ITEM EXPLANATION The claimant is a former Police Dispatcher in the Carlsbad Police Department. Ms. Hiles suffered cumulative trauma injuries to her wrists, hands and arms during the period July 1987 through March 1994. She underwent several surgeries which resulted in a total fusion of both wrists. Ultimately, it was determined that Ms. Hiles could no longer perform the duties of her job and she retired on October 1, 1995. The terms and conditions of the proposed settlement are set forth in the Compromise and Release (on file in the Risk Management office). The terms and conditions were agreed upon by the attorney representing the claimant and the attorney representing the City, and have been approved by HCM Claim Management, the City's Third Party Administrator for workers' compensation claims at the time of this settlement. FISCAL IMPACT The total cost of the settlement is $45,000. There are sufficient funds available in the Workers' Compensation Self-Insurance Fund to cover the cost of this settlement. 1. That the above recitations are true and correct. That the expenditure of $45,000 from the Workers’ Compensation Self-Insurance Fund is authorized for the settlement of said claims. That the Council accept the Compromise and Release, on file in the Risk Management Office. 3.
