I ITEM EXPLANATION: In 1991, the City entered into a State and Local Transportation Partnership Pro1 Agreement with the State which permits the City to apply for funds for transportation F State contribution rate is based on the prorata share of funds allocated by the Sta relative to all projects being funded. Supplements are made to the Master Agreemen the funding of individual projects. Supplements No. 022 and 023 will provide funding for the Poinsettia Lanell-5 construction and the Olivenhain Road widening. The Poinsettia Lane/l-5 project is the program. The reimbursement rate is 19.35% which will provide funding in tt- $1,011,623. Olivenhain Road is in Cycle 7 of the program. The reimbursement rate is 12.84% and will provide $218,969. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for program and fiscal delays that would occur if the agreement were executed after that determination was made. The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed $1011623 to be encumbered and reimbursed as follows: the mutual benefit of both parties, in order to avoid FY 94-95 $ 0 FY 95-96 1011623 FY 96-97 0 Any increase in State Partnership funds will require a revised program supplement. Any decrease in State Partnership funds will require a revised finance letter. 2. The State Funds Share is calculated based on the lower of th approved eligible application amount or the eligible award amount. 3. Within 120 days of project completion a Final Report ofExpenditures must be transmitted to the Caltrans District Assistant Engineer. 4. A Final Audit must be completed and transmitted to the Caltr District Local Assistant Engineer by December 30th (the Stat fiscal year following project completion). 5. In accordance with the State-Local Transportation Partnershi Program Guidelines dated June 8, 1994, project eligibility i limited to contract items plus locally funded State or Local Entity furnished materials and Supplemental Work. Supplemen Work eligibility is further defined under the Project Eligib section of the Guildelines as limited to certain maximum cos and to non-early reimbursement projects of $300,000 or less. 19.35%. 6. SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300,000 STATE SHARE These Covenants supersede any conflicting provisions of the Master Agreement: A. The LOCAL ENTITY agrees that the payment of "State ShareFunds" will be limited to the lesser of the product of multiplying the calculated pro rata percentage as determined the STATE by either: (a) The eligible award amount or (b) cost in the approved State/Local Partnership Program Application and accepts any consequent increase in LOCAL ENTITY funding requirements. B. The LOCAL ENTITY will invoice the State for the full "St Share" after the contract award or upon the State Budget Act The total eligible State/Local Partnership Project appropriation of funds, whichever occurs later. "State's Sha is considered a grant and will be reimbursed as a lump sum payment regardless of final project cost. C. D. The financial audit and Final Project Expenditure Report provisions of Sections 9 and 10 of ARTICLE I of the Master Agreement are not applicable to this PROJECT. 4. WHEREAS, the City and State have previously entered into State i PROGRAM MASTER AGREEMENT NO. SLTPP-5308 AND Transportation Partnership Program Master Agreement No. SLTPP-5308; and WHEREAS, the City has applied for and been granted approval for the Lanellnterstate 5 Interchange construction and Olivenhain Road widening; and WHEREAS, the City Council finds that receipt of this supplemental funding is to the transportation system for both the City and the State. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of California, as follows: 1. That the above recitations are true and correct. 2. That the City Council hereby approves Program Supplements No. 022 i the State and Local Transportation Partnership Agreement SLTPP-5308. 3. That the City Council hereby authorizes the Mayor to execute doc1 Program Supplements No. 022 and 023.
