The project is located in Local Facilities Mana (LFMP) Zone 6, between Rancho Santa Fe Road and Melrose Drive, and, north and : Road. The tentative map was originally approved on October 22, 1985, in accordance with Resolution No. 8219 and was subsequently tolled for a number of years. The expirati this tolling period was March 14, 1993. At that time, the tentative map was aga pursuant to City Council Resolution 93-311, to March 14, 1994. Due to financing unc Rancho Santa Fe Road (RSF)/Melrose Drive, a final map was still not recorded for 1 Again, an extension would have to have been processed for this tentative map t however, on September 13, 1993 the state automatically extended all active tentative Meadowlands benefited from this state mandated extension legislation, so the tentati once again extended, to March 14, 1996. Since the developc negotiating in good faith with Engineering Department staff regarding the financing and of their portion of RSF/Melrose Drive, staff is recommending that the requested te extension be granted. The applicant has executed an Agreement for "Waiver of Prohibitions Against the 11 Conditions" which is on file in the City Clerk's Office. This standard agreement has bc by the city Attorneyk office to include a definite and final expiration date for this tei which the developer has agreed to. If a final map is not recorded then this tentativ expire on February 14, 1998. Resolution No. 2488 and City Council original Resolution No. 8219 and extension Resoh 311 are still applicable to the project; however, Engineering Condition No.'s 43, 44, 46 58, 59 and 66 have been revised as follows: Revised Condition No. 43: This condition has been deleted and replaced wit Condition "B. The condition was deleted because the Melrose Drive improvc exist. Revised Condition No. 44: This condition has been deleted. Payment in lieu of of the RSF/Melrose Drive intersection will be made. The condition was deleted to allow the City greater flexibility in deten geometric configuration for the RSF/Melrose drive intersection. Prior to approval, the project was reviewed analyzed for environmental impacts. Staff determined that there was no subst, evidence that the project would have a significant adverse impact on the environme Negative Declaration to that effect was issued on July 27, 1985. Prior environm documents are on file in the Planning Department. Subsequent to approval of the Negative Declaration, in March 1993 the U. S. Fist Wildlife Service (USFWS) listed the California Gnatcatcher as a threatened species. P same time, the USFWS imposed restrictions on the removal of Coastal Sage Scrub, hi for the Gnatcatcher. More recently, the USFWS also listed the Del Mar Manzanita i endangered species. Both of these listings constitute a change in circumstance: Section 15162(a) and (c) of the California Environmental Quality Act and re subsequent environmental review of the site relative to these species. A biological survey of the site was performed on July 31, 1995 by Oudek and Associ Th.e survey revealed that two habitat types were present on the site: redueral disturbed Coastal Sage Scrub (dCSS). Because of the relatively poor quality, structure composition of dCSS on the proposed project site, it is unlikely that California Gnatcat' would use the area for nesting. Although the USFWS agreed that the site was not likt support Gnatcatchers, they did indicate that impacts to the dCSS would require mitis at a ratio of 1 : 1 by area. Approximately 1.3 acres of dCSS occur within the approximate 35-acre project site. though the coastal sage located on the site has been disturbed, staff considers its ren a significant environmental impact. Prior to project implementation, mitigation mea: will need to be identified and approved by USFWS under the 4(d) Rule for interim tal dCSS. The loss of 1.3 acres of dCSS could be mitigated by on-site revegetation or thr off-site purchase. To mitigate the above-listed impacts, the requested tentative extension has been conditioned to require permit approval from the US Fish and Wi the environmental impacts of removal of the .1.3 acres of dCSS will be reduced to a le\ insignificance. On October 29, 1996, another field survey (on file in the Planning Department) conducted to survey the site for the federally-listed endangered species, Del Manzanita. The survey determined that'there was no Del Mar Manzanita located 01 subject site and therefore, there are no environmental impacts relative to this species. The City has concluded in good faith that proper environmental analyses have completed regarding the changed circumstances, that adequate mitigation measures been incorporated as part of the tentative map extension, and that environmental imF have been reduced to a level of insignificance. Prior to approval, the project was reviewed i analyzed for environmental impacts. Staff determined that there was no substan evidence that the project would have a significant adverse impact on the environmenl Negative Declaration to that effect was issued on July 27, 1985. Prior environrnei documents are on file in the Planning Department. Subsequent to approval of the Negative Declaration, in March 1993 the U. S. Fish i Wildlife Service (USFWS) listed the California Gnatcatcher as a threatened species. At same time, the USFWS imposed restrictions on the removal of Coastal Sage Scrub, habi endangered species. Section 15162(a) and (c) of the California Environmental Quality Act and