RECOMMENDED ACTION:
Adopt Resolution No. 9 3- 60 summarily vacating a portion of Pine Avenue between
Street and Tyler Street.
ITEM EXPLANATION:
On November 19, 1996, an application was filed with the City requesting the vacation of i
Pine Avenue, on the south side of the street, between Roosevelt Street and Tyler I
proposed street vacation was filed to accommodate development of the Schilling Mixed U
which is to front this portion of Pine Avenue.
In its existing condition, Pine Avenue, which is designated as a local street, c
right-of-way width for a local street is 60’. As proposed, the street vacation will have nc
the curb-to-curb width, but will reduce the right-of-way width behind the southerly curb f
IO’. Staff has reviewed the street vacation and concludes that the excess right-of-way v, required for present or future street purposes.
The utility companies have been notified and no objections have been received nor are
utilities located within the area proposed for vacation.

Approval of this street vacation will result in approximately 1,323 square feet of land to bc
to the tax rolls. While no detailed economic analysis was conducted, there will be an incre

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING A PORTION
OF PINE AVENUE BETWEEN ROOSEVELT STREET AND TYLER STREET, PR 6.129.
WHEREAS, a request has been made to vacate a portion of Pine Avenue
Roosevelt Street and Tyler Street; and
WHEREAS, Pine Avenue is designated as a local street which requires a rig1
width of 60 feet; and
WHEREAS, Pine Avenue presently has a right-of-way width of 80 feet along the i
the street proposed to be vacated; and
WHEREAS, the City Engineer has determined that the excess right-of-way is not
for present or future street purposes; and
WHEREAS, the vacation of this excess right-of-way will result in approximatc
square feet of land being returned to the tax rolls; and
WHEREAS, the proposed vacation is consistent with the General Plan of the Cit
requirements of the Growth Management Plan,
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of th
Carlsbad, California, as follows:

2. That pursuant to Chapter 4, Part 3, Division 9 of the California Si
Highways Code, said excess right-of-way more particularly described in Exhibit A, and :
the sake of clarity in Exhibit B, be summarily vacated.
That the above recitations are true and correct.
3. The City Clerk is directed to record this resolution in the office of th
Recorder of San Diego County.
