RECOMMENDED ACTION:
That City Council ADOPT City Council Resolution No. OIG - CII S APPROVING a request
for an amendment to Precise Development Plan l(C) to allow placement of a modular
office unit within the Encina Administrative Agency site on the east side of Avenida
Encinas between Palomar Airport Road and Poinsettia Lane.
ITEM EXPLANATION:
This is a request to allow placement of a modular office unit within the Encina
Administrative Agency site on the east side of Avenida Encinas between Palomar Airport
Road and Poinsettia Lane. The modular unit will provide an additional 528 sf of office
space. The applicant anticipates a continued need for the modular unit until a
remodeling of the primary office structure occurs. Consequently, staff has conditioned
the project to be approved for a maximum time period of seven years or until the
remodeling occurs, whichever occurs first.
The Planning Commission heard this project at a public hearing held on October 2,
1996, and recommended approval of the request unanimously.
ENVIRONMENTAL REVIEW:
The project was reviewed and found to be exempt from environmental review under
CEQA pursuant to Section 15301(c) (addition of no more than 2,500 square feet to an
existing facility).
FISCAL IMPACT:
The proposed modular unit will provide 528 sf of additional office space, thus generating
an average of IO additional trips per day. The unit will have no sewer or water service.
The project will be subject to traffic impact and bridge and thoroughfare fees for Local
Facility Management Zone 3 as required by the conditions of approval.

WHEREAS, Encina Administrative Agency, “Developer”, has filed a
verified application with the City of Carlsbad regarding property owned by Encina Joint
Powers, “Owner”, described as
a portion of Section 20 of Township 12 South, Range 4 West, San
Bernardino Meridian, according to the US Government survey
approved October 25, 1875 and a portion of Lot “H” of Agua

WHEREAS, said verified application constitutes a request for a Precise

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
W That based on the evidence presented at the public hearing, the Commission
RECOMMENDS APPROVAL of Precise Development Plan Amendment
PDP l(D), based on the following findings and subject to the following
conditions:
Findings:
1. The Planning Commission finds that the project, as conditioned herein, is in
conformance with the Elements of the City’s General Plan, based on the following:
a. Land Use - The proposed use (modular offke unit) is consistent with the
City’s General Plan in that the subject site is designated for Public Utility
uses.
b. Circulation - The existing circulation system is adequate to handle all
traffic generated by the existing use, and the proposed use will not
generate significant additional traffic.
2. The project is consistent with the City-Wide Facilities and Improvements Plan, the
applicable local facilities management plan, and all City public facility policies and
ordinances since:
a. All necessary public improvements have been provided or are required as
conditions of approval.
3. This project has been conditioned to comply with any requirement approved as part of
the Local Facilities Management Plan for Zone 3.
4. The Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section
15301(c) of the State CEQA Guidelines and will not have any adverse significant
impact on the environment.
5. The project is consistent with the P-U Zone regulations based on the following:

have been considered, and it has been determined that there will be no

c) The project is compatible with the surrounding development in that (1)
the modular building will be painted to match the existing adjacent office
building, (2) it will be low in scale (12’ maximum height), (3) it will be
adequately screened from Avenida Encinas by an existing fence and
landscaping, and (4) it will not generate any additional traffic.

The conditions of approval contained herein shall be in addition to the previous
conditions of approval. All previous conditions of PDP l(C), Planning Commission
Resolution No. 2830, shall remain in effect and shall be complied with in their
entirety.
The Planning Commission does hereby RECOMMEND APPROVAL of the Precise
Development Plan Amendment for the modular offrce project entitled Encina
Modular Office (Exhibits “A” - “B” dated October 2, 1996, on file in the Planning
Department and incorporated by this reference), subject to the conditions herein set
forth. Staff is authorized and directed to make, or require Developer to make, all
corrections and modifications to the Precise Development Plan Amendment
documents, as necessary, to make them internally consistent and in conformity with
final action on the project. Development shall occur substantially as shown in the
approved Exhibits. Any proposed development substantially different from this
approval, shall require an amendment to this approval.
The Developer shall comply with all applicable provisions of federal, state and local
ordinances in effect at the time of building permit issuance.
The Developer shall provide the City with a reproducible 24” x 36”, mylar copy of
the Precise Development Plan Amendment as approved by the final decision
making body. The Precise Development Plan Amendment shall reflect the
conditions of approval by the City. The Plan copy shall be submitted to the City
Engineer and approved prior to building, grading, final map or improvement plan.

