Adopt Resolution No. ??-/OS Introduce Ordinance No. NS- 400 to establish the residential permit parking area. to establish the boundary of the residential permit parking Introduce Ordinance No. NS- YO/ to establish a NO PARKING restriction on Carlsbad Boulevard between Cherry Avenue and Redwood Avenue between the hours of 2:OO a.m. and 6:OO a.m. area and the permit fee. 3. ITEM EXPLANATION: At the City Council meeting of August 13, 1996 staff was directed to formulate a residential permit parking program and return, with documents, to the City Council for final approval. The attached ordinance and resolution are provided to formally implement the residential permit parking program. Based upon staff meetings with residents and their input to the City Council, the boundary of the parking permit has been established. Occupants of residences and businesses within the permit arei will have an opportunity to purchase a maximum of four parking permits in each calendar year. Eact permit will cost $24 and the cost will be prorated depending upon the month in which it was purchased. The permit parking area will require a valid permit, issued by City staff, affixed to the vehicle to pari on-street between the hours of 1O:OO p.m. and 200 a.m., seven days a week. Drivers of vehicles ir violation of the permit program will have their vehicle towed at their expense. Residences and businesses that abut the following streets are included in the residential perm1 parking area and are eligible to purchase a parking permit(s). 1. Hemlock Avenue - Carlsbad Boulevard to Garfield Street. 2. Redwood Avenue - Carlsbad Boulevard to Garfield Street. 3. Tamarack Avenue - Carlsbad Boulevard to Garfield Street. Residents of this portion of Tamara( Avenue cannot park on Tamarack Avenue due to the 24-hour NO PARKING ANYTIME restrictic in place. Sequoia Avenue - Carlsbad Boulevard to Garfield Street. Carlsbad Boulevard - Hemlock Avenue to Sequoia Avenue, east side only. Garfield Street - Hemlock Avenue to Sequoia Avenue. 4. 5. 6. 4 1$ 0 Page 2 of Agenda Bill 0. /qj 0 q (0 A maximum of four permits per calendar year will be issued to an eligible residence or busines! address and lost permits will not be replaced during the calendar year it is valid. Owners that ren property will be responsible to collect the perrnit(s) for their next tenant to use during the remainder a the calendar year. A turnover in tenants of rental property is not sufficient reason for more than fou parking permits per calendar year to be issued to the dwelling unit address. Signs will be posted on each street segment within the boundaries of the residential permit parkin! area. New tenants, therefore, can observe the signs and purchase the required number of parkin1 permits, up to a maximum of four. Staff is also recommending that vehicles be allowed to park on Carlsbad Boulevard until 200 a.rr between Cherry Avenue and Redwood Avenue. Extending the time allowed to park on this roa segment from the current 12:OO midnight restriction will allow additional parking to minimize th NO PARKING TOW AWAY between 1O:OO p.m. and 2:OO a.m. on nearby streets. The State Parks and Recreation Department has agreed to allow parking in the lower Tamarac Avenue parking lot until 2:OO a.m. each night. Currently, parking is not allowed after 11:OO p.m. an the extended hours will permit more off-street parking to minimize the need for on-street parking in th residential neighborhood. The sign will be changed in the parking lot to reflect the 2:OO am beginning of the parking restriction. FISCAL IMPACT: About 48 signs will be required to be posted on streets in the permit area advising drivers of th NO PARKING TOW AWAY between the hours of 1O:OO p.m. and 2:OO am., except if a valid parkin permit is displayed. Cost of the signs is about $5,000. The Police Department will routinely patrol the parking restricted area and enforce as needed. Th cost for this service may range from $2,000 to $10,000 depending upon the level of enforcemer actions and the time spent at the vehicle to be towed. Administrative costs to issue permits and maintain files for the residential permit program on a year1 basis is estimated at $8,000. Based upon the above analysis, the total costs borne by the City of Carlsbad resulting from th implementation of the residential permit program will range from $15,000 to $23,000. It is estimate that up to 200 dwelling units are within the boundaries of the parking area and could purchase parkin permits valued between $10,000 and $20,000. Although a maximum of four permits can b purchased per dwelling unit, the total revenue to the City will depend on the number of permil purchased annually. EXHIBITS: 1. In order to protect and omote the integrity of thes,e areas and neighborhoods, it is necessary to the opportunity fJyesibents to park near their hdpes. Uniform parking regulations restricting residents and non-r sid nts alike would not serve tbe public interest. The City Council finds ai!a result of public testimony, evidence generated by both professional planning studies and derived from other sources, that the continued vitality of the City of Carlsbad depends on dye preservation of safe, healthy and attractive neighborhoods and other residential areas therein!. They are intended as illustrations only and do not exhaust the subject of the factual basis supporting its adoption: The safety, health and welfare of the residents of the city can be greatly (1) and oher residential areas; Certain neighborhoods and areas of the city do not have sufficient on or off-street space to accommodate the convenient parking of motor vehicles by residents (*) \\a ereof in the vicinity of their homes; (3) S ch areas as described in (2) above are often further burdened by influxes of knotor vehicles owned by non-residents which compete for the inadequate av ilable on-street parking spaces; A syst m of preferential residential parking as enacted in this Chapter will serve to promot the safety, health and welfare of all the residents of the city by reducing unneceyary personal motor- vehicle travel and by promoting improvements in arf quality and the convenience and attractiveness of urban residential living. The City Manager or his designee is hereby authorized to issue, upon written request, a residential parking permit. Each parking permit shall state or reflect thereon the particular residential parking permit area and the residence for which it is issued. The City Manager or his designee is authorized to issue such rules and regulations governing the Parking permits may be issued for motor vehicles only upon written application of (I A legal resident of the residential parking permit area who provides proof of resi ency within the area. The provisions of this Chapter regulating t e operation, parking and standing of vehicles shall not apply to authorized emergency ve icles operated by the Police or Fire Department, any public or private ambulance or any ublic utility vehicle qualified as an authorized emergency vehicle by operation in the manner pecified by the Vehicle Code in response to an emergency. The provisions of this Chapter regulating the parkng or standing of vehicles shall not apply to any vehicle of a City department or public utility whilekn use for construction or repair work on a street or highway. (a) Each parking permit issued by the City Manager or his designee shall be valid until and including December 31 of the year in which it is issued. (b) Each barking permit issued must be renewed each year and a renewal fee shall be paid for each rene al permit. (c) Each a plication shall contain such information sufficient to identify the applicant, their residence or I bu iness address within the residential parking permit area, and other such information that may b deemed relevant. 10.60.110 Permit Fees. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended by the amendment of Section 10.40.041 to read as follows: “1 0.40.041 Parking restricted on certain parts of Carlsbad Boulevard.
