' 0 AB# 1 ?, 'io y TITLE: APPROVAL OF AN APPLICATION FOR GRANT FUNDS FOR THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION (EEMP) PROGRAM UNDER SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE MTG- -!/- /9 -?&L CITY Am- DEPT. RECOMMENDED ACTION: Adopt Resolution No. 961-3861 approving an application for grant funds for the Er Enhancement and Mitigation (EEMP) program under section 164.56 of the Streets an Code. ITEM EXPLANATION: The State of California Legislature has enacted legislation which provides $10 million ai period of IO years for grant funds to local, state, and federal agencies and non-profil projects to enhance and mitigate the environmental impacts of modified or new public tri facilities. Last year, the City of Carlsbad's application for $200,000 to landscape the Palomar Airp Interchange Enhancement project was approved. This year's application is for $250,00( landscaping of the La Costa Avenuell-5 Interchange Enhancement project. Since thc improved is within the highway right-of-way, grant funds can only pay for trees and irrigat FISCAL IMPACT: The City could receive up to $250,000 in state funding for the La Costa AvenueA-5 Enhancement project. Matching funds are not required. EXHIBITS: I. WHEREAS, the Legislature of the State of California has enacted AB 471 (Chaf the Statutes of 1989), which is intended to provide $10 million annually for a period o for grant funds to local, state and federal agencies and nonprofit entities for projects ti and mitigate the environmental impacts of modified or new public transportation facili WHEREAS, the Resources Agency has established the procedures and 1 reviewing grant proposals and is required to submit to the California Transportation Cl a list of recommended projects from which the grant recipients will be selected; and WHEREAS, said procedures and criteria established by the Resources Agenc resolution certifymg the approval of application by the applicant’s governing bc submission of said application to the State; and WHEREAS, the application contains assurances that the applicant must com WHEREAS, the applicant, if selected, will enter into an agreement with th California to cany out the environmental enhancement and mitigation project; WHEREAS, the City Council of the City of Carlsbad, California has detel necessity and desirability to apply for State funding for the La Costa Avenuell-5 I Enhancement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City o California, as foliows: 1. That the above recitations are true and correct. 2. That the City Council approves the filing of an application for the En Enhancement and Mitigation Program for grant assistance. 3.