The Developer shall include, as part of the plans submitted for any permit plan check,
a reduced legible version of the approving resolution on a 24” x 36” blueline
drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal
Development Permit and signed approved site plan.
This project shall comply with all conditions and mitigation measures which are
required as part of the Zone 3 Local Facilities Management Plan and any amendments
made to that plan prior to the issuance of building permits.
No outdoor storage of material shall occur onsite unless required by the Fire Chief. In
such instance a storage plan will be submitted for approval by the Fire Chief and the
Planning Director.

8. Prior to the approval of the Planned Development Permit, the Developer shall
receive approval of a Coastal Development Permit that substantially conforms to this
approval. A signed copy of the Coastal Development Permit must be submitted to the
Planning Director. If the approval is substantially different, an amendment to the
Planned Development Permit shall be required.
9. This project is approved for a time period of seven (7) years or until the existing
offke facility is remodeled, whichever occurs first.
General:
10. If any of the foregoing conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time; if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of
all future building permits; deny, revoke or further condition all certificates of
occupancy issued under the authority of approvals herein granted; institute and
prosecute litigation to compel their compliance with said conditions or seek damages
for their violation. No vested rights are gained by Developer or a successor in interest
by the City’s approval of this Precise Development Plan Amendment.

This approval shall become null and void if building permits are not issued for this
project within 18 months from the date of project approval.
Approval of this request shall not excuse compliance with all applicable sections of
the Zoning Ordinance and all other applicable City ordinances in effect at time of
building permit issuance, except as otherwise specifically provided herein.
The project shall comply with the latest non-residential disabled access requirements
pursuant to Title 24 of the State Building Code.

SUBJECT: PDP l(D) - ENCINA MODULAR OFFICE - Request for an amendment to
Precise Development Plan l(C) to allow placement of a modular office unit
within the Encina Administrative Agency site on the east side of Avenida Encinas
between Palomar Airport Road and Poinsettia Lane and within Local Facilities
Management Zone 3.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 3992
RECOMMENDING APPROVAL of PDP l(D) based upon the findings and subject to the
conditions contained therein.
II. INTRODUCTION
This application involves a request to allow placement of a modular office unit within the area of
the existing Encina Administrative Agency complex on the east side of Avenida Encinas. The
modular unit would be placed in an area previously designated for that purpose on a temporary
basis during Phase IV expansion of the facility.
III. PROJECT DESCRIPTION AND BACKGROUND
This project application is for placement of a modular office unit on the Encina Administrative
Agency property on the east side of Avenida Encinas. The proposed modular unit will be 12’
wide, 44’ long, and 12’ high and will provide 528 square feet of office space. The modular unit
will have wood siding and will be painted light brown with darker brown trim to match the
existing adjacent building. The modular unit will be placed on the western side of the property
adjacent to the existing office building. The additional office space will be used for current
employees who presently have inadequate space inside the primary office building on the site.
Since no major remodeling is expected for at least a few years, the modular unit will likely be
needed for several years. Staff has included a condition which establishes a time limit of 7 years
or until the current office facility is remodeled.
The location for the proposed unit already has underground telephone and electric’ ‘service
available as it was used for modular units previously. (During the Phase IV expansion of the
Encina facility in the late 198Os, three modular units were approved and placed in this area.
They were later removed when the Phase IV expansion was completed.) This area is currently
covered with gravel, The gravel area is surrounded by grass. No grading will be involved, and
no landscaping will need to be moved as a result of the proposed placement of the modular unit.
The project site is zoned PU (Public Utility) and has a U General Plan designation. The site is

surrounded by the Encina primary office building to the north, a parking lot and other Encina
uses to the east, a grassy lot and parking to the south and Avenida Encinas to the west. Beyond
the Encina Administrative Agency development to the north are more office buildings. To the
west, beyond Avenida Encinas, are railroad tracks and a mobile home park. The modular unit
will not be visible from beyond Avenida Encinas.
IV. ANALYSIS
The project is subject to the following regulations and requirements:
A. P-U (Public Utility) Zone (Chapter 21.36 of the Carlsbad Municipal Code);
B. Growth Management;
C. Mello II Segment of the Local Coastal Program; and
D. California Environmental Quality Act.
A. P-U Zone
An approved Precise Development Plan (PDP) is required for any development in the P-U Zone.
There is an approved PDP on the subject site (PDP l(C)). The purpose of the PDP requirement
is to ensure compatibility of the development with the General Plan and surrounding
development, to ensure consideration of environmental factors, and to provide for public
improvements and other conditions of approval necessitated by the development.
P-U Zone development standards include a minimum lot area of 7,500 square feet and a
maximum lot coverage of 50%. The project complies with both of these regulations and with the
zone requirements for parking/loading areas and landscaping requirements.
Staffs review of the proposed modular unit indicates that the unit is consistent with the General
Plan and compatible with surrounding development. The proposed unit will be an expansion of
the existing use, which is a permitted use in the P-U Zone and the U General Plan designation.
The modular unit will be placed on the western edge of the project area just south of and adjacent
to the primary office building and will be painted to match the office building. The proposed
modular unit is compatible with surrounding similar uses in that it: (1) will be low in scale (12’
maximum height), (2) will be adequately screened from Avenida Encinas by an existing fence
and landscaping, and (3) will not generate significant additional traffic.
The project site contains a total of approximately 52,900 square feet of development. About
60% of this total consists of “unoccupied” areas which contain chemical equipment, engines,
and structures to contain odors, noise, etc., but which do not provide employee work areas. The
“occupied” 40% (21,450 sq. ft.) includes the administration building (9,670 sq. ft.) and
maintenance/warehouse areas (11,780 sq. ft.). Based upon current parking regulations, the
“occupied” use areas on the site would require approximately 60 parking spaces. The site
currently provides 79 parking spaces, 19 more than required. The facility employs a total of 66

