RECOMMENDED ACTION:
Adopt Resolution No. 9 3-553 approving Amendment No. 1 to an agreement with
Associates, a California Corporation, to provide environmental services for environment
for the Rancho Santa Fe Road Bridge Replacement, Project No. 3190.
ITEM EXPLANATION:
On February 28, 1997 the City entered into a contact with Dudek & Associates to
biological surveys in conjunction with the proposed construction of the Rancho Santa
bridge over San Marcos Creek. The proposed amendment expands the scope of services
under that contract to include completion of an Environmental Assessment Form
preparation and processing of permits with the Army Corps of Engineers, U.S. Fish an
Service and the California Fish and Game. Dudek and Associates is the prime consultan
on County Habitat Management Plans and is considered one of the best firms to cond
types of studies.
Project permits and the mitigation of Creek impacts will likely be the critical path item in cot
the bridge project and northern segment of Rancho Santa Fe Road.
FISCAL IMPACT:
The estimated cost to prepare and process the environmental assessment is $75,000. Fu
this contract will initially come from the Rancho Santa Fe Road account with 80% (
qualifying for reimbursement from federal funding. This results in actual cost to the City of

' This Amendment is entered into and effective as of the 18th day 01
AUGUST , 1997, amending the agreement dated February 28, 1997 by and between
the City of Carlsbad, a municipal corporation, hereinafter referred to as Tity", and Dudek 8
Associates, a California Corporation, hereinafter referred to as, "Contractor" for environmental
technical studies relating to the Rancho Santa Fe Road Bridge Replacement project.
RECITALS
WHEREAS, the initial agreement, dated February 28, 1997 identified a scope o
work to prepare technical studies for environmental review related to the Rancho Santa FC
Road bridge replacement; and
WHEREAS, the parties to this aforementioned agreement desire to alter the
scope of work as follows: to include preparation and processing of environmental assessmen
forms for compliance with CEQA and NEPA requirements and permit processing with thf
appropriate agencies; and
WHEREAS, a supplemental scope of work and fee schedule have bee1
negotiated and agreed to between the parties hereto, and as shown on Exhibit "A" Scope c
Services and Fee;
.-& MW, THEREFORE, in consideration of these recitals and the mutual covenant
contained herein, City and Contractor hereby agree as follows:
1. Contractor shall provide services as outlined on the attached Exhibit "A".
2. City shall pay Contractor for all work associated with Paragraph 1 above, a
stated in said Exhibit "A" not-to-exceed $75,000. Contractor shall provide City on a month1
basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, an
related activities and costs for approval by City.

3. All other provisions of the aforementioned agreement entered into on
February 28, 1997, by and between City and Contractor shall remain in full force and effect.
4. All requisite insurance policies to be maintained by the Contractor shall
include coverage for the amended assignment and scope of work.

Declaration and Resource Agency Pemitting for the Rancho Santa Fe Road Bridge
Replacement Project
Dear Doug:
Dudek & Associates, Inc. (DUDEK) is pleased to .present this revised letter proposal to provide
environmental documentation for the subject project in compliance with the National Environmental
Policy Act (NEPA) and the California Environmental Quality Act (CEQA). This letter proposal has been
prepared based on our understanding of environmental requirements that should be met in order to hlfdl
mandated NEPA and CEQA requirements €or the subject project, and has been revised to incorporate your
comments dated May 8,1997, and to include resource agency permitting as requested on May 28,1997.
UNDERSTANDING OF PROJECT/ASSUMPTIONS
The City of Carlsbad (City) will be the local lead agency responsible for CEQA compliance and the Federal
Highway Administration (FHWA) will be the federal lead agency responsible for NEPA compliance for
the project. Caltrans wdl provide oversight for ensuring FHWA requirements are met. No separate action
is required by Caltrans.
The City has recamended that a Mitigated Negative Declaration (MND) in compliance with CEQA be
prepared for the project. CaItrans has recommended that an Environmental Assessment (EA) with a
Finding of No Significant Impact (FONSI) be prepared in compliance with NEPA and FHWA guidelines.
Based on conversations with the City (Adrienne Landers, Christer Westman, April 15,1997) and Caltrans
(Richalene Kelsay, April 18,1997), a joint WMND will be prepared for the project to meet CEQA, NEPA,
and FHWA guidelines.
DUDEK’s scope o€ work to complete the WMND for the Rancho Santa Fe Bridge Replacement Project
is based on the €allowing assumptions:
1) Technical studies are being completed by DUDEK under our existing contract: biological
resources, noise, water quality, floodplain risk assessment, air quality, Phase I Site Assessment,
aesthetics, and Section 106, Historic Preservation Study. With the exception of a Pacific pocket
mouse survey, no additional field work or technical studies will be required.

