RECOMMENDED ACTION:
CITY MGR.a
Adopt Resolution No. 97-542. to accept the public improvements, authorize the City Clerk to
record the Notice of Completion, release bonds, and direct the Community Services Department to
commence maintaining the public improvements constructed southerly of Aviara Parkway and
westerly of Aviara Phase I.
ITEM EXPLANATION:
The developer has constructed improvements required of this project and has requested the City
to accept the public improvements. City forces have inspected the public improvements and found
them to be satisfactory.
The public improvements constructed consist of installation of street improvements, storm drains
and sewers. The following streets have been added to the City: Batiquitos Drive (from Golden
Star Lane to Merganser Lane) and Kestrel Drive (from Aviara Parkway to Batiquitos Drive).
FISCAL IMPACT:
The Community Services Department will be required to maintain the public improvements. The
valuation of the street improvements and storm drain is $4,719,525.70 The valuation of the sewer
improvements is $330,474.30.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING THE PUBLIC IMPROVEMENTS, AUTHORIZING
THE CITY CLERK TO RECORD THE NOTICE OF COMPLETION, RELEASE BONDS, AND DIRECT THE COMMUNITY SERVICES DEPARTMENT TO I COMMENCE MAINTAINING THE PUBLIC IMPROVEMENTS CONSTRUCTED SOUTHERLY OF AVIARA PARKWAY AND WESTERLY OF AVIARA PHASE I (AVIARA PHASE II. CT 89-37)
WHEREAS, the public improvements consisting of installation of street improvements,
storm drains and sewers, in the City of Carlsbad, California has been successfully completed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the above described public improvements are deemed
complete and hereby accepted.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to record
the Notice of Completion for said project and release the bonds in accordance with State Law
and City Ordinances.
4. That the Community Services Department of the City of Carlsbad, California, is
hereby directed to commence maintaining the above described public improvements for said
project.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 22nd day of July , 1997 by the following vote, to wit:
