CA GRANTING OF APPEAL OF PLANNING TITLE: COMMISSION’S APPROVAL OF CONDITIONAL USE PERMIT PROVIDING A CIRCULATION CONNECTION AT HOSP WAY APPLICANT: BRIGHTON GARDENS CASE NO: CUP 9619 DEPT. HD. CITY MGR. / RECOMMENDED ACTION: Adopt Resolution No. 9F #3? granting the appeal on the limited issue of the circulation provisions and approving the project in other respects as set forth in Conditional Use Permit 96-l 9, Brighton Gardens. ITEM EXPLANATION: At its meeting of April I, 1997, the Council granted appellant’s appeal on the limited issue of circulation and upheld the project in other respects except modifying it to retain the serpentine walkway. The Council retained jurisdiction to approve a revised Circulation Plan for the project which would discourage or prohibit through traffic from using the aisle roadway between Carlsbad Village Drive and Hosp Way. The Council also deleted the condition requiring removal of the serpentine sidewalk along El Camino Real. The Council directed the City Attorney to prepare documents implementing this decision. Those documents are attached. The Council should satisfy itself that the findings and conditions accurately reflect its intentions. FISCAL IMPACT: Other than expenditure of staff time, there is no fiscal impact from this decision. EXHIBITS: 1. CONDITIONAL USE PERMIT 96-l 9 WHEREAS, a verified application for a conditional use permit for certain property to wit: Parcels 2 and 4 of Parcel Map No. 13206, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, March 14, 1984 as File/Page No. 84-092419 of Official Records; and Parcel 3 of Parcel Map No. 13206, filed in the Office of the County Recorder of San Diego County, California, together with a portion of lot 5 in Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, according to the Official Plat thereof, all being in the City of Carlsbad, County of San Diego, State of California. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, the Planning Commission did on February 5, 1997 hold a duly 18 19 noticed public hearing as prescribed by law to consider said application for Conditional 20 Use Permit 96-16; and 21 22 23 24 WHEREAS, the Planning Commission did on February 5, 1997, after hearing and considering all the evidence and testimony of all people desiring to be heard adopted Resolution No. 4034 approving Conditional Use Permit 96-16; and 25 WHEREAS, the appellant appealed the decision of the Planning 26 Commission by letter dated February 10, 1997; and 1 1 2 3 4 5 6 7 8 9 10 11 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, on March 25, 1997 the City Council of the City of Carlsbad continued this appeal until its meeting of April 1, 1997; and WHEREAS, on April 1, 1997, the City Council of the City of Carlsbad held a duly noticed public hearing as prescribed by law to consider said appeal and at which time the Council considered all arguments and evidence concerning the appeal; and WHEREAS, at said public hearing after consideration of all the evidence, testimony, arguments of those persons present and desiring to be heard, the City Council granted the appeal of appellant on the limited issue of circulation and otherwise approved the project as modified, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the foregoing recitations are true and correct. 2. That the appeal of appellant on the limited issue of circulation is granted. The Council finds that the evidence adduced at the hearing shows that there are safety and circulation issues requiring a redesign of the through-roadway. Therefore, the City Council will approve in concept a revised Circulation Plan for the aisle roadway between Carlsbad Village Drive and Hosp Way which plan is to be presented to the City Council for its approval at the Council’s meeting of April 8, 1997,as shown on Exhibit “A”, and if that plan is approved in concept, detailed plans shall be approved by the City Engineer prior to the issuance of building permits or certificates of occupancy, as appropriate. 3. That Condition Nos 26, 27 and 28(b) of Planning Commission Resolution No. 4034 is deleted which had required the removal and replacement of the 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 28 27 28 meandering sidewalk with standard sidewalk improvements on El Camino Real and that with those exceptions, the findings and conditions of Planning Commission Resolution No. 4034 on file with the City Clerk and made a part hereof, constitute the findings and decision of the City Council. 4. That appellant’s appeal fees are refunded. 5. This action is final upon the date this resolution is adopted by the City Council. Jz ASSOCIATES February 5, 1997 Dear Planning Commission Members: This letter is to voice my concern about the traffic easement to be used in the development of Brighton Gardens (Case file CUP 96-19/SDP 96-lo/SUP 96-06/HDP 96-09). My concern is with the driveway which will act as an extension of Hosp Way. The driveway of the new project will exit into the already congested parking lot of ABC Children’s School. This parking area is busy all day with children coming and going. This driveway would be to the back entrance of the proposed care facility.The traffic would be routed off Hosp Way up the hill right next to the children’s classroom and play area. All of this added together would equal an inadequate road way, small children and large delivery trucks. This would create a hazard for the children and a possible liability to the property owners and the city. I feel that the planned Care facility is a viable project for the community. But I would hope the traffic problems could be redesigned so it does not encroach an already overburdened trafIic area. Sincerely, Ray N. (CUP 96-l S/SDP 96-l O/SUP 96-06/HDP 96-09) I attended the public hearing, and heard two misconceptions that I want to bring to your attention: 1. The fenced area on the side of our building is part of our playsround space required by state licensing, and children do play there. I am verv concerned about the closeness of the road to our side playsround. The turn seems sharp, and danqerouslv close to our fence. Traffic noise, and fumes also concern me. 2. The parking in front of our building is heavily used bv our parents when bringing and picking up their children. We have approximately 125 cars coming and going each day that back out directly into Hosp Way. Morning and evenings the front parking is full, as well as the parking across Hosp by the bird feeder store. Currently our families have no problem with backing out into Hosp, but I am concerned that they will have a problem backing out of ABC Children’s Center when the road is built going through to Carlsbad Village. Having easy in and out access to our school is a must for parents that are in a hurry to get to and from work every day. I’m concerned that Brighten Garden employees and traffic from Carlsbad Village will use the road to bypass traffic on El Camino that is backed up in the evening, and that big trucks will frequent the road to save from making a U- turn on El Camino. Please look carefully at the closeness of the road to our playground. When I physically walked off the distance of the road from our side playground, I was very uncomfortable with the closeness. Is this road really necessarv? Can it be relocated elsewhere? ABC Children’s Center, Dr. McClave owner of the Adiacent lot, and Briqhten Gardens would prefer it not to be built.
