PLN 4 CITY MGR- RECOMMENDED ACTION: That the City Council INTRODUCE Ordinance No. &S -33 9 APPROVING Zone Code Amendment 96-08 and ADOPT City Council Resolution No. ‘??L -32a* APPROVING Local Coastal Program Amendment 96-07 and Zone Code Amendment 96-08. ITEM EXPLANATION: The Community Development Department has received multiple requests to allow corporate entities, generally located within the office/light industrial zone of the City, the ability to fly company flags. City staff have met with officers of various companies within the City and have constructed a Zone Code Amendment and Local Coastal Program Amendment that does not preclude the necessary safeguards to protect the citizenry from a proliferation of attention-getting devices, while simultaneously allowing the expression of membership within an organization. To ensure attention to compatibility and to design issues, the proposed code amendment would allow corporate flags only as part of an integrated sign program. Another provision of the proposed code amendment addresses potential proliferation of flags leading to “visual clutter”. Corporate flags would only be allowed for permitted uses on a single tenant lot or building. On August 7, 1996, the Planning Commission conducted a public hearing and recommended approval with a 7-O vote. Three members of the public representing Chrysler Pacifica, Daniels Cablevision, and the Carlsbad Chamber of Commerce, spoke in favor of the amendments. ENVIRONMENTAL REVIEW: The Planning Director determined that this project qualifies for a Class 1 Section 15301 Categorical Exemption under the California Environmental Quality Act and the filing of the Notice of Exemption is in compliance with Section 21152b of the Public Resources Code. FISCAL IMPACT: Aside from typical administrative costs associated with processing the zone code amendment and local coastal program amendment, no direct fiscal impacts will result to the City from the approval of ZCA 96-08 and LCPA 96-07. CASE NAME: CORPORATE FLAGS CASE NO. : ZCA 96-08 The City Council of the City of Carlsbad, California, does ordain as follows: SECTION I: That Title 21, Chapter 21.41 of the Carlsbad Municipal Code is amended by the addition of subsection 2 1.4 1.070( 11) to read as follows: “21.41.070(11) In addition to all other signs otherwise herein allowed, a single tenant lot or building, housing a non-conditionally permitted, non-retail use within the M, C-M, or P-M zone may maintain a company flag displaying a company logo, insignia, or registered trademark when flown on a flagpole in traditional combination with the Federal and State flags. Such company flag shall be no larger than four feet by six feet in size and no more than one flag per business entity within the City’s corporate boundaries is allowed. Such company flag shall not count towards the allowable signage area, but shall be allowed only as part of an integrated sign program subject to the approval of the Planning Director.” EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in a publication of general circulation in the City of Carlsbad within fifteen days after its adoption. Not withstanding the preceeding, this ordinance shall not be effective until approved by the California Coastal Commission. II. INTRODUCTION The project is a request for a Zone Code Amendment and Local Coastal Program Amendment by the Planning Department to allow company flags in certain limited, circumscribed situations. Presently such devices are prohibited under Section 21.41.050(2) of the Carlsbad Municipal Code. III. PROJECT DESCRIPTION AND BACKGROUND The Community Development Department has received multiple requests to allow corporate entities, generally located within the office/light industrial zone of the City, the ability to fly company flags. IV. ANALYSIS Company or corporate flags are presently prohibited under Section 21.41.050 Prohibited Signs “(2) Pennants, banners, streamers, whirligigs, or similar attention-getting devices.. .“. At the same time, under Section 21.41.060 the following described signs shall be exempt from the provisions of this chapter, “(5) The flag of a government, school, or religious group or agency;“. Review of the two municipal code sections noted above reveals the intent of the City’s sign ordinance; identification rather than distraction. The proposed Zone Code Amendment and G /t .