ITEM EXPLANATION:
On August 15, 1995, the final map for CT 91-02 (Eagle Canyon), a residential development of
29 dwelling units, was approved by the City Council. One of the conditions of development was to
pay a Planned Local Drainage Area (PLDA) fee per the Master Drainage Plan. Another condition
was to construct a storm drain along the south edge of the subdivision. This storm drain was included in the Master Drainage Plan, Area B. Since the cost of the Master Plan drainage structures constructed by the developer was in excess of the PLDA fee, the developer is eligible for
reimbursement for the excess amount, provided there are sufficient funds within the PLDA fee
account for that area.
The developer, D. R. Horton, has requested reimbursement in the amount of $62648.50 (Exhibit 3). Staff reviewed the details of the request, found some items that were not Master Drainage facilities (they were disallowed), some items were left out (they were added) and found that the developer had not deducted the PLDA fee amount from the total cost. With all of the corrections, staff recommends that the developer be reimbursed for excess costs in the amount of $53,239.
FISCAL IMPACT:
The Master Drainage Plan provides for reimbursement to a developer when Master Drainage Plan facilities are constructed by the developer and the cost is in excess of the PLDA fee the developer
would have otherwise paid. For the purpose of reimbursement, the developer’s actual cost of
constructing the facilities or the estimated cost of the facilities from the Master Drainage Plan shall
be used whichever is the lesser amount.
The developer’s actual cost was determined to be $82,455 which is lower than the Master Drainage
Plan estimate of $90,045. The PLDA fee obligation (which was not paid at the time of final map
approval) is $29,216. Therefore, the reimbursement due is $82,455$29,216 or $53,239. The
details of the cost estimates are presented in Exhibit 2.
There are sufficient funds in the PLDA, Area B fee account to pay this amount.

Please accept this letter as our formal “Request For Refund” for the reimbursement
of the Drainage Fee Credit referenced in your letter dated March 29, 1995 (see
attached copy).
Also attached are copies of our invoices showing the actual costs for the
installation of the storm drain improvements. The total amount of the refund
requested is $62,648.50.

RESOLUTION NO. 97-43
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE REIMBURSEMENT OF DRAINAGE COSTS IN EXCESS OF FEE OBLIGATION.
WHEREAS, the City Council of the City of Cartsbad, California approved the final map for
Carlsbad Tract No. 91-02 on August 15, 1995; and
WHEREAS, the developer, D. R. Horton, is obligated to pay a Planned Local Drainage
Area fee; and
WHEREAS, said developer constmcted Master Drainage Plan facilities with a cost
greater than the required Planned Local Drainage Area fee; and
WHEREAS, the Master Drainage Plan provides for reimbursements to the developer of
drainage costs in excess of the fee obligation.
WHEREAS, sufficient funds exist in the Planned Local Drainage Area fee, Area B
amount, to pay said reimbursement
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad,
California, as follows:
1. That the above recitations are true and correct.
2. That reimbursement to the developer, D. R. Horton, in the amount of $53,239 is
hereby approved.
