Program for fiscal year I- 7 - 9 3 MEMORANDUM OF UNDERSTANDING FOR 3 1996-97. ITEM EXPLANATION: The City has agreed to provide the the Carlsbad Unified and San Dieguito Union High School Districts with the School Resource Officer Program for Carlsbad High School at La Costa Canyon High School respectively. The Police Department will staff one S.R.C Officer to each school in accordance with the M.O.U. Each school has agreed to pay 01 half the cost of a full-time police officer for the approximate nine month school term. On officer will cost $60,434. The pro-rated cost for nine months would be $45,324, half of which is $22,662. Each school would therefore pay $22,662 for their share of the cost ( an officer for a total of $45,324 for both schools. FISCAL IMPACT: The cost sharing payments of $45,324 will be placed into the General Fund Expense Account and will be used to offset the cost of the School Resource Officer Program to th City. That the Memorandum of Understanding for the School Resourc Program, attached hereto as Exhibit 2, between the City of Carlsbad ar Carlsbad Unified School District is hereby approved. 2. RAUTENKRANZ, City dlerk (SEAL) P e 0 MEMORANDUM OF UNDERSTANDING BETWEEN CARLsBAD WIED SCHQQL DISTRICT AND CITY OF CARLSBAD MISSION STATEMENT: It is the mission of the Carlsbad Police Department in concert with the CarlsbadUnified School District to provide a safe, secure, peaceful teaching and learning environment for all students and staff within the City of Carlsbad by protecting life and property. Ensuring the safety of students and staff on school campuses in Carlsbad is a priori to the school administration and the Police Department. Campus security will be increased by the presence of police officers who will interact with the students in both a positive and proactive manner. Police officers on campus will help improv relations between the police department and the youth of the community. Therefore the Carlsbad Unified School District and the City of Carlsbad have the following expectations and agree to undertake the listed responsibilities to achieve these mutual objectives: A. SCHOOL DISTRICT'S ROLE AND RESPONSIBILITY 1. To ensure student welfare portal to portal; 2. To develop procedures to handle campus safety issues; 3. To establish and follow procedures for referring police involvement; and 4. To cooperate with and support in a proactive manner the City of Carlsbad Policc Department to ensure the success of programs involving students, school personnel, parents and the community. B. SCHOOL RESOURCE OFFICER' ROLE AND RESPONSIBILITY 1. To provide prevention/intervention by: To provide high visibility of uniform police officer presence on the campus of the Carlsbad High School located in the City of Carlsbad. Developing classroom and faculty presentations relating to the youth and the law; Attending parent conferences/meetings; Attending S.A.R.B. TIMEFRAME This Memorandum of Understanding shall remain in effect for the 1996 - 1997 pu school fiscal year, and may be extended for such length of time as both parties mu agree to continue this Memorandum of Understanding. The officer will remain under the direction and control of the Carlsbad Police Department. Requests for work assignments will be issued from the Police Department, who will thereafter direct the School Resource Officer to respond appropriately to the request. E. Total compensation includes salary, estimated overtime and benefits. One officer will cost' $60,434 Total Compensation annually which is $5,036 monthly. Pro-rated on a nine month school year the cost would be $45,324. Therefore the Carlsbad Unified school District' share of the cost would be $22,662 for the nine month school year. This Memorandum of Understanding will be effective July 1,1996 and the Carlsbad Unified School District will pay annually, upon execution of this Memorandum, to the Finance Director of the City of Carlsbad the agreed amount of $22,662. If the agreement is canceled as herein permitted, e 0 Memorandum of Understanding Page 4 City shall forthwith return to the District the portion of such payment allocable to the period of the term subsequent to the effective date of cancellation. GI NO INDEPENDENT BASIS FOR LIABILITY Nothing herein shall create, by this or other Understanding between the parties, an independent basis for liability of the City to either the District or to a third party for failing to respond or for responding to a call for police services in a dilatory or negligent manner. The City’s liability, if any, shall be determined by law without regard to the existence of this Agreement.