SCOPE OF .WORK
Our proposed scope of work consists of nine (9) tasks as summarized below:
Task 1: Scoping
DUDEK will coordinate with the City and Caltrans to ensure that the EA/MND meets both the City':
and FHWA environmental requirements.
Task 2: Conduct Pacific Pocket Mouse Survey
DUDEK will conduct the required Pacific pocket mouse survey. See attached Memorandum dated April
23, 1997 for scope of work.
Task 3: Administrative Draft EA/MND Preparation
Concurrent with Caltrans and FHWA review of the completed technical studies, DUDEK wiU prepare an
WMND supported by an Initial Study/Environmental Checklist in compliance with NEPA, CEQA and
FHWA guidelines. The Initial Study will reflect the January 1, 1996 Environmental Checklist Form
incorporated in the CEQA Guidelines and wiil also inciude the FHWA Region 9 Environmental Checklist.
Explanations supporting each checklist answer will be provided either by brief qualitative reasons,
reference to other resources of information, or reference to the adequate treatment of the issue in a prior
environmental document.
It is anticipated that the WMND wdl be approximately 30 pages in length, not including the Initial
Study Environmental Checkhst and supporting technical appendices. The content and sequence of

DUDEK wilI provide two (2) copies of the Administrative Draft WMND to the City for review.
Technical studies will not be included in the ENMND for review or comment by the City. It is assumed
that review of technical studies by the City will occur under our existing contract.
Task 4: Revise Draft WD based on City's Comments Received
DUDEK a revise the Draft EA/MND based on comments received from the City. DUDEK will then
submit Five (5)copies of the Draft WMND to the City of CarIsbad for submittal to Caltrans.
Task 5: R&e Draft EA/MND Based on Comments Received from Caltrans ."
DUDEK trill revise the Draft WMND as well as all technical studies and appendices based on Caltrans'
coments and any additional comments received by the City. DUDEK will then submit five (5) copies
of the Final Draft WMND to the City for review and distribution to Caltrans and FHWA.
Processing Technical Studies
Our current scope and cost includes one (1) round of revisions for all technical studies with the City and
does not include responding to CaItrans and FHWA comments. Extensive review by both Caltrans and
FHWA was not anticipated based on the assumption that a Categorical Exclusion (CE) would be
acceptable to Caltrans and FHWA to comply with NEPA.

Task 6: Final Changes to EAIMND
DUDEK wilI incorporate final changes to the EA/MND technical studies and appendices based on final
City, Caitrans and FHWA comments. DUDEK will produce 50 copies of the WMND for public
distribution. DUDEK assumes that the City will prepare all notices and distribute the WMND.
Task 7: Responses to CommenMinal EA/MND *
DUDEK will assist the City in responding to public and agency comments received on the WMND
during public review. DUDEK will prepare up to 20 individual responses and provide the responses to the
City for distribution to CaItrans and FHWA review. DUDEK will also make minor revisions to the
WMND, if necessary, based on public comments received.
Our scope and cost assume two (2) rounds of revisions to the Final WMND. Thls task does not include
new analysis or major revisions to the WMND. DUDEK will produce 50 copies of the responses to
comments/Finai WMND for the City,
Task 8: Meetings
DUDEK's project manager wdl attend five (5) meetings with the project team, as needed. All other
meetings d be bdled separately on a time-and-materials basis..
Task 9: --ReSjurce Agency Permitting
The preparation of permit applications, analyses, and detailed mitigation plans for federal and state
resource agency permits is included in this task. It is likely that a Section 404 permit pursuant to the
Federal Clean Water Act, a Section 1601 Streambed Alteration Agreement pursuant to the California Fish
and Came Code and 401 waiver would be required because of the presence of riparian habitat. Mitigation
for these impacts typically involves the restoration, creation, and/or enhancement of wetlands, with a
replacement ratio dependent upon the quality of the wetlands impacted and the quality of wetlands
proposed to be created or enhanced. In addition, if endangered species are present, a Federal Endangered
Species Act Section 7 Biological Opinion would also be required.'
Our estimated cost includes the following assumptions: wetland mitigation will take place onsite, upland
mitigation would consist of purchase credits oEfsite.

SCHEDULE
Upon receipt of notice to proceed, DUDEK will prepare an admimstrative draft WMND for the City of
Carisbad's review. The Administrative Draft WMND will be prepared concurrent with the biological
resources, air quality, arid noise technical studies currently being completed. Subsequent schedule
milestones will be based on the scheduling constraints of' the reviewing agencies. DUDEK commits to
prompt response to agency comments and requests.
COST ESTIMATE
All work will be billed on a time and materials basis in accordance with our 1997 Standard Schedule of
Charges. A cost summary is presented below and a detailed cost estimate is attached. Based on our
experience (as shown below), the bulk of our effort will be spent in responding to Caltrans and FHWA
comments. As the extent of the processing item is hard to tie down, Tasks 4 - 6 will be addressed on a
time and materials basis with a not-to-exceed authorization of $19,000. Task 7, Responses to
Comments/ Final WMND, is also proposed to be addressed on a time and materials basis with a not-to-
exceed amount of $4,000 without additional authorization. As actual permits are U&O~ at this time,
Task 9, Resource Agency Permitting, is also proposed to be completed on a time and materials basis with
a not-to-exceed amount of $28,000 without additionai authorization.