- ZCA 96-08/LCPA 96-O I - CORPORATE FLAGS AUGUST 7,1996 Local Coastal Program Amendment states, “In addition to all other signs otherwise herein allowed, a single tenant lot or building, housing a non-conditionally permitted, non-retail use within the M, C-M, or P-M zone may maintain a company flag displaying a company logo, insignia, or registered trademark when flown on a flagpole in traditional combination with the Federal and State Flags. Such company flag shall not count towards the allowable signage area, but shall be allowed only as part of an integrated sign program subject to the approval of the Planning Director.” The issues addressed within this proposed ordinance include: l Non-retail orientation - The retail world deals directly with the consumer, and advertising is employed in an attempt to encourage buying. Anything that requires one to take note of or observe or draws the attention of, works as advertising. As the intent of this ordinance is to allow a sense of affiliation with an organization rather than offer another avenue to attract attention, it has been constructed to preclude retail participation. l Single lot or building only - To discourage the look of signal flags on a ship or the construction of more than three flag poles on a site, the ordinance limits the privilege of such display to single tenant lots or buildings. l Limits on display - The company flag is to be flown in traditional combination with the Federal and State Flags, so as to normalize its visual impact. To further normalize such display, it is limited in size to 4 feet by 6 feet, and no more than one flag per business entity is allowed. l Sign program - To ensure that the intent and letter of this amendment is accomplished, while not counting towards the allowable signage area, the company flag must be included as part of an integrated sign program subject to the approval of the Planning Director. V. Chairman Compas reminded applicant, the public and Commissioners that approval of this item would be forwarded to the City Council for its consideration. Project Planner Brian Hunter, stating that the City was the applicant, provided background for this item to the Commission. Mr. Hunter said there are four issues addressed within this proposed ordinance which include: non-retail orientation, single lot or building only, limits on display size, and sign program. As a matter of clarity, Commissioner Monroy said this wasn’t restricting to one flag pole, people could have three poles. Mr. Hunter responded that people would fly the flags in the traditional way, federal, state, and entity flag on three separate poles. Commissioner Nielsen asked if this included retail, to which Mr. Hunter responded it did not. Commissioner Nielsen asked this question because he believes there are retail corporate flags in the Redevelopment Area, and he wondered if this was done to legalize those, to which Mr. Hunter replied no. Chairman Compas opened public testimony and issued the invitation to speak. The first speaker was Paul Kirk, 3476 Sitlo Baya, Carlsbad. Mr. Kirk expressed his gratitude that the Commission was considering this item. He said that Chrysler Pacifica had been at its site in Carlsbad for 13 years and was planning on staying. He said that Chrysler has 200 facilities across the Country and Carlsbad is the only one that prohibits them from flying their corporate flag. Mr. Kirk showed the Commission his flag, which meets the 4’ x 6’ size requirement. Mr. Kirk added that he felt being able to fly a corporate flag gives the employees a sense of identity and pride. Commissioner Savary asked Mr. Kirk if he didn’t mind purchasing another pole if this item was approved. Mr. Kirk replied that they would fly all three flags on the same pole - federal at the top, state in the middle, and corporate below the state. Commissioner Savary asked Mr. Hunter if this is acceptable and Mr. Hunter said it is in conformance with the ordinance. The next speaker was Jan Sobel, 5411 Avenida Encinas, Carlsbad. Ms. Sobel is the new Chamber President and said that the Chamber wholeheartedly supports passage of this amendment. MINUTES /3 PLANNING COMMISSION August 7, 1996 Page 19 The last speaker was Phil Urbina, Daniels Cablevision, 5720 El Camino Real, Carlsbad. Mr. Urbina spoke in favor of this amendment and stated that Daniel’s, like Chrysler Pacifica, had flown a corporate flag for years before finding out it was not allowed. Mr. Urbina added that many of Daniel’s sister companies were allowed to fly their corporate flags, which are very tasteful. Mr. Urbina commended staff on crafting the amendment. Seeing no one else wishing to speak, Chairman Compas closed public testimony and opened Commission discussion. ACTION: Motion by Commissioner Monroy, and duly seconded, to adopt Planning Commission Resolutions No. 3968 and 3969 recommending approval of ZCA 96-08 and LCPA 96- 07, respectively, based upon the findings and subject to the conditions contained therein.
