I ITEM EXPLANATION:
At their meeting of December 2, 1996, the Traffic Safety Commission rej
recommendation of the Traffic Safety Coordinating Committee (TSCC) to establish tw prima facie speed limits upon Batiquitos Drive due to there being two different design the roadway. The TSCC recommended to the Traffic Safety Commission establishir
facie 35 mile per hour speed limit upon Batiquitos Drive from Aviara Parkway to Golden and a 40 mile per hour prima facie speed limit from Golden Star Lane to Kestrel Drive. could not justiv a prima facie speed higher than 35 miles per hour based upon the de:
and roadway elements within the segment from Aviara Parkway to Golden Star Lane.
The Traffic Safety Commission did not want two different speed limits posted on Batiq
and rejected the TSCC recommendation. They recommended, by a 4-1 vote, that tt established with a 40 mile per hour prima facie speed limit its entire length.
Batiquitos Drive is considered a collector road and a collector road generally has a desig 30 miles per hour. However, some elements of Batiquitos Drive have been built to a hig standard than the minimum design criteria for a collector road. Although the design spc on the improvement plans is 30 miles per hour on Batiquitos Drive between Aviara Pal Golden Star Lane, the road is constructed, with a centerline radius greater than the design criteria of 300 feet. This allows vehicles to travel at a comfortable speed above 3C hour. However, corner sight distance in this segment is limited to about 35 miles I Consequently, the TSCC recommended a maximum speed limit posting of 35 miles pr Batiquitos Drive from Aviara Parkway to Golden Star Lane. The Traffic Safety Commission discussed this matter and the reasons for the recommel the TSCC for a 35 mile per hour speed limit on a portion of the road and a 40 mile per h limit on the remaining portion. Four of the Traffic Safety Commissioners thought that roadway from Aviara Parkway to Kestrel Drive should be established as a 40 mile per t- facie speed limit.
Based upon the 4-1 recommendation by the Traffic Safety Commission, an ordinance i$ to establish a 40 mile per hour prima facie speed limit on Batiquitos Drive from Aviara P Kestrel Drive, if the City Council concurs.

NEW BUSINESS:
A. Batiauitos Drive. Aviara Parkway to Kestrel Drive - Request to establish prima facie speed limit.
Bob Johnson gave the report, using a transparency to show this segment c
roadway. He stated that this item was continued from the Traffic Safet
Commission meeting of November 4, 1996. He said that the Engineering an
Traffic Surveys have been done and the critical speed was 43 miles per hoL
between Aviara Parkway and Golden Star Lane. From Golden Star Lane t
Kestrel Drive, the critical speed was 44 miles per hour. Mr. Johnson state
that after the road is posted and enforcement occurs, staff will re-evaluate th
street if there is a need to change the speed limits due to any problem wit
tickets. He added that staff does not want to post a roadway with a speed lim:
that 100 percent of the drivers are exceeding.
.In repiy to Commission query, Sgt. Byler stated that when a-.street is poste
with a speed limit, the Police do not issue citations immediately. They giv
the drivers time to adjust to the new speed limit, then spend some time issuin
takes about three or four weeks. He added that they wouid probably use thei
smart radar trailer to monitor the speeds, as that provides a hard copy of th
speeds registered during the day and that data can be used as an educationa
tool in response to any complaints by chizens.
Commissioner Allen inquir.ed why Kestrel was not included in this su-rvey, an
Mr. Johnson replied that if wilI be brought before the Commission at a late
date.
In reply to Commission query, Mr. Johnson stated that Kestrel is a residentia
collector. He said that a 40 mile per hour design speed would carry throug
for Batiquitos Drive from Kestrel to the west to join Poinsettia Lane. He sai
there will be a raised median on part of that road and the roadway does wide
out.
Mr. Johnson stated that in going from a 35 mile per hour limit to 40 miles doe
warnings before they actually start writing citations. He said that usual1
involve signage to alert the drivers to the change.
Commissioner Gillfillan felt the transition point should be placed elsewhere
and Sgt. Byler stated that they do not issue citations right at the transitio
spot; generally in the middle of a speed zone. He said that there are no home
fronting on Kestrel, and that seems to be a logical breakpoint.
Chairperson Courtney stated he has a problem with splitting the speed limit o
the same street; particularly over such a short span and would favor one spee'
limit for the entire length of roadway.

recognize the following important features and special circumstances of
Batiquitos Drive:

meandering. sidewalks; and routes connecting through the Resort and

As the Four Seasons Hotei opens this summer, we believe many
guests here to enjoy OUT spectacular climates and surrounds, will walk
from the Hotel to the Golf Club;,Batiquitos Lagoon Trail; and the
Argyle Restaurant. They will, therefore, have to cross Batiquitos . .
Drive, Additionally, more activity will take place betvieen the golf
driving range (on the north side of Batiquitos Drive)'and the Golf .

