RECOMMENDED ACTION:
Adopt Ordinance No. NS-423, approving an amendment to Title 13, Chapter 13.10 of the
Car&bad Municipal Code to create a sewage impact fee exemption for outdoor cafes
associated with restaurants on private property, and sidewalk cafes associated with restaurants
on public property located inside the redevelopment area.
ITEM EXPLANATION
Ordinance No. NS-423 was introduced and first read at the City Council meeting held on
September 9, 1997. The second reading allows the City Council to adopt the ordinance which
would then become effective in thirty days. The City Clerk will have the ordinance published
within fifteen days, if adopted.

AN AMENDMENT TO TITLE 13, CHAPTER 13.10 OF THE
CARLSBAD MUNICIPAL CODE TO CREATE A SEWAGE
IMPACT FEE EXEMPTION FOR OUTDOOR CAFES
ASSOCIATED WITH RESTAURANTS ON PRIVATE
PROPERTY AND SIDEWALK CAFES ASSOCIATED WITH
RESTAURANTS ON PUBLIC PROPERTY INSIDE THE
REDEVELOPMENT AREA.

The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION 1: That Title 13, Chapter 13.10 of the Carlsbad Municipal Code is
amended by the amendment of Table 13.10.020(c)(7) to read as follows:

sewer impact fees.)

EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
Council on the 9th day of September 1997, and thereafter.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Carlsbad on the 16th day of 1997, by the following vote, to wit: SEPTEMBER
AYES: Council Members Lewis, Finnila, Nygaard, Kulchin, Hall
