SETTLEMENT OF WORKERS'
COMPENSATION CLAIMS OF THOMAS
RECOMMENDED ACTION:
Adopt Resolution No.??-IS approving the Stipulations with Request for Award which
authorizes the payment of $ 14,171,OO to Thomas Oakley.
ITEM EXPLANATION
Mr. Oakley is a former custodian with the City who was hired in 1989. In 1993, he sustained
a back injury while lifting some shelves. As a result of this injury, he underwent back surgery
and was determined to be unable to continue in his employment as a custodian.
The terms and conditions of the proposed settlement are set forth in the Stipulations with
Request for Award on file in the Risk Management office. The terms and conditions were
agreed upon by the attorney representing the claimant and the attorney representing the City,
and have been approved by HCM Claim Management, the City's Third Party Administrator,
and the Workers' Compensation Appeals Board.
FISCAL IMPACT
The total cost of the settlement is $14,171.00. There are sufficient fbnds available in the
Workers' Compensation Self-Insurance Fund to cover the cost of this settlement.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA,
AUTHORIZING THE EXPENDITURE OF FUNDS
FOR SETTLEMENT OF THE WORKERS
COMPENSATION CLAIMS OF THOMAS OAKLEY
WHEREAS, Mr. Dan Trovillion, Defense Counsel for the City of Carlsbad in this
matter, has recommended a settlement of the Workers Compensation claims of Thomas
0akley;and
WHEREAS, there are sufficient knds available in the Workers Compensation Self-
Insurance Fund to pay the settlement,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:

That the above recitations are true and correct.
That the expenditure of $14,171.00 fiom the Workers Compensation Self-
Insurance Fund is authorized for the settlement of said claims.
That the Council accept the Stipulations with Request for Award on file in
the Risk Management Office.