In the early planning days of Aviara, it was decided that Batiquitos '
be constructed with extra width to improve the aesthetics of the area
and to provide an avenue that motorists, bicyclists, walkers, and
joggers could safely share. It was always our intent that Batiquitos
Drive be a "Scenic Drive," capturing the visual and serene
environments that the ?ea has to offer. Increased speed and the
enjoyment of scenic qualities of the area are not compatible.

Seasons Hotel; and the buiid-out of the Aviara community, a
significant increase in traffic volume will conflict with the *

The speed limit should be established on Batiquitos Drive at 35 mph
or less, and City Council should acktlowiedge and agree that it is
acceptable that a portion of the street's speed limit will not be able to
be enforced through the use of radar.
Additionally, the .City Council should recognize the speciai cir
circumstance ofthe Resort/community usage of Batiquitos Drive as a
pedestrian route, and, h adv- of the Hotel opening (a) iristall a
cross walk at Batiquitos Drive at Aviara Drive; and (b) install stop
signs on Batiquitos Drive at Aviara Drive to create a safe pedestrian
crossing opportunity.
In conclusion, Aviara Land Associates has worked hird to create the very ' .
best master planned comhty possible. ' It has been our goal to take care
of as many details as possible so that our new homeowners will enjoy the
special, well-thought-out environment of Aviara. We have consciously
pianned for the blading of the residential and resort usages and have
concentrated on limiting the impacts of each Of special concern, and .
hstration, is the City's "wait and see" approach to traffic related issues. It
does not take much imagination to know that with the opening of the Hotel
and the now occupied neighborhoods along Batiquitos and Kestrel Drive,
that the prepaid traffic signal. at Kestrel Drive and Aviara Parkway should
be instailed immediately; the prepaid traffjc signal at Aviara Parkway and
Poinsettia Lane should be installed; the aforementioned cross walk and stop
signs should be installed on Batiquitos Drive at Aviara Drive; and, of
course, that Batiquitos.Drive have a reduced speed limit (35 mph or less)
established.

Batiquitos. She is concerned that since it is only a two-lane road and the fact that when
Batiquitos is completed and open from Ponsettia to Aviara Parkway, people will use it
as a thoroughfare and not a residential street which is what it was intended to be.
She would appreciate it if the Council would consider keeping the speed to a minimum.

Dear Councilmembers:
On behalf of the Four Seasons Resort Aviara we are very concerned about the proposed 40 mph
speed limit for Batiquitos Drive. We urgc you to consider a speed limit that wouid be a
maximum of 25 to 30 rnph for Batiquitos Drive.
Both the Four Seasons Resort Aviara and OUT developer. Hillman Properties, have expressed
their concerns in the past and urge the City to consider options such as stoplights, stop signs or
cross walkson Batiquitos Drive, speciscally at Lhe entmncc to the golf course as it is presently
an de situation for pedestrians crossing the road. Posting a speed limit of 40 mph would
mereiy exacerbate a problem that already exists.
By eariy summer with the opening of the Resort, there will be an additional 300 - 900 guests in
and around Aviara on a daily basis. Guests will choose to walk around the resort, venturing
Batiquitos Drive. In additioK the residents along Batiquitos Drive are crossing that street for thc
same reasons and there is also a concern for their safety. We have raised our concerns about
pedestrians crossing Batiquitos Drive in the past and this currently presents a serious bbility and
sakety concern.
Batiquitos Drive has many curves and inclines at different points, making it very difficult for the
vehicle driver to see. in some piacs more than 25 to 50 yards in advance. Encouraging people to
drive at speeds 40 rnph or higher will fiuther increase the potential risk for pedestrians crossing
the road.
