ITEM EXPLANATION: Ordinance No. NS-403 was first introduced and read at the City Council meeting held on 1997. At that time the Traffic Safety Commission recommended the ordinance establi: mile per hour prima facie speed limit on Batiquitos Drive from Aviara Parkway to Kestrel This recommendation rejected the Traffic Safety Coordinating Committee (‘“ recommendation to establish two different prima facie speed limits upon Batiquitos Dr miles per hour from Aviara Parkway to Golden Star Lane, and a 40 mile per hour prim speed limit from Golden Star Lane to Kestrel Drive, The TSCC recommendation was upon the design speed and roadway elements within the segment from Aviara Park Golden Star Lane. At the April 15, 1997, Council meeting Mr. Larry Clemens, developer of Aviara, SF opposition to the 40 mile per hour speed limit and requested Council’s reconsideration ordinance as introduced, since Batiquitos Drive was enhanced to be scenic and p resident and tourist pedestrian enjoyment. The Traffic Engineer pointed out that a 35 mile per hour speed limit could not be enforcc the use of radar, since it would be designated as a “speed trap” under California law acc to the speed survey establishing critical speeds for that area. City Council expressed concern about having two different speed limits along Batiquito: since this might be confusing to the public. NS - 4 0 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE IO, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.520 TO ESTABLISH A PRIMA FACIE 40 MILE PER HOUR SPEED LIMIT UPON BATIQUITOS DRIVE FROM AVIARA PARKWAY TO ITS INTERSECTION WITH KESTREL DRIVE. WHEREAS, the City Council of the City of Carlsbad, California, hereby ordains as folic SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amende the addition of Section 10.44.520 to read as follows: “10.44.520 Batiquitos Drive: Upon Batiquitos Drive from Aviara Parkway to its intersection with Kestrel Drive, the prima facie speed limit shall be forty miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its ador and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause be published at least once in a newspaper of general circulation in the City of Carlsbad w fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of said City Council held on day of , 1997, and thereafter, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City COL held on the day of ¶ 1997 by the following vote, to wit: AYES: NOES: ABSENT CLAUDE A.
