RECOMMENDED ACTION:
Introduce Ordinance No. NS- 40% to establish a prima facie 35 mile per hour spe
upon Avenida Encinas from Carlsbad Boulevard to Poinsettia Lane. I ITEM EXPLANATION:
Avenida Encinas is designated as a secondary arterial on the Circulation Element of the (
Plan. Construction of Avenida Encinas between Windrose Circle and Carlsbad Bouleva
completed last year. Currently, the portion of Avenida Encinas from Carlsbad Boule1
Poinsettia Lane does not have a posted speed limit. Northerly of Poinsettia Lane, the prirr
speed limit on Avenida Encinas is 35 miles per hour.
Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to esk
prima facie speed limit on the basis of the results of an Engineering and Traffic Surve!
Engineering and Traffic Survey considers such factors as the number of collisions th;
occurred on the road segment, roadway features, traffic volumes, pedestrian volumes, a
land uses, driveway locations, critical speed, conditions that may not be readily apparenl
driver, horizontal and vertical alignment, stopping sight distance, and superelevation.

FISCAL IMPACT:
Installation of eight (8) speed limit signs will cost about $1,000.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE IO, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 10.44.280 TO ESTABLISH A PRIMA
FACIE 35 MILE PER HOUR SPEED LIMIT UPON
AVENIDAENCINAS FROM CARLSBAD BOULEVARD TO ITS
INTERSECTION WITH POINSETTIA LANE.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is am(

by the revision of Section 10.44.280 to read as follows:
“I 0.44.280 Avenida Encinas:
10 (a) Upon Avenida Encinas from Carlsbad Boulevard to a point three thousanc I1 northerly of Poinsettia Lane, the prima facie speed limit shall be thirty-five miles per hour.

(b) Upon Avenida Encinas from a point three thousand feet northerly of Poinsettia
12 to a point three thousand five hundred feet southerly of Palomar Airport Road, the prima
speed limit shall be thirty miles per hour.

(c) Upon Avenida Encinas from a point three thousand five hundred feet southe
14 Palomar Airport Road to its intersection with Palomar Airport Road, the prima facie speec
shall be thirty-five miles per hour.

(d) Upon Avenida Encinas from Palomar Airport Road to its intersection with Ca 16 Road, the prima facie speed limit shall be forty miles per hour.”
17 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its ado
