RECOMMENDED ACTION:
ADOPT Resolution of Intention No. ::.,I -!* 2 . ~ .- directing staff to conduct a
use study for the south shore of Agua Hedionda Lagoon. An alternative would I
direct staff to initiate a comprehensive review and update of the entire Agua Hedi
Local Coastal Plan as requested by the Agua Hedionda Lagoon Foundation.
ITEM EXPLANATION:
At a recent City Council workshop, staff was directed to prepare a Resolutic
Intention to study existing and future land use along the south shore of Agua Hedi
Lagoon. The General Plan currently designates the majority of the south shor
open space. There are, however, a couple of areas designated for non-open s
uses. The intended purpose of the study was to determine if the entire south :
should be designated for open space uses only. Attached is the Resolution of lnte
to initiate the study. Staff estimates that it will take approximately six montl
complete the study.
Subsequent to the workshop, the City received a letter from the Agua Hedi
Local Coastal Plan for the entire lagoon area. A copy of the letter is attached.
Foundation believes that the entire Plan needs to be studied because it hasn't
reviewed since its adoption in 1982.
The Agua Hedionda Coastal Plan was originally prepared by the City and submitt
the Coastal Commission in 1977. The Plan was returned to the City by the Cc
Commission with 32 issue areas requiring modifications before the Commission c
approve it. The City Council then appointed a Negotiating Committee to addres
32 issue areas. After a couple of years of negotiations, the issues were addressec
the Plan was revised and resubmitted to the Coastal Commission. The Plan was I
adopted in 1982 or 5 years after it was initially prepared.
At this point in time, staff needs direction from the City Council on whether the Cc
wishes to have staff do a focused land use study for the south shore of Agua Hed
attached Resolution of Intention, or whether the Council wants the study expand
include a comprehensive review and update of the entire Agua Hedionda Local Cc
Plan (LCP). The major differences with the expanded study area are as follows.

FISCAL IMPACT:
The study for the land on the south shore of the lagoon, will be completed in-hou:
City staff. Therefore, only the cost of staff time to complete the study woul
required. If the Council directs staff to review the entire Agua Hedionda Local Ca
Plan area, some consultant assistance may be required. Staff estimates cons1
costs could range from the $25,000 to $50,000 and would have to be transferred
the Council's contingency account.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA DECLARING THE INTENTION
TO STUDY THE LAND USES PERMITTED BY THE CITY’S
GENERAL PLAN, COASTAL PLAN AND ZONING MAP
ALONG THE SOUTH SHORE OF AGUA HEDIONDA
LAGOON
WHEREAS, the City of Carlsbad General Plan, Agua Hedionda Coasta
the City’s Zoning Map currently designates most of the south shore of Agua Hedionl
for open space uses; and
WHEREAS, there are a couple of areas as shown on the attached m
Exhibit “A” which are designated for non-open space uses; and
WHEREAS, the Agua Hedionda Land Use Plan was originally prepa
City in 1977 and approved by the Coastal Commission in 1982; and
WHEREAS, the City Council wishes to study the appropriateness of
space uses on the south shore of Agua Hedionda Lagoon and wishes to consider if
south shore should be designated for open space on the General Plan, Local Coasta
Zoning Map.
NOW, THEREFORE, BE IT RESOLVED by the City Council of t
Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That it is the intention of the City Council to consider amending the Ge
the Local Coastal Plan and the Zoning Map to designate the entire 2
south shore of Agua Hedionda Lagoon to open space.
3. That the City Council directs the Planning Director to conduct the
studies, notices, and reports and bring this matter without undue delay

Dear Mayor Lewis and Councilmembers:
San Diego Gas & Electric Company (SDG&E) was surprised and lsturbed to learn about the
proposed Resolution of Intention to be considered at the Council’s meeting of September 10.
As you know, SDG&E abstained from any planning efforts on its Encina East property at the
specific request of the City in order to assist the City in its efforts regarding the Lego property.
One interpretation of the City’s actions is that the Company is being “rewarded’ for its
cooperation with an attempt to downzone SDG&E’s property and that the City proposes to spend
taxpayer funds to plan the Company’s private property. We are hopeful that this interpretation is
incorrect.
Please place this letter in the public record as a reflection that SDG&E opposes and objects to the
proposed Resolution of Intention. The Company will vigorously oppose, with litigation if
necessary, any efforts by the City to remove the existing commercial tourism designation on the
Company’s Encina East property.
SDG&E has been ready for some time to begin Specific Planning and Local Coastal Planning
(LCP) efforts for its Encina East property and to participate in an open and participatory
planning effort. We can only assume that the City’s action is an indication that negotiations with
Carlsbad Ranch and Lego are completed and that it is now appropriate for SDG&E to proceed
with its planning.
SDG&E looks fonvard to meeting with the Council, City stafY, the Agua Hedionda Lagoon
Foundation and other interested community members to discuss the planning opportunities for
Encina East.
I have asked Joe Larkin, Director of Real Estate Operations, to begin that process.

