CLASSIFICATION CHANGE IN
CITY ATTORNEY’S OFFICE
Adopt Resolution No.
reclassifying one incumbent and amending the General Employee’s Salary Schedule.
ITEM EXPLANATION:
At the request of the City Attorney’s Ofice, Human Resources recently completed an audit
and reviewed the Administrative Secretary job description to determine whether it accurately
described the specialized, technical complexity of the position. Based on this audit, staff
recommends establishing a new classification, Legal Secretary, to more accurately describe
the responsibilities of this position. Staff further recommends reclassifying an incumbent
Administrative Secretary in the City Attorney’s Office to this new classification.
This secretarial position provides support to all the attorneys in the office and requires a full
range of legal secretarial functions related to litigation, calendaring, filings, and preparation
of legal documentation. In addition, the position is assigned to compose a variety of legal
documents by extracting data from support documents, determining correct forms md
formatting to use according to court rules and regulations. There are a number of legal
actions, including sanctions on attorneys, if these rules are not followed. These designated
functions are required of the position and serve the City Attorney’s Office with specialized
clerical/secretarial support for daily operations.

Submitted for Council approval is the job description for Legal Secretary which is
recommended to be added to the General Employees’ Classification and Salary Plan at salary
range 45, $1 164.73 - $1415.73 biweekly. Staff also recommends reclassifying the incumbent
Administrative Secretary in the City Attorney’s Office to this new classification.
FISCAL IMPACT:
The annual salary range for the proposed Legal Secretary will be approximately
$30,283 - $36,809. The estimated annual compensation and benefit cost for this
reclassification is $4,200. For the remainder of FY 96-97, the cost for this reclassification is
estimated at $400 which is available within the department’s current budget. For FY 97-98,
$4,200 is requested from the Council’s contingency fund.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ADOPTING THE
LEGAL SECRETARY JOB CLASSIFICATION,
AMENDING THE GENERAL EMPLOYEES’ SALARY
SCHEDULE AND RECLASSIFYING ONE
ADMINISTRATIVE SECRETARY TO LEGAL
SECRETARY.

WHEREAS, the City Manager recommends and the City Council concurs,
that it is desirable and necessary to adopt the job classification of Legal Secretary;
and,
WHEREAS, the City Manager recommends and the City Council concurs,
that the Legal Secretary be placed on range 45 of the General Employees’ Salary
Schedule; and,
WHEREAS, the City Manager recommends and the City Council concurs,
that it is desirable and necessary to reclassify one Administrative Secretary to Legal
Secretary in the City Attorney’s Office; and,
WHEREAS, funds for this reclassification are available in the Council’s
contingency fund for FY 1997-98; and
WHEREAS, the City and the Carlsbad City Employees’ Association have
met and conferred on the impacts of this recommendation on represented employees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.

2. That the City Council authorizes and directs the City Manager to
adopt the Legal Secretary job classification as described in Attachment A, attached
hereto and made a part thereof.
3. That the City Council authorizes and directs the City Manager to
amend the General Employees’ Salary Schedule to include the Legal Secretary on
range 45 at $1,164.73 -$1,415.73 biweekly, as shown in Attachment B, attached
hereto and made a part thereof.
4. That the City Council authorizes and directs the City Manager to
reclassify one Administrative Secretary to Legal Secretary in the City Attorney’s
Office.
5. That the amount of $4,200 be transferred fiom the General Fund
Contingency Account to support this reclassification for FY 1997-98.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 17th day of June , 1997, by the
following vote, to wit:

JOB DESCRIPTION
JOB TITLE: LEGAL SECRETARY
DEPARTMENT: CITY ATTORNEY
BASIC FUNCTION:
Under general supervision, perform a variety of responsible legal
secretarial duties in conjunction with the City Attorney’s Office; prepare
pleadings, motions, discoveries, and all court filings and litigation related
correspondence; provide support to other professionals in the City
Attorney’s Office.
KEY RESPONSIBILITIES:
(These are representative duties and the emphasis on certain duties will
vary depending on the job assignment.)
Assist attorneys with litigation matters, drafting and transcribing
pleadings including verifying quotes for accuracy; verify case cite
references utilizing law books and a computer database; compile and
mark exhibits as necessary.
Research litigation-related rules, terminology, facts and procedures
utilizing a variety of sources; create templates of portions of pleadings for
lawsuits.
Compose, type and compile pleadings, subpoenas, discoveries, motions,
agenda bills, resolutions, ordinances, correspondence and various legal
documents, transcribe from stenographic equipment, notes, oral or
written instruction or prior materials; review work for accuracy, format
and compliance.
Receive and review visitors and telephone calls; provide information
regarding policies and procedures; refer complaints to the appropriate
staff or agency; open, sort and route mail; prepare and process
complaints for Municipal Code violations; schedule meetings and
appointments for attorneys. -

municipal government.

Criminal and civil law functions of the legal office.

EXPERIENCE AND EDUCATION:
Any combination equivalent to experience and education that could likely
