PROPOSED ORDINANCE AMENDMENTS
CITY AS PEDESTRIAN ONLY AREAS 6
RECOMMENDED ACTION:
City Council to direct staff to draft the appropriate ordinance designating certain are
the city as pedestrian only areas.
ITEM EXPLANATION:
Mayor Lewis has requested that this items be placed on the City Council ag
discussion and direction to staff. This ordinance is being proposed due to concer
pedestrian safety in certain areas of the City and due to occurrences of property
(both private and public).
Specifically the City Council is being asked to designate the following areas as p
only areas:
0 Split Pavilion
The bluff top walkway from the Split Pavilion to Tamarack Avenue
The sidewalk on the west side of Carlsbad Boulevard beginning at the north e
0 The sea wall itself
0 The promenade on the west side of Armada Drive overlooking the flower fields
new sea wall continuing to its southern terminus
1 FISCAL IMPACT:

There will be additional sign costs and additional enforcement costs required to it
and enforce these new regulations.

Subject: Maintenance of Armada Dr. Promenade

Ray, in response to your request we have researched the Carlsbad Ranch plans and CC&R'
determine the maintenace and ownership obligations for the Armada Dr. promenade. The
promenade is within the public right of way and therefore City property. The wall and railir
on the Flower Fields property which is owned by Carltas. All facilities except the roadway a
maintained by the Maintenance Association. The benches,walls,landscape etc. will be main
by the Association.
In reviewing the CC & R's the role of the City in control and enforcement is not clear. It ma
appropriate to require the Association to enter into an Encroachment Agreement with the C
better defining obligations and resposibilties within the public right of way.
Association maintenance should not preclude regulations of activities on the promenade.
