CARLSBAD AND THE COUNTY OF SAN DIEGO
RECOMMENDED ACTION:
ADOPT City Council Resolution No. 97- $0 I I AMENDING the Residential Re1
Agreement between the City of Carlsbad and the County of San Diego Housing Authority
$84,474 in 1996-97 Community Development Block Grant funds for the rehabilitation of sir
ITEM EXPLANATION:
On April 16, 1996 2nd subsequently on June 19, 1996, the City Council selected the organ
receive federal Community Development Block Grant (CDBG) Entitlement funding for thi
program year. The City of Carlsbad will receive $84,474 in 1996-97 CDBG funds for the
administration and implementation of the City’s Single Family Residential Rehabilitation Progra
and grants will be provided to eligible homeowners for the rehabilitation of their single famil
mobile home.
The existing residential rehabilitation agreement with the Housing Authority of the County of Sal
administration and implementation of this program has been amended to reflect the 1996-97 CI
awarded and is attached as Exhibit 2 for City Council review and approval at this time.
Staff is recommending that the City amend the existing residential rehabilitation agreemer
County of San Diego Housing Authority. The amendment would provide $84,474 in CDBC
fiscal year 1996-97. The County has administered the Single Family Residential Rehabilitation
on behalf of the City since February 8, 1994. Since that time, the City has provided $176,’
Single Family Residential Rehabilitation Program resulting in the rehabilitation of seven (7) si
homes and three (3) mobilehomes.
FISCAL IMPACT:
No fiscal impact on the General Fund. The Carlsbad Single Family Residential Rehabilitatior
will be funded through the federal CDBG and HOME Investment Partnership Programs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING AN AMENDMENT TO THE RESIDENTIAL
REHABILIATION AGREEMENT BETWEEN THE CITY OF CARLSBAD AND
THE HOUSING AUTHORITY OF THE COUNTY OF SAN DIEGO
WHEREAS, the City Council on February 8, 1994 approved the establishment of the
Carlsbad Residential Rehabilitation Program; and,
WHEREAS, on April 16, 1996 and subsequently on June 19, 1996, the City Council oft
of Carlsbad, California selected the Carlsbad Single Family Residential Rehabilitation Program to
$84,474 from the City’s 1996-97 Community Development Block Grant (CDBG) Program; and,
WHEREAS, the Housing Authority of the County of San Diego has the expertise, SI
resources to enable it to provide technical assistance to aid the City of Carlsbad in the implemental
administration of a Single Family Residential Rehabilitation Program; and,
WHEREAS, the City Council of the City of Carlsbad, California has considered the 1
amendment to Contract Number 71704-R for 1996-97 Community Development Block Grant fi
the implementation and administration of the Carlsbad Single Family Residential Rehabilitation P
and,
WHEREAS, the City Council has taken all testimony into account.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the above recitations are true and correct.
2. That the City Council hereby approves the amendment to Contract Number 717(
1996-97 Community Development Block Grant funds for the implementat
administration of the Carlsbad Single Family Residential Rehabilitation Program, on fi
City Clerk’s office.
3. That the Mayor is authorized to sign the amendment to Contract Number 71704-F
Carlsbad Residential Rehabilitation Program on behalf of the City of Carlsbad.

THIRD AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF CARLSBAD
AND THE HOUSING AUTHORITY OF THE COUNTY OF SAN DIEGO FOR
ADMINISTEFUNG A RESIDENTIAL REHABILITATION PROGRAM
This Third Agreement to the original Agreement (County Contract No. 71704-R) is made an(
entered into this day of 1997, by and between the CITY 01
CARLSBAD, a municipal corporation, hereinafter referred to as "CITY", and the HOUSINC
AUTHORITY OF THE COUNTY OF SAN DIEGO, a public corporation created pursuant to thc
Housing Authority law of the State of California, hereinafter referred to as "AUTHORITY";
WHEREAS, there exists a need within the City of Carlsbad to assist property owners wit1
rehabilitation of their single-family dwellings and mobile home units; and
WHEREAS, the City Council believes it to be in the best interest of the citizens of Carlsbac
to provide an agency to administer a Single Family Residential Rehabilitation Program for eligibli
property owners; and
WHEREAS, the Authority has the expertise, staff and resources to enable it to providl
technical assistance to aid the CITY to implement and administer a Single Family Residentia
Rehabilitation Program.
NOW, THEREFORE: the CITY and the AUTHORITY hereby agree to amend Contrac
Number 7 1704-R by amending Paragraphs 1,2 and 4 of the contract:
1. Grant Obligations:
The Authority shall implement and administer a Residential Rehabilitation Loan Prograr
fully in accordance with the tirms of the City's Community Development Block Grar
Application, other rehabilitation grant applications and agreements and assurances made b
the City to the United States Department of Housing and Urban Development, hereinafte
referred to as HUD or other grantors for funds to carry out said loan programs. Th
Authority also agrees that it undertakes, hereby, the same obligations to the City that th
City has undertaken to HUD or other grantors pursuant to said applications and assurance:
specifically including compliance with OMB Circular A- 102: "Uniform Administrativ
Requirements for Grants-in-Aid to State and Local Governments". Reference is particular1
made to Appendix G, relating to financial management systems and Appendix 0, relating t
procurement standards.
The Authority shall provide technical assistance to the City to administer a Rent:
Rehabilitation Program hlly in accordance with the terms or requirements of the fundin
source which is identified and other guidelines as established by the City.

