ENG PROJECT 3409 CITY MGR. RECOMMENDED ACTION: c c. $.?-“I) Adopt Resolution No. 96 - YYZ authorizing reimbursement of costs for construction of Hidden Valley Road. ITEM EXPLANATION: On March 22, 1994, the City Council approved CT 92-05. A condition of that approval required Sambi Seaside Heights, the “developer”, to construct half street improvements for a portion of Hidden Valley Road which would provide access to the developer’s property Adjacent to this proposed subdivision was the City’s property which was planned for Poinsettia Park (see Exhibit 2). At the time Poinsettia Park was in the design phase, it was uncertain whether the Sambi Seaside Heights project or another nearby project (Greystone) would proceed with construction of the approved subdivisions. Included in the Park design were plans for the City to construct Hidden Valley Road from Camino de las Ondas to the northerly boundary of the park. Just after the City started construction of the park, Sambi and Greystone began construction. At this point, the City met with Sambi and reached an agreement whereby the developer would construct their half plus the City’s half of Hidden Valley Road. The City would then reimburse the developer for the City’s share of the construction. This agreement resulted in a savings of approximately $100,000 to the City. The developer has completed the construction of the Hidden Valley Road improvements and is requesting reimbursement in the amount of $121,865. Staff recommends that City Council authorize the Finance Director to reimburse Sambi Seaside Heights the cost of the City’s share for the Hidden Valley Road Improvements constructed by the developer. Funds are available in the project account. FISCAL IMPACT: Sufficient funds are available in the project account to reimburse the developer for the City’s portion of the street improvements. The City’s share is $121,865. The 19962003 Regional Transportation Improvement Program (RTIP) has allocated $120,000 towards the improvement of Hidden Valley Road and this amount can be applied to the City’s reimbursable funds. WHEREAS, the City Council of the City of Carlsbad, California has previously determined that construction of a portion of Hidden Valley Road adjacent to Poinsettia Park is necessary to provide access to the park; and WHEREAS, the City Council previously conditioned CT 92-05, Sambi Seaside Heights, to construct half street improvements for a portion of Hidden Valley Road; and WHEREAS, the Sambi Seaside Heights development agreed to construct the full street improvements; and WHEREAS, the City Council had determined that the City’s portion of the street improvements are reimbursable to Sambi Seaside Heights in the amount of $121,865; and WHEREAS, funds are available in the project account. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, . California, as follows: 1. That the above recitations are true and correct. 2. That the City Council hereby authorizes the Finance Director to reimburse Sambi Seaside Heights, developer, for the City’s portion of the construction of Hidden Valley Road in the amount of $121,865.