The foundation strongly urges the City Council to vote in favor of expanding the
study to include a cornprchtnsive review of the lagoon and update the entire Agua
Hedionda Local Coastal Plan (LCP) instead of P piece-meal approach which focuses
only on down-zoning 3 portion of tbhe lagoon's ptrimeter.
Carlsbad is it1 a very unique position to have 3 lagoons within its city bouddarics. Aqua
Hedionda Lagoou is even more unique due to is central iocation and it's many faceted
activities. The current xtiuities include recreation, commer-ciai and residential
development, aqua culture. a fish hatchery, natural habitat and open space areas and tratis
just to natne a few. The lagoon is poised to become the next real jewel of this city and the
source of countless community actiwties for its citizens to enjoy. However, without
proper fol-esight and comprehensive overall planning, the hture of Agua Hedionds
Lagoon is at serious risk.
As stated by the foundation in the Mach 18 lctter to the Planning Direclot, the Agsg
He&& LCp is nearly 20 years old and does not take into consideration the emerging
conditions. The city is gowing around the lagoon and activities have six\lply been
&wed t~ progms iaou( any overall plan and very little input from the wm1nunity.
The foundation bek~es that a upiwe-me~i'' approach to planning would seriously
impact the lagoon and most likely prevent it from ever reaching its full potential for
the community to enjoy. Making any zoning decisiom without 8n overall pbn for
the lagoon is equivalent to bufldmg a howc without a blueprint; before YOU know it,
YOU have a second story without any access.

The overall weifare of fhe lagoon is snch a critical platform of our foutldation that we
have reoently applied for, and are about to receive. a Coastal Conservancy Grant to assist
in ths development of an overall framework pla11 for Agua liedionde Lagoon Hopefully, I
our plans will dovetail nicely with the City's. Ultimately, working together, we will be
able to devdop an aquatic paradise that nccentuates all of the natural amenities that
comprise the lagoon today.
Again, I encourage the City Council to recommend to staff that they embark on an overdl
lagoon plan and update the LCP immediately I also encourage City Council to direct stafl'
world-class lagoon whle we stfl have the opportunity.

Dear Mayor Lewis:
As you may know, Hillman Properties is currently in escrow to purchase the Kelly
Ranch.
I recently was sent a copy of Staffs recommendation and proposed Resolution of
Intention in which Staff is requesting the City Council to consider "....if the entire so1 shore should be designated for open space on the General Plan, Local Coastal Plan : Zoning Map ...."
The approved Kelly Ranch Master Plan (MP-174) approved in 1984, designates Villz
"Fq (8.6 acres) as recreational/cornmercial. It is my understanding that the Coastal Permit for Kelly Ranch is vested and that the approved land use provisions are
confirmed. The City should not attempt to "take" private property by disallowing it5
use (other than open space) without proper and fair compensation. We are amazed
the City Staff would recommend the expenditure of $25,000 - $50,000, plus Staff timt
without first havhg ample discussion with the affected property owners. We are not
aware of any mticing, or invitatim to, a recent City Cwncil workshop.
In the context oi a iand use study of the south shore of Aga Hediaeia hgscq YE would support a study that considered and fully evaluated all of the land use alterna
and the economics of each. On the face of the matter, it is clear to me that the Ci?
Staff lacks vision on the highest and best use of the Cannon Road corridor. It takes
very little imagination to envision a spectacular water-oriented commercial developn: on the SDG&E owned south shore property (to compliment the Leg0 project), and 1
continuing to the Kelly Ranch where the preponderance of development wjll be
residential, but also with a small recreational/commercial development on Village "I
I request that the City Council continue this matter to a future City Council agenda
to direct Staff to conduct workshop meetings with all of the affected property ownel
attendance.