2. Services to be provided:
For a period commencing February 1, 1994, expiring when all allocated funds arc
expended or upon a 60 day written notification from either the CITY or thc
AUTHORITY, the AUTHORITY agrees to provide the following services for the CITY.
A. Implement and administer an Owner Occupant Interest Subsidy Loan Program:
Within the target areas specified in Provision 3, the Authority shall provide 1
program for a private lending institution to make below market interest rate loans t(
the City shall provide a prepaid portion of the interest. The prepaid portion o
irlkrest shall be an amount which will (1) not reduce the interest rate to participant
to less than 5 percent per annum, or (2) result in a subsidy payment of more than ’
percentage points. The maximum amount available shall be determined by thl
rehabilitation needs of the property and the owner’s ability to repay the loar

Program:
The City shall refer eligible projects to the Authority for rehabilitation. Th
maximum amount to he expended on each project shall be determined by th
rehabilitation need of the property, the property owner’s ability to repay the loa
and the amount of funds set-aside by the City. The Authority shall also provid
technical assistance in regards to determining relocation expenses for tenants an
provide guidance for the relocation.
Implement and administer a Residential Rehabilitation Deferred Loan Program:
Within the target areas specified in Provision 3, the Authority shall provide
program to make non-interest bearing deferred loans to eligible participants unabl
to qualify for the Interest Subsidy Loan Program. The principal amount of th
deferred loans shall be repaid upon sale, transfer or change in the title to th
property. All deferred loans will be secured by a Trust Deed and Promissory Not
for a single family dwelling or a junior lien for a mobile home taken by th
Authority on behalf of the City. All proceeds from the repayment of these loar
will be made to the Authority and deposited into a reserve account for continue
operation of the program by the Authority. The maximum loan amount for an
single deferred loan shall be $20,000 for a single family dwelling or $5,000 for
mobile home. Eligible participants shall be limited to those owner occupants who:

gross household income is less than 80 percent of the San Diego County media
income adjusted for larger or smaller household size. Such income limits shall bc
based on data published or revised by HUD.
Implement and administer an Elderly/Disabied Grant Program and Weatherizatioi D.
Grant Program;
(1) Within the target areas specified in Provision 3, the Authority shall provide
program to make non-repayable grants to eligible participants. Th
maximum amount for this type of grant shall be $1,000. Eligibl
participants for this type of grant shall be limited to owner occupants o
single family dwellings or mobile homes, who are elderly (62 or over) o
handicapped (as defined by Social Security) and whose gross householl
income does not exceed 80 percent of the San Diego County media
income, adjusted for larger or smaller household size. All grants awardel
shall be used on rehabilitation activities related to the maintenance o
promotion of the health and safety of the occupants, particularly th
elimination of architectural barriers to the access and use of the dwellin
unit by elderly or disabled occupants.
Within the target areas specified in Provision 3, the Authority shall provid
Weatherization Grants to eligible participants. The maximum amount fo
any single weatherization grant is $1,000. Eligible participants for thi
Grant shall be limited to owner occupants of single family dwellings o
mobile homes whose gross income does not exceed 80% of the San Diegl
County median income, adjusted for larger or smaller household size.

4. Contract Amount:
In consideration for services provided for by this Agreements, the City shall make availabl
fhding in amounts to be determined by the City. The determined amount for fiscal yes
1996-97 is $84,474. Upon written request from the Authority, payment shall be disburse
by the City.
