HomeMy WebLinkAbout1997-07-15; City Council; 14263; Seapointe Resort ExpansionCITY OF CARLSBAD - AGENr”\ BILL SEAPOINTE RESORT EXPANSION RECOMMENDED ACTION: Adopt Ordinance No. NS-407, amending Title 21, Section 21.05.030, of the Carlsbad Municipal Code, to grant an amendment to the zoning map to grant a zone change from 0 to C-T, on property generally located on the northeast comer of Island Way and Surfside Lane, in Local Facilities Management Zone 22. ITEM EXPLANATION Ordinance No. NS-407 was introduced and first read at the City Council meeting held on June 24, 1997. The second reading allows the City Council to adopt the ordinance which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted. Ordinance No. NS-407. h Exhibit 1 ORDINANCE NO. ~3-407 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2 1, CHAPTER 21.05, SECTION 21.05.030 OF THE CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO THE ZONING MAP, TO GRANT A ZONE CHANGE, ZC 96-05, FROM 0 TO C-T ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF ISLAND WAY AND SURFSIDE LANE, IN LOCAL FACILITIES MANAGEMENT ZONE 22. CASE NAME: SEAPOINTE RESORT EXPANSION’ CASE NO.: ZC 96-05 The City Council of the City of Carlsbad, California, does ordain as follows: SECTION I: That Title 2 1, Chapter 2 1.05, Section 21.05.030 of the Carlsbad Municipal Code, being the Zoning Map, is amended to reflect a zone change from 0 to C-T as shown on that portion of the map marked “Exhibit ZC 96-05”, attached hereto and made a part hereof by this reference. SECTION II: That the findings of the Planning Commission as set forth in PIanning Commission Resolution No. 4077 constitutes the findings of the City Council. SECTION III: The Council further finds that this action is consistent with the Land Use Element of the Carlsbad General Plan. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in a publication of general circulation in the City of Carlsbad within fifteen days after its adoption. Not withstanding the preceding, this ordinance shall not be effective until approved by the California Coastal Commission.
