RECOMMENDED ACTION:
Adopt Ordinance No. NS- $83 amending Title IO, Chapter 10.44 of the Carlsbad Mu
Code by the addition of Sections '1 0.44.520(a) and 10.44.520(b) establishing 35 and 4
per hour prima facie speed limits on Batiquitos Drive from Aviara Parkway to Golden Sta
and from Golden Star Lane to Kestrel Drive respectively.
ITEM EXPLANATION:
At its meeting of April 22, 1997, the Council (4-1) reintroduced the speed limits on Bat
Drive establishing a prima facie 35 mile per hour speed zone on Batiquitos Drive from
Parkway to Golden Star Lane and a 40 mile per hour prima facie speed limit from Gold€
Lane to Kestrel Drive.

ORDINANCE NO. NS-403
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF
SECTION 10.44.520 TO ESTABLISH A PRIMA FACIE 35 MILE PER
HOUR SPEED LIMIT UPON BATIQUITOS DRIVE FROM AVIARA
PARKWAY TO GOLDEN STAR LANE AND 40 MILES PER HOUR
FROM GOLDEN STAR LANE TO KESTREL DRIVE.
WHEREAS, the City Council of the City of Carlsbad, California,
hereby ordains as follows:
SECTION 1 : That Title IO, Chapter 10.44 of the Carlsbad Municipal
Code is amended by the addition of Section 10.44520 to read as follows:
"1 0,44520 Batiauitos Drive;
(a) Upon Batiquitos Drive from Aviara Parkway to its intersection
with Golden Star Lane, the prima facie speed limit shall be thirty-five miles
per hour.

(b) Upon Batiquitos Drive from Golden Star Lane to Kestrel Drive,
EFFECTIVE DATE: This ordinance shall be effective (30) thirty da)
after its adoption; and the City Clerk, City of Carlsbad, shall certify to the adoptio
of this ordinance and cause it to be published at least once in a newspaper (
general circulation in the City of Carlsbad within (1 5) fifteen days after its adoption.
