PARTNERSHIP AGREEMENT FOR FUNDING THE
BRIDGE OVER SAN MARCOS CREEK DEPT. ENG CITY MGR 1 RECOMMENDED ACTION:
Adopt Resolution No. 56- 3 3 9 authorizing the Mayor to execute Program !
Agreement No. 020 to Local Agency-State Agreement No. 11-5308 providing fur
preliminary engineering and right-of-way phase of the bridge replacement project.
ITEM EXPLANATION:
The existing Rancho Santa Fe Road bridge over San Marcos Creek has been inadequate to handle future traffic demands and is projected to be totally submc 100-year storm flow in San Marcos Creek and to have about one foot of water over portion of the bridge during the 50-year storm flow.
Caltrans recently approved expenditure of $400,000 for the first phase of the bridge
process. This phase will cover preliminary engineering to select an alignment, environn
and studies to satisfy the National Environmental Protection Act (NEPA) ar
Environmental Quality Act (CEQA) and definition of right-of-way needed to construct 1 1 FISCAL IMPACT:
The local agency (Carlsbad) funding responsibility for this phase of the project would b
$400,000 (or actual costs) with the Federal portion being 80%. This project is la
Community Facilities District Number 2. Local funds to pay the 20% portion ($80,000) H
from the proposed Community Facilities District Number 2 or fees collected under agrc
developers for road improvements required by the Growth Management Plan and the LC Management Plans for Zones 11 and 12. Currently, there is $2.5 million available in Santa Fe Road project account.
Once completed, there would be increased operation and maintenance expenses re
project over that of the existing Rancho Santa Fe Road Bridge and roadway. Ho\
increased expenses are considered a beneficial tradeoff when compared to the incrl
and improved capacity of the new roadway.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR TO
EXECUTE PROGRAM SUPPLEMENTAL AGREEMENT NO. 020
PROVIDING FUNDING FOR THE FIRST PHASE OF THE BRIDGE
REPLACEMENT FOR THE RANCHO SANTA FE ROAD BRIDGE
OVER SAN MARCOS CREEK.
TO LOCAL AGENCY-STATE AGREEMENT NO. 11-5308
WHEREAS, the City and State have previously entered into Local-State i
No. 11-5308; and
WHEREAS, Caltrans has approved funding for preliminary engineering and ri
work for the referenced project; and
WHEREAS, the City of Carlsbad will administer the project; and
WHEREAS, the City Council finds that receipt of supplemental funding is bene1
transportation system of the State of California, County of San Diego and the City of
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
California, as follows:
1. That the above recitations are true and correct.
2. That the City Council authorizes the Mayor to sign both Program Su
Agreements No. 020 to Local Agency-State Agreement No. 11-5308 providing func
preliminary engineering and right-of-way phase of the project.
3. That the City Clerk's office forward the two (2) executed Program SL
Agreements No. 020 to Local Agency-State Agreement No. 11-5308 and a copy of
bill and signed Council resolution to the California Department of Transportation, Offi

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as re for efficient operation of the completed improvements.
\ 2. The Local Agency agrees the payment of Federal funds will k
limited to the amounts approved by the Federal Highway
Administration in the Federal-Aid Project Agreement (PR-2)/
Estimate, or its modification (PR-2A) or the FNM-76, and ac
any increases in Local Agency Funds as shown on the Finance Bid Letter or its modification as prepared by the Office of

3. This agreement supplements the Local Agency-State Master
Agreement for Federal-Aid projects, with the understanding all provisions of the 1991 Intermodal Surface Transportatio Efficiency Act (ISTEA) apply.
4. The Local Agency will advertise, award and administer this project in accordance with the current Local Program Proced
or the new Local Programs Manual, when issued.
5. Right of Way appraisal and acquisition cannot be initiated the Environmental document has been approved by the Federal Highway Administration and/or Caltrans.
6. This Program Supplement will be revised at a later date to
include other phases of,work.
7. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances1'
contained in the aforementioned Master Agreement for Federal-Aid Program.
