RECOMMENDED ACTION:
If Council concurs your action is adopt Resolution No. 9J-d/j approving the Tentative
Subdivision Map (CT 93-01) and Planned Unit Development (PUD 9505).
ITEM EXPLANATION:
The City Council, at your meeting of September 10, 1996, voted 4-O to approve the Tentative
Subdivision Map (CT 93-01) and Planned Unit Development (PUD 95-05), and directed the City
Attorney to prepare the necessary document. That document is attached.
Condition No. 29 was amended to decrease the affordable housing units from 27 to 20.
The Council should satisfy itself that the findings and conditions as recommended by itself and the
Planning Commission accurately reflect your intentions in the matter.

RESOLUTION NO. 96-313
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING A TENTATIVE
SUBDIVISION MAP (CT 93-01) AND PLANNED UNIT
DEVELOPMENT (PUD 95-05) TO SUBDIVIDE 188 LOTS
INCLUDING 181 RESIDENTIAL LOTS, 4 OPEN SPACE
LOTS, AND 1 FUTURE LOT, FOR RANCH0 CARRILLO
VILLAGES “J” AND “K” ON PROPERTY LOCATED SOUTH
OF PALOMAR AIRPORT ROAD, ADJACENT TO FUTURE
MELROSE DRIVE AND NORTH OF THE RANCH0
CARRILLO PARK SITE

WHEREAS, on May 15, 1998, the Carlsbad Planning Commission held a
duly noticed public hearing to consider a proposed Tentative Subdivision Map (CT 93-01)
and Planned Unit Development (PUD 95-05) for project development, and adopted
Planning Commission Resolutions No. 3931 and 3932 respectively, recommending to the
City Council that they be approved; and
WHEREAS, on August 8, 1998, the Housing Commission held a duly noticed
public hearing to also consider the project and adopted Housing Commission Resolution
la No. 98-009 recommending to the City Council that it be approved; and
19 WHEREAS, the City Council of the City of Carlsbad, held a public hearing on
20 September 10, 1998 to consider the recommendations and heard all persons interested in
21 or opposed to Tentative Subdivision Map (CT 93-01) and Planned Unit Development (PUD
22 95-05); and

24 WHEREAS, an Environmental Impact Report (EIR 91-04) was previously
25 certified on July 27, 1993, and this project complies with all applicable mitigation measures
26 outlined by Final EIR 91-04 for the development of Village “E” and, as proposed, this
27 project will not create any significant adverse environmental impacts,
28 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Tentative Subdivision Map (CT 93-01) and Planned Unit
Development (PUD 95-05) for this project are approved and that the findings and
conditions of the Planning Commission contained in Resolutions No. 3931 and 3932,
respectively, on file with the City Clerk and incorporated herein by reference, are the
findings and conditions of the City Council with the following amendment to Condition No.
29 to read as follows:
“Prior to the approval of the final map for any phase of this project, or
where a map is not being processed, prior to the issuance of building permits for any lots or
units, the Developer shall enter into an Affordable Housing Agreement with the City to
provide and deed restrict twenty (20) second dwelling units as affordable to lower-income
households for the useful life of the dwelling units in accordance with the requirements and
process set forth in Chapter 21.85 of the Carlsbad Municipal Code. The draft Affordable
Housing Agreement shall be submitted to the Planning Director not later than thirty (30)
days after final map submittal.
“The developer shall enter into an agreement with the City to
participate in an offsite combined inclusionary project in Village E to meet their 10% three
bedroom requirement (4 units), in accordance with the requirements set forth in Chapter
21.85 of the Carlsbad Municipal Code, the Ranch0 Carrillo Master Plan, and City Council
Policies 57 and 58. Prior to the City Council approval, the developer shall submit a signed
Affordable Housing Agreement to the Housing and Redevelopment Director. The recorded
Affordable Housing Agreement shall be binding on all future owners and successors in
interest.”
3. That staff is directed to process the appropriate amendments to the
related and approved site development plans for this tentative maps.
4. This action is final the date this resolution is adopted by the City Council.
The provision of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Judicial

“NOTICE TO APPLICANT’
‘The time within which judicial review of this decision must be
sought is governed by Code of Civil Procedure, Section
1094.6, which has been made applicable in the City of
Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any
petition or other paper seeking judicial review must be filed in
the appropriate court not later than the ninetieth day following
the date on which this decision becomes final; however, if
within ten days after the decision becomes final a request for
the record of the proceedings accompanied by the required
deposit in an amount sufficient to cover the estimated cost of
preparation of such record, the time within which such petition
may be filed in court is extended to not later than the thirtieth
day following the date on which the record is either personally
delivered or mailed to the party, or his attorney of record, if he
has one. A written request for the preparation of the record of
the proceedings shall be filed with the City Clerk, City of
Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, California
92008.”
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City
Council of the City of Carlsbad on the 17th day of SEPTEMBER 1996, by the
following vote, to wit:
