANNING COMMISSION July 3, 1996 Page 3 Mr. Westman said that staff reviewed these conditions and concurs with the Coastal Commission’s suggested modifications, and recommends adoption of the resolution which recommends approval to the City Council to incorporate these into the Green Valley Master Plan. Mr. Westman again noted changes that had been made to Exhibit A which is the City Council Ordinance, including: the third “whereas” on line 13 of page 1 was stricken; in keeping with Coastal Commission language, the word “suggesfecf to describe modifications, has been added to end of line 22 of page 1; the words “as shown herein” were added to line 26; the addition of “and recommended approval thereof as well as the following line, ‘Now, therefore, the City Council does ordain as follows:” has been added at the end of the second “Whereas” on page 2 which begins on line 7. Additionally, format changes including parentheses around numbers has been added, as well as clarification language, “beginning with Goals of the Mitigation Program” which was not originally included on page 3, lines 11 and 12 regarding pages V-8 through V-12 of Section E of the Biological Mitigation Program. Chairman Compas asked if there were any questions of staff. Commissioner Monroy stated his concern over funding of the trail’s maintenance by homeowner’s association fees since there are both retail and residential elements in that area. He wanted to know if the burden of the cost would fall solely on the homeowners. Mr. Westman said that while it is called a ‘homeowner’s association” the entire property within the Master Plan is covered by the common ownership. Both the retail as well as the residential elements would be responsible for covering the costs. Commissioner Monroy asked if some language clarifying that point could be added to avoid future misunderstandings. Mr. Westman said he would need to defer to the Asst. City Attorney for his suggestion on such a change of language. Asst. City Attorney Rudolf and Asst. Planning Director Gary Wayne asked to be allowed to confer on the matter. Commissioner Welshons queried about clarification on maintenance, and whether or not a conflict exists in the letter between the City’s Master Plan and the Coastal Commission with regard to this being a public or private trail. She wanted confirmation that the trail would be maintained, but couldn’t find it in black and white in the document because the current language just says that it is a public trail, but there is no clarification as to who and how it will be maintained. In addition, she asked about the liability issue of the trail and people who walk on the trail. Mr. Westman cited that a homeowners association was a typical example of the way other subdivisions in Carlsbad operated. With regard to maintenance, it is typically included in the CC&Rs. Therefore, while it is not specified that maintenance of the trail is included, such maintenance of the trail and open space will be included in the CC&Rs. Commissioner Welshons queried if there was some flexibility in changing the language contained in Exhibit A, the City Council Ordinance. Specifically, she wanted to know if it was Coastal Commission language that the Planning Commission had no control in changing. Mr. Westman asked to defer to the Asst. City Attorney. Mr. Rudolf said that it is possible to change anything preceding Section 1 of the Ordinance because those are just recitals. However, Section 1 and the language that follows is intended to incorporate the suggested \h MINUTES I PLANNING COMMISSION July 3, 1996 Page 4 modifications of the Coastal Commission. Unless the Planning Commission accepts the language as it is established by the Coastal Commission in this document, then such action is considered amending the amendment, and the whole Local Coastal Program amendment dies because it has not been accepted. There are two choices: either accept the language contained in the document, or reject it. Commissioner Welshons asked, in light of Mr. Rudolf’s comment above, how was language added to Section F on page 3 of the redrafted City Council Ordinance? Mr. Westman responded that the language did come from the Coastal Commission. It had not been included because of staff error. Mr. Rudolf pointed out again that if the Planning Commission was not content with the language as it was presented, the amendment could be rejected. A companion minute motion could be made to have staff explore and present findings to the Planning Commission at a future meeting. Commissioner Welshons asked Chairman Compas if the Commission could reconcile the difference of what the Master Plan says as far as this trail being a private trail and what the Coastal Commission says as far as it being a public trail. Specifically, she wanted to know how the Commission could reconcile the difference. Chairman Compas asked how to go about fixing it. Mr. Wayne explained that it could be fixed at the tentative map level so that the map would be in concert with the action on the Master Plan. Mr. Rudolf added that fixing it could be done one of two ways. One would be to do a formal amendment to the tentative map. The other would be for the Engineering Department to recommend that the final map be approved because the provision of the public trail, in accordance with the Master Plan as set forth by the Coastal Commission, not the City, is in substantial compliance with the tentative map. Chairman Compas queried whether the City has any homeowners associations in which commercial entities are included. Mr. Wayne answered that Aviara Planning Area 23 includes commercial areas within its homeowner’s association. Commissioner Heineman suggested that “homeowner’s” be referred to as “property owner’s” association to avoid confusion and provide clarification of who is responsible for maintenance within the established CC&Rs. Mr. Westman answered that if there was anticipation of making changes to the tract map, it could be done at that time. Mr. Rudolf explained that the Planning Commission did not have to make that call tonight. Commissioner Welshons said she would like to follow through with a minute motion and ask staff to pursue whatever is the most appropriate direction to take, and report back to the Planning Commission of whether to handle it as substantial conformance or as a formal amendment. Chairman Compass asked the applicant to come forward. The applicant not being present, Chairman Compas opened the agenda item up for public testimony. Commissioner Monroy queried whether the City was trying to take over the functions of the Coastal Commission, and was this situation setting a precedent. MINUTES PLANNING COMMISSION July 3, 1996 Page 5 Mr. Westman answered that the Coastal Commission still had authority, and that this was the second time this type of situation had occurred. Commissioner Monroy stated that he felt the Commission should set some sort of direction. Mr. Wayne explained that two standards had been followed: the Coastal Commission and the City. Additionally, when it comes time for the City to administer the LCP, the City will require the trail to be public.
