H/RED COMMUTER RAIL STATION RECOMMENDED ACTION: ADOPT City Council No. 97-f?’ APPROVING an amendment to City Council Resolution No. 93-304 to modify a condition of approval (No. 9) which requires North County Transit District to construct a third access concurrently with construction of an expanded parking lot for the Village Commuter Rail Station. ITEM EXPLANATION: When the Village Commuter Rail Station was approved by the City Council and Housing and Redevelopment Commission in November of 1993, a condition was placed on the project which requires North County Transit District (NCTD) to construct a third access concurrent with the construction of expansion of the parking lot. NCTD is prepared to proceed with construction of the expanded parking lot for the Village Commuter Rail Station as of April 1, 1997 but is unable to concurrently construct the third access as required by the Council and Commission. Although NCTD does intend to eventually construct the third access, they do not wish to delay construction of the parking lot until the third access can be constructed. As of this date, NCTD staff does not have an estimated timeline as to when the third access will be constructed. However, it is expected that it will take at least one year to complete all of the steps necessary to purchase the property required for the third access and then construct the improvements. NCTD intends to complete parking and circulation plans for the expanded parking lot at the station which will identify several options for location of the third access. NCTD will then work with the City to identify the best location to pursue in terms of property acquisition and construction plans. Due to the existing parking shortage at the Village Commuter Rail Station, it is staffs recommendation that NCTD be permitted to immediately proceed with construction of the expanded parking and delay construction of the third access for at least one year. The City’s Traffic Engineer will be working directly with NCTD and their consultants to identify the appropriate location for the third access and to develop the appropriate improvement plans for construction purposes. Since NCTD staff has agreed to construct the third access and work with the City to identify the best location for that access, staff believes it is in the best interest of the Village Area to allow NCTD to proceed with the parking expansion immediately and construct the third access at a later date. Staff is recommending approval of a modified condition related to construction of the third access which requires NCTD to enter into an agreement with the City of Carlsbad to construct the third access within twelve (12) months of the date of initiation of construction of the expanded parking lot. Approval of the modification is required by the City Council as well as the Housing and Redevelopment Commission. The Commission will take action on the modified condition under a separate agenda bill. \ Council AB# Page 2 /$07+ FISCAL IMPACT: The requested action has no fiscal impact on the City of Carlsbad or the Carlsbad Redevelopment Agency. The parking and related third access are projects which will be funded entirely by the North County Transit District. EXHIBITS: 1. CITY COUNCIL RESOLUTION NO. 97-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA TO APPROVE AN AMENDMENT TO CITY COUNCIL RESOLUTION NO. 93-304 TO MODIFY CONDITION NUMBER 9 AS RELATED TO CONSTRUCTION OF PARKING AND A THIRD ACCESS FOR THE VILLAGE COMMUTER RAIL STATION. WHEREAS, the City Council, at their meeting on November 2, 1993, approved the design and site plans for the Carlsbad Village Commuter Rail Station/Transit Station subject to the findings and conditions contained in City Council Resolution No. 93-304; and WHEREAS, North County Transit District has requested a modification to one of the conditions of approval which requires concurrent construction of a third access to the expanded parking lot for the Village Commuter Rail/Transit Station. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Carlsbad, California, as follows: A) That the above recitations are true and correct. NCTD shall enter into a standard “Development Improvement Agreement” with the City of Carlsbad, to be approved and executed by the Community Development Director, and provide security satisfactory to the City’s Finance Director to ensure construction of the third (additional) access within twelve (12) months of the initiation of construction for the expanded parking lot, unless an extension of time is granted by the City Council. The location for the third access shall be approved by the City of Carlsbad’s City Engineer. All plans, specifications and supporting documents for all improvements and landscaping, as related to the third access, shall be prepared by NCTD to the satisfaction of the City Engineer. WHEREAS, the City Council, at their meeting on February 20, 1990 approved an agreement with the North County Transit District, hereinafter referred to as “NCTD”, and the County of San Diego, hereinafter referred ‘to as “COUNTY” for construction and operation of a Commuter Rail/Transit Station on the north side of Grand Avenue between State Street and Washington Street, and WHEREAS, the City Council has agreed to participate as a member of the project team and review and take action to approve/disapprove the final design drawings and site plan(s); and WHEREAS, NCTD and the COUNTY, have in good faith made an effort to respond to all comments on the final design drawings and site plan(s) provided by the City. , NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Carlsbad, California, as follows: A) That the above recitations are true and correct. The Carlsbad Village Station will be able to accommodate AMTRACK operations if at a future date a decision is made by AMTRAK-to provide service to Carlsbad at the subject station site. NCTO shall provide the City with a reproducible 24” X 36”, mylar copy of the final drawings and site plan(s) as approved by the City Council. The site plan shall reflect the conditions of approvai by the City. The site plan(s) shall be submitted to the City’s Housing and Redevelopment Department within thirty (30) days of project approval. NCTD shall cooperate with the City of Carlsbad to incorporate the approved City-Wide Trails System into the Village Transit Station project, to the greatest degree possible, once the final alignment ‘for -the trails is complete and approved. . --. NCTD shall investigate structural sections of the road surrounding the stations, specifically on Washington Street and Beech Avenue, to ensure that the roads are adequate to handle the bus/truck traffic related to the Transit Station. Washington Street, to the satisfaction of the Housing and Redevelopment Director and/or the Planning Director, to provide greater protection to the residences from any dust and noise impact associated with the Transit Station. NCTD/County shall work .with the Engineering Department to redesign street improvements on Washington Street to save as many Eucalyptus trees as possible. NCTD/County shall work with the City to provide an appropriately-sized turn- around area for large trucks accessing the Bauer Lumber Company on the railroad right-of-way. On behalf of NCTD and the City, SANDAG shall c&duct a commuter rail parking lot study a minimum of once a year. A copy of the study will be forwarded to the City within thirty (30) days of completion. If th8 study indicates that the parking lot mid-day utilization ratio meets or exceeds 85% for three (3) consecutive days, NCTD will immediately initiate procedures to effect the construction 6f a parking lot expansion within one (1) year. * If the parking lot study noted in condition No. 8 indicates that the parking lot mid-day utilization ratio meet or exceeds 85% for three (3) consecutive days, . NCTD will immediately initiate procedures to obtain..the: right-of-way and . construct an additional public street access for the expansion of the parking lot. The third access shall be constructed concurrent with construction of the expansion of the parking lot. Plans, specifications and supporting documents for all improvements and landscaping within the ,City right-of-way shall be prepared by NCTD to the satisfaction of the City Engineer. The plans shall be prepared on standard City plan sheets and be processed through the normal City plancheck process and the work shall be inspected by City forces. The structural section for Beech Avenue from Washington Street to Carlsbad Boulevard shall be modified to accommodate a minimum traffic index of 7.0. Full improvement to -Cedar Street‘ from State Street to the alley way including pavement, curbs, gutters, sidewalks, street lights, street trees, landscaped median and drainage facilities. The structural section shall accommodate a minimum traffic index of 6.0. Full improvement to the alleyfrom Grand Avenue to the second parking lot entrance north of Cedar Street including pavement, curbs, gutters, sidewalks, street tiees, streetlights; landscaped median and drainage facilities. The structural section shall be designed to accommodate a minimum traffic index of 5.0. NCTD shall grant a public easement or an appropriate.license agreement to the City for any portion of Washington Street or the alley way which encroaches into th8 railroad right-of-way and which has not been previously dedicated to the City for public street purposes.