reqi subsequent environmental review of the site relative to these species. A biological survey of the site was performed on July 31, 1995 by Dudek and Associatc The survey revealed that two habitat types were present on the site: redueral a disturbed Coastal Sage Scrub (dCSS). Because of the relatively poor quality, structure, a composition of dCSS on the proposed project site, it is unlikely that California Gnatcatchc would use the area for nesting. Although the USFWS agreed that the site was not likely support Gnatcatchers, they did indicate that impacts to the dCSS would require mitigati at a ratio of 1 : 1 by area. Approximately 1.3 acres of dCSS occur within the approximate 35-acre project site. Ev though the coastal sage located on the site has been disturbed, staff considers its remo\ a significant environmental impact. Prior to project implementation, mitigation measur will need to be identified and approved by USFWS under the 4(d) Rule for interim take dCSS. The lass of 1.3 acres of dCSS could be mitigated by on-site revegetation or throu! off-site purchase. To mitigate the above-listed impacts, the requested tentative m extension has been conditioned to require permit approval from the US Fish and Wildli Service prior to approval of the final map. As conditioned by the tentative map extensio the environmental impacts of removal of the 1.3 acres of dCSS will be reduced to a level insignificance. On October 29, 1996, another field survey (on file in the Planning Department) wi conducted to survey the site for the federally-listed endangered species, Del M Manzanita. The survey determined that’there was no Del Mar Manzanita located on tt subject site and therefore, there are no environmental impacts relative to this species. The City has concluded in good faith that proper environmental analyses have bee completed regarding the changed circumstances, that adequate mitigation measures ha\ been incorporated as part of the tentative map extension, and that environmental impaci have been reduced to a level of insignificance, for the Gnatcatcher. More recently, the USFWS also listed the Del Mar Manzanita as Both of these listings constitute a change in circumstances 2 Rev. 03/28/96 e 0 DETERMINATION o I find that the proposed project COULD NOT have a significant effect on environment, and a NEGATIVE DECLARATION will be prepared. I find that although the proposed project could have a significant effect on environment, there will not be a significant effect in this case because mitigat measures described ABOVE have been added to the project. A SUBSEQUE NEGATIVE DECLARATION will be prepared. (XI I find that the proposed project MAY have a significant effect on the environme and an ENVIRONMENTAL IMPACT REPORT is required. I find that the proposed project MAY have significant effect(s) on the environme but at least one potentially significant effect 1) has been adequately analyzed in earlier document pursuant to applicable legal standards, and 2) has been address by mitigation measures based on the earlier analysis as described on attach sheets. As we discussed on the telephone yesterday, because your letter was addressed to the Community Development Department address at Las Palmas Drive, rather than the City Clerk’s address at City Hall, the City Clerk did not limited resources and has the further disadvantage of being physically decentralized, so that your request for records in virtually every department in receive your letter until July 1, 1996, As you are aware, this is a small city with r 4 i 0 0 Y the City requires extensive coordination at a multiplicity of facilities. The City Clerk and I are attempting to coordinate a response to your request as quickly as possible. Once we obtain some idea of the number of documents and time involved in locating copying those documents, we will provide you with a cost estimate for a deposit to cover our costs of locating and copying them. Since your request deals with records as far back as 1986, many of them may have been destroyed or are in storage, and it may take several weeks to locate and/or withholding their disclosure, where such withholding would be authorized by the Public Records Act. So far the City Clerk has produced an 11 page computer printout identifying documents which might be responsive to your request. Don Rideout, the City’s growth management guru, indicates that the Citywide Facilities and Improvements Plan is a bound document available at the Community Development Facility at Las Palmas for sale to the public for $8; copies of the Local Facilities Management Plans for Zones 6, 11 and 12 similarly are available for sale to the public at the Community Development Facility at Las Palmas for $8, $20, and $20, respectively. Additionally, Mr. Rideout estimates that there are approximately 1,000 pages of documents which might be responsive to your request in the central files at Las Palmas and/or in his personal office, which would require approximately 16 hours of clerical time to retrieve and copy. It is difficult to say at this point how many documents in Community Dvelopment, Public Works, Engineering, Building, Planning, Finance, City Manager and City Attorney’s office relate to Carlsbad Tract Map No. 85-19, but this will obviously be the hardest to comply with because of the breadth and lack of specificity of the request. We will keep you advised of our progress in locating and identifying the documents responsive to your request.
