CARLSBAD TRACT NO. 90-31 AVIARA PA 28. UNIT 1 I RECOMMENDED ACTION: Adopt Resolution No. ‘%-36/ approving the Final Map for Carlsbad Tract No. 90-31, Aviara Planning Area 28, Unit 1. ITEM EXPLANATION: Engineering staff has completed checking the Final Map of Carlsbad Tract 90-31, also known as Aviara Planning Area 28, Unit 1. This is the first unit of the 61 unit, single family residential project. This subdivision is within Local Facilities Management Plan (LFMP) Zone 19 and is located south of Batiquitos Drive at its intersection with Shorebird Lane. It is comprised of 34 lots with uses as follows: 32 residential lots, 1 open space lot, 1 private street lot. The Final Map conforms substantially with the tentative map as approved by Planning Commission on June 17, 1992 per Resolution No. 3410. The Final Map also conforms to the General Plan and all the applicable requirements of the Municipal Code and City Standards. The applicant, Brookfield Carlsbad, Inc., A California Corporation, is requesting the recordation of said Final Map. This map has been found to be consistent with the Growth Management Ordinance. The project density is 1.38 dwelling units per acre which is within the density range of O-4 du/acre specified for the site as indicated on the land use element of the General Plan, and is at or below the Growth Control Point of 3.2 du/acre. This map has been found to comply with the requirements of LFMP Zone 19. Currently, all public facilities within, or impacted by, Zone 19 meet or exceed the adopted performance standards. For a more complete analysis of the public facilities impact for this project, please see the attached Local Facilities Impact Assessment Form. The developer entered into a Park Agreement with the City of Carlsbad on June 1, 1989. This Park Agreement provided for dedication of 24.2 acres of land by Aviara for park purposes in conjunction with Aviara’s contained in Phase I project. The 32 residential units contained in CT 90-31 requires a park dedication of 0.223 acres. The Park Credit Accounting Ledger attached hereon has been updated to reflect this new project. The site has been previously graded as part of Aviara Phase II mass grading. In conjunction with the mass grading operation, the applicant has entered into an agreement with the California Coastal Commission, creating a deed restriction over the open space areas within the subdivision. This deed restriction prohibits any encroachment into said areas in perpetuity. Also in conjunction with the mass grading, the applicant has contracted with a licensed environmental consultant to provide construction observation and monitoring services for the mitigation measures required by the tentative map. The exact amount of Public Facility Fees are unknown until the applicant submits the application for Building Permits. Public improvements for this project include, drainage system, potable water system, reclaimed water system, and sewer system all to City Standards. The public street improvements serving this project are all existing. No detailed economic impact analysis of this development has been conducted. While increased operating expenses related to this project are expected to be offset from the increased tax or fee revenue, no exact percentage of offset can be predicted. This project is located within Community Facilities District (CFD) No. 1. Upon recordation of the Final Map, the CFD No. 1 special tax will be apportioned to all lots within the subdivision. Because this is a residential subdivision the owner will be required to pay the one-time special development tax upon issuance of each building permit within the project. This project is within Assessment District No. 88-l (Alga Road). The developer has signed an agreement to provide notification and disclosure of the assessment to potential home buyers. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That said Final Map known as Carlsbad Tract No. 90-31 from Brookfield Carlsbad, Inc., which is on file with the City Engineer and is incorporated herein by reference, is accepted. 3. That the City accepts the dedications shown on the Final Map. 4.