people. However, due to shift work, there are only approximately 38 employees working at any
one time. Therefore, staff has concluded that the parking currently provided will be adequate to
accommodate the proposed modular unit.
Staff reviewed the proposed project for environmental factors, and concluded that there will be
no environmental impact from the placement of the proposed unit. (See Section V.
“Environmental Review” of this report.)
Finally, no new public improvements will be required as a result of the placement of this unit,
(See Section IV. B. “Growth Management” of this report.)
Therefore, staff has concluded that the placement of the proposed modular unit is consistent with
all applicable regulations.
B. Growth Management
The proposed modular unit will have telephone and electric service via existing underground
lines. There will be no water or sewer service, and only 10 additional trips will be generated by
the unit. The project is conditioned to comply with the requirements of the Zone 3 Local
Facilities Plan.
C. Mello II Segment of the Local Coastal Program
The addition of the proposed modular unit is consistent with the Mello II segment of the Local
Coastal Program. The unit does not represent a new use or change of use on the subject site. It
is a minor expansion of the current use, and therefore, remains consistent with the Local Coastal
Program regulations. The project will, however, require a Coastal Development Permit.
V. ENVIRONMENTAL REVIEW
The proposed project has been reviewed and found to be exempt from environmental review
under CEQA pursuant to Section 15301(c) (addition of no more than 2,500 square feet to an
existing facility). Therefore, the Planning Director will issue a Notice of Exemption.

The Precise Development Plan ensures the compatibility of the project with the City's General Plan because:
The-site is designated for public utility uses and the project is consistent with the goal and policy of the Public Facilities Element of the General Plan to ensure public facilities are available concurrent with need.
The Land Use Plan of Carlsbadls Local Coastal Program specifically calls for the expansion of the Encina Water Pollution Control Facility.
The Precise Development Plan Amendment is in conformance with the P-U, Public Utilities Zone and ensures compatibility with surrounding development for the following reasons:
a) Conditions are imposed as part of this approval that mitigate all significant impacts resulting from the project: particularly visual and odor impacts.
b) The development is located in a depressed area that can be more easily buffered in Order to prevent adverse impacts to adjacent properties.
The proposed project conforms to the California Environmental Quality Act, and the Carlsbad Environmental Protection Ordinance since:
a) An EIR has been prepared and certified for the project.

All previous conditions of PDP l(A), City Council Resolution No. 6926 and Planning Commission Resolution No. 2113 are no longer applicable and shall be superseded by the conditions of approval contained herein.
In addition to the approval of the development indicated in the exhibits noted in Condition No. 1, all other requirements listed in this approval shall be indicated on the final Precise Development Plan. All subsequent communication concerning this project shall, when applicable, reference this Resolution Number and conditions contained herein.
PRIOR TO ISSUANCE OF BUILDING PERMITS:
a) Final landscape and irrigation construction drawings shall be submitted to the Planning Director for the entire facility and be subject to the approval of the Planning Director. The landscaping shall be designed to significantly screen facilities from views from I-5, and surrounding properties to the north, east and south. The drawings shall include fast growing tall and wide trees, as well as a combination of shrubs and ground cover. Plants shall be irrigated with reclaimed water to the maximum extent possible. Screening landscaping shall be installed upon completion of grading. Landscape and irrigation adjacent to building shall be installed immediately upon completion of any building construction.
b) A final lighting plan shall be subject to the approval of the Planning Director. All lighting shall be designed in a manner that will not adversely affect nearby residences or public roadways.
cl The applicant shall provide evidence that the retaining wall at the southeast corner of the site shall use a colored concrete mix which when dry shall be a color which blends into the surrounding background. This color mixture shall be reviewed and approved by the Planning Director. The intent of the colored concrete retaining wall is to allow the wall to better blend into the surrounding landscaping.
d) The applicant shall submit a reproducible.copy of Precise Development Plan l(C) which incorporates all requirements of the approval to the City Manager for.signature. Prior to signing the final Precise Development Plan, the City Manager shall determine that all applicable requirements have been incorporated into the plan and that all conditions of approval have been satisfactorily met or otherwise guaranteed. The final signed Precise Development Plan shall be the official site layout plan

