Adopt Resolution No. 99 d4-q to support the creation by the San Diego E
Supervisors of a San Diego County Library Authority for the purpose of placinc
quarter-cent sales tax measure on the June 2, 1998 primary election ballot.
ITEM EXPLANATION:
A temporary (five-year) one-quarter-cent sales tax measure is proposed for the JUI
primary election ballot. Revenues realized from the tax would be used to suy
existing appropriations for all city libraries in the County and the San Diego County
The one-quarter-cent sales tax collected in each jurisdiction would return to the jui
where it was collected. Carlsbad would receive $18,773,323 over the five-year li
tax, based upon SANDAG estimates. Cities in San Diego County are being i
support the creation of the Library Authority for the purpose of placing the propos
tax measure on the June, 1998 primary election ballot.
The San Diego County Board of Supervisors is scheduled to approve a resolution
a County Library Authority on October 21, 1997. Authority members will work c
respective communities to determine library priorities. Subsequently, it is expectec
Library Authority will request County Counsel to draft the ballot question.
The County Law Library has expressed interest in participating in the Library Auth
receiving funds from the sales tax revenues to support its operations. The CO~
Librarian asked for a legal opinion from the County Counsel, who rendered an 01
June 24, 1997. County Counsel’s opinion states that “The Law Library may part
an authority created pursuant to section 7285.5 if the ordinance adopted by the
Supervisors creating the authority provides for Law Library participation.” Fur
opinion states that the decision for distribution of sales tax revenue “is a policy ma
resolved by members of the Board of Supervisors or the Authority.”
The County Law Librarian and the Law Library Board of Trustees suggest that ‘?.t
method for determining the amount to be contributed to the County Public Law Lib
across-the-board percentage from each tax jurisdiction (18 cities and the uninc!
portions of the County). The Law Library Board of Trustees recommends 5.675 PE
that represents the ratio of the operating budget of the San Diego County Pi
Library to all the operating budgets of the other public libraries combined.”
Participating cities and libraries have had considerable dialog with the County Law
regarding the County Law Library’s participation in the sales tax measure. Library
are concerned about this participation. The County Law Library is a specialized Ii
serves a fairly narrow portion of the public as compared to public libraries. City li

F San Diego County do provide access to legal information and provide assista
guidance to the public in their use, for example, of State and Federal Codes. The
clientele of the Law Library is attorneys and judges. It is the view of public librarl
the County Law Library is not a public library in the usual sense of the term and prc
not perceived by the public as a public library.
A major concern is the possible confusion in the public's mind about the purpose o
could jeopardize the passage of the tax measure. A final concern is the amount.0
each jurisdiction is being asked to contribute to the County Law Library. Carls
example, would need to contribute $1,065,386 to the County Law Library if the su!
of 5.675 percent were adopted as the appropriate measure of support.
It is recommended that the City Council support the creation of the Library Authority
recommend the inclusion of the County Law Library. The decision to include o
include the County Law Library probably will be made by the Library Authority. 1
Council will have an opportunity at that time to participate in the decision.

RESOLUTION NO. 97-624
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALlFORNIA,SUPPORTlNG THE CREATION OF A
COUNTY LIBRARY AUTHORITY FOR THE PURPOSE OF
THE JUNE 2,1998 PRIMARY ELECTION BALLOT.
PLACING A ONE-QUARTER-CENT SALES TAX MEASURE ON
WHEREAS, citizens throughout the San Diego County region rely on
their community libraries for a variety of services; and
WHEREAS, current funding levels are insufficient to provide for
essential library programs and operations; and
WHEREAS, a number of library facilities are in need of repair,
remodeling or expansion to properly serve library patrons; and
WHEREAS, current funding levels are insufficient to pay for an
information age library system; and
WHEREAS, libraries serve youngsters from pre-school to college,
parents and seniors, as well as businesses; and
WHEREAS, a sales tax rate increase of one-quarter-cent for a period
of five years would generate approximately $399 million for the entire
region; and
WHEREAS, the establishment of a Countywide Library Authority is
needed to place the ballot measure on the June 2, 1998 ballot.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California as follows:
1. That the above recitations are true and correct, and
2. That the City Council hereby supports the formation of the
County Library Authority which will thereby permit the voters of San Diego
County to consider a one-quarter-cent sales tax rate increase for five years
to be used exclusively for library improvements, and
3. That the City Council does not support inclusion of the San
Diego County Law Library in the Library Authority or in the proposed sales
taxmeasure. *(Council Member Finnila voted to delete Section 3 frc
the Resolution.)
