RECOMMENDED ACTION:
Adopt Ordinance No. NS-408, amending Title 10, Chapter 10.44, of the Carlsbad Municipal
Code, by the amendment of Section 10.44.280, to establish a 35 mile per hour prima facie
speed limit upon Avenida Encinas from Carlsbad Boulevard to its intersection with Poinsettia
Lane.
ITEM EXPLANATION
Ordinance No. NS-408 was introduced and first read at the City Council meeting held on June
3, 1997. The second reading allows the City Council to adopt the ordinance which would
then become effective in thirty days. The City Clerk will have the ordinance published within
fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 10.44.280 TO ESTABLISH A PRIMA
FACIE 35 MILE PER HOUR SPEED LIMIT UPON
AVENIDAENCINAS FROM CARLSBAD BOULEVARD TO ITS
INTERSECTION WITH POINSETTIA LANE.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is am€

by the revision of Section 10.44.280 to read as follows:

(a) Upon Avenida Encinas from Carlsbad Boulevard to a point three thousanc
northerly of Poinsettia Lane, the prima facie speed limit shall be thirty-five miles per hour.
(b) Upon Avenida Encinas from a point three thousand feet northerly of Poinsettia
to a point three thousand five hundred feet southerly of Palomar Airport Road, the prima
speed limit shall be thirty miles per hour.
(c) Upon Avenida Encinas from a point three thousand five hundred feet southe
Palomar Airport Road to its intersection with Palomar Airport Road, the prima facie speec
shall be thirty-five miles per hour.
(d) Upon Avenida Encinas from Palomar Airport Road to its intersection’with Cal
Road, the prima facie speed limit shall be forty miles per hour.”
17 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its ado

INTRODUCED AND FIRST READ at a regular meeting of said City Council held c
3rd day of June , 1997, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbac
Council held on the 10th day of June , 1997 by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Kulchin, and Hall