for the property and shall be attached to any application for a permit on the subject property.
e) The applicant shall submit to the Planning Director for approval of an environmental mitigation monitoring and reporting program according to Section 21.081.6 of the Public Resources Code. This program shall be a part of this Precise Development Plan Amendment. The program shall include monitoring and reporting to the Planning Director the progress of all mitigation identified in the Final Environmental Impact Report for the project dated August 1988.
II . 5. PRIOR TO FINAL INSPECTION OF THE SITE:
a) The placement of equipment on any roof tops shall be screened from views along I-5 and from adjacent properties consistent with Building Policy 80-6 and subject to the approval of the Planning Director.
b) All landscaping as indicated in this approval shall be in place and in a condition to assure healthy growth as determined by the Planning Director.
cl The site's aeration basins shall be covered and odors from the basins controlled based on the best available technology.

6. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site.
7. The grading for this project is defined as "controlled grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under.the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code.
8. No grading shall occur outside the limits of the project unless a letter of permission is obtained from the owners of the affected properties.
9. A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits.
10. All slopes within this project shall be no steeper than 2:l.

11. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The contractor shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation.
12. Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer.
13. Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this Site Plan.
14. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project.
15. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities.
16. The applicant shall agree to utilize reclaimed water on the subject property in all common areas as approved by the City Engineer.

Irrigation systems to accommodate future reclaimed water shall be designed consistent with Title 17 of the California Administrative Code. Offsite future -reclaimed water distribution systems should be anticipated by the installation of adequately sized sleeves at crossing points to minimize street excavation.
Prior to issuance of a building permit, the applicant shall enter into an agreement with the City of Carlsbad whereby the applicant agrees to acquire adjacent right-of-way from the railroad for the purpose of constructing the full width improvement of Avenida Encinas including any necessary drainage, slope and construction easements. The applicant shall further agree to construct Avenida Encinas adjacent to the project to full width secondary arterial standards within the time frame as may be specified by the City Engineer.

19. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department.
20. Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal.

The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval.
All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site.
All fire aiarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction.

Project Planner, Elaine Blackburn opened her presentation by characterizing the site and outlining the
placement and use of the modular unit. She addressed the subject of parking by pointing out that there is
already adequate parking (which actually exceeds the Code requirements) for the proposed use including
the additional 528 square feet. Ms. Blackburn advised that Staff has reviewed the proposed project and
has concluded that it complies with all applicable regulations and is therefore recommending that the
Commission recommend approval of the project for the proposed seven (7) year time period, or until such
time as the overall facility goes through a remodeling effort, whichever occurs first.
Chaiman Compas invited the applicants representative to come forward.
Nancy Anson, Laboratory Manager, Encina Waste Water Authority, gave a brief history of Water Authority
employees having to be placed in remote office locations, since 1990, due to ever increasing over-
crowded conditions, and concluded by stating that the modular unit is an alternative to having to place an
undue tax burden on the tax-payers by remodeling an existing building to provide adequate space.
Chairman Compas opened public testimony. Seeing no one, he closed public testimony and opened
Commission discussion.
Commissioner Nielsen asked City Attorney Ball if it is possible for anyone to place a modular unit in the
industrial parks property. Mr. Wayne asked Ms. Blackburn to answer the question. Ms. Blackburn stated
that, typically, temporary modular offices require a CUP and if a request of that nature were to come in, it
would require a CUP and therefore the Commission would be reviewing it.
Mr. Wayne explained that the City amended its Code to allow temporary modular offices, only during the
construction of permanent office facilities. Because the Code does not address the issue, the City has
created a Community Development Policy that allows temporary modular units to serve as offices (during
remodels) and temporary training facilities, so that an existing business would not be inconvenienced
when it wanted to up-grade. In response to Commissioner Nielsen’s direct question, Mr. Wayne
answered, “no”. A modular unit cannot be placed on an industrial lot without a Planned Industrial Permit.
Schools, on the other hand, can bypass certain parts of the City’s process. Modular units used as public
buildings, he pointed out, require CUPS.
