RECOMMENDED ACTION:
gl-ssa/ Adopt Resolution No. amending the Memorandum of Understanding with the Carlsbad
Police Officers’ Association.
ITEM EXPLANATION:
On January 23, 1996, the City Council adopted Resolution No. 96-33 approving a Memorandum
of Understanding (MOU) with the Carlsbad Police Officers’ Association. It is recommended
that the Council amend Article 23. PROBATIONARY PERIOD of this MOU to delete the
current language in its entirety and replace it with new language as outlined in Exhibit A.
Current language in the MOU indicates that sworn personnel will be on probationary period for
one year from the date the employee is sworn as an officer, which occurs at the time of hire.
However, police recruits are sent to a police academy for 6 months after they are sVr;orn, leaving
only 6 months for a probationary period in the workplace after academy graduation. The new
language stipulates that the probationary period for police recruits will be one year from the date
of academy graduation, thereby giving both the City and the employee a full 12 month
evaluation period once the officer is actually in the workplace.
Representatives of the City and the Carlsbad Police Officers’ Association have met and
conferred in good faith and mutually agree to this amendment of the MOU regarding
probationary period.
FISCAL IMPACT:
There is no immediate fiscal impact associated with the aforementioned amendment to the
Memorandum of Understanding.

RESOLUTION NO. 96-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, MODIFYING THE MEMORANDUM OF
UNDERSTANDING BETWEEN REPRESENTATIVES OF
MANAGEMENT AND THE CARLSBAD POLICE OFFICERS’
ASSOCIATION.
WHEREAS, the City Council adopted Resolution No. 96-33 approving a
Memorandum of Understanding between representatives of Management and the
Carlsbad Police Officers’ Association on January 23 , 1996; and
WHEREAS, it has been determined by both parties that it is necessary to amend
this Memorandum of Understanding to replace ARTICLE 23. PROBATIONARY
PERIOD with language that allows police recruits a full 12 month probationary period in
the workplace after academy graduation, as outlined in Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of
Carlsbad, California, as follows:

That the Memorandum of Understanding between the Carlsbad Police
Officers’ Association and representatives of management is hereby amended as per
ExhibitA.
3. There is no immediate fiscal impact associated with the aforementioned

EXHIBIT A
ARTICLE 23. PROBATIONARY PERIOD
23.1 Police Recruit - The probationary period shall be one year fiom the date of academy
graduation.
Lateral Police Officer - The probationary period shall be one year from the date of hire.
Non-Sworn Personnel - The probationary period shall be one year fiom the date of hire.
The probationary period shall include scheduled days off and vacation days. Time off
for other leave, such as 4850 labor code and maternity leave are specifically not included
in the one-year probationary period.
23.2 All personnel promoted within the Department shall be on probation in the promotional
position for a period of one year fiom the date of promotion.
