C1WMG.g RECOMMENDED ACTION: That the City Council INTRODUCE Ordinance No. AMENDING The Ranch0 Carrillo Master Plan and ADOPT Resolution No??-6’15 APPROVING the Master Plan Amendment, General Plan Amendment, and Addendum to Master Environmental Impact Report 93-01. ITEM EXPLANATION: The proposal involves a Master Plan Amendment and General Plan Amendment to increase the residential densities at the intersection of Palomar Airport Road and Melrose Drive, while lowering the densities in adjacent areas to the east, so there is no net increase in dwelling units. The Open Space is also being adjusted to reflect input from the Fish and Wildlife Service and the California Department of Fish and Game. Although the applicant proposed amended development standards regarding separation of structures, those amendments were withdrawn to be considered at such time as the tentative maps are brought forward to public hearing. The Planning Commission conducted a public hearing on September 3, 1997 and voted 7-O to recommend approval of the project. Two homeowners from La Golondrina Street spoke to their concerns as regards the visual impact of the RV parking and Community Services site as their homes are on the ridge overlooking the Master Plan. It was explained that these sites were not part of the Master Plan that was being proposed for amendment, they had been scrutinized by the public and their location changed to minimize their impact by the City Council during the original public hearings in 1993, and will be screened with landscaping to the extent possible. An environmental analysis of the proposed project was conducted and no significant impacts identified. Specifically the change of land use was assessed from an environmental impact standpoint as being in conformance with the previously approved Environmental Impact Report (EIR 91-04) for the project and the Master Environmental Impact Report for the 1994 General Plan update. An addendum has been included to the Master Environmental Impact Report for the 1994 General Plan update (MEIR 93-01) which amends the project description to include the changes proposed. A brief discussion that the land use changes do not have associated impacts is included. FISCAL IMPACT: The fiscal impacts to the City are negligible for this specific action. The transposition of dwelling units along Palomar Airport Road such that there is no net dwelling unit change by itself will not have a fiscal impact on the City. HOtiMILLvR Planning Director PC RESO NO. 4165 -3- EIR 93-01 ADDENDUM #4 September 3,1997 ADDENDUM TO MEIR PROJECT DESCRIPTION A request has been made to change the General Plan Land Use designations on Villages A and B from RM to RH, Villages E and F from RMH to RM, Village H from RM to RLM, Village P from RLM to RM, and increase the Open Space General Plan Land Use designated area by two acres within the Ranch0 Carrillo Master Plan, resulting in the same number of dwelling units as analyzed by the existing General Plan MEIR and the project specific EIR. CHANGE IN IMPACTS There will be no significant change in impacts. The proposed land uses will have the same or similar development standards as other land uses within the Master Plan. The development potential of the site will not be increased nor will it be decreased by virtue of the land use change. The redistribution of the General Plan Land Use designations is being made due to the consolidation of the ownership of the Master Plan which allows for an economy of scale to be applied to such requirements as the affordable housing component. Staff is authorized and directed to make, or require Developer to make, all necessary corrections and modifications to the General Plan Amendment document(s), as necessary, to make them internally consistent and in conformity with final action on the project, based on the following findings: Findinps: 1. Goal “A” of the General Plan Land Use Element encourages the preservation and enhancement of the environment, character, and image of the City as a desirable residential, beach and open space oriented community. The project produces a quality residential and open space orientation. 2. Goal “F” of the General Plan Land Use Element suggests protecting and conserving natural resources, fragile ecological areas, unique natural assets and historically significant features of the community. Within the 252 acres of Open Space the fragile, unique natural assets and historically significant features of the community have been preserved. 3. Goal 1.A.l of the Open Space Element delineates coordinating Open Space uses with other land uses for mutual enhancement and creation of a “human” urban environment, which includes, but is not limited to, development and expansion of recreational land, conservation of natural and manmade amenities, and preservation of options with regard to agricultural land. The Master Plan Amendment provides a synergistic experience between the passive open space, the community park site, the school site, and the day care and community recreation area. 4. The Open Space within the Master Plan has been reconfigured to address the input received from the U. S. Fish and Wildlife Service, U. S. Army Corps of Engineers, and the California Department of Fish and Game to improve the habitat value while still providing a feeling of natural spaciousness and providing visual relief to the residents of the Master Plan. Goal 2.A.l of the Open Space Element desires the exploration of all means of providing for Open Space needs. The Master Plan Amendment is increasing the Open Space by approximately 2 acres. Goal 2.A.2 of the Open Space Element is to assure that new development provides for the Open Space needs of its occupants. The Master Plan includes passive and active Open Space that exceeds the 15% standard required by the Local Facilities Management Plan and the Planned Community Ordinance. Approximately 36.5% of the Master Plan is Open Space and that number will increase as discretionary entitlements are issued. Goal 3.A.2 of the Open Space Element is to protect and preserve visually attractive and/or significant natural areas. The Master Plan has been able to identify and preserve these areas in such a manner as to provide both private and public viewsheds and access. Goal 3.A.3 of the Open Space Element suggests preserving Open Space areas in as natural a state as possible. A review of the Open Space plan indicates this is the intent and conceptual goal of the document. Goal 4.A.l of the Open Space Element is to encourage larger and connected Open Space areas rather than numerous and disconnected areas. The Master Plan has continually strived to meet this objective by constricting development to congruent conjoined discrete areas to allow for larger connected Open Space areas. Goal 4.A.2 requires the creation of natural and man-made links between Open Space areas. In general with this plan, such linkages are not required because of the connectivity of the Open Space. However, where possible the linkages have been provided. The proposed Open Space area is equal to or greater than the area depicted on the Open Space and Conservation Map since the Map since the General Plan Amendment provides additional open space. The proposed Open Space area is of environmental quality equal to or greater than that depicted on the Open Space and Conservation Map as indicated by a review of the previously certified Environmental Impact Report for the Ranch0 Carrillo Master Plan, dated February 1993, and conformance of the Open Space with the proposed Habitat Management Plan and the U. S. Fish and Wildlife Service’s approval of a Section 7 Permit for this project. Residential Guideline 1 of the Land Use Element is to retain the present predominance of single family residences throughout the community. Of the plan’s 405 acres of residential land, 255.6 acres are proposed to be devoted to RLM (low medium density, O-4 dwelling units per acre) single family development. The Housing Element has a Goal 2 that new housing be developed with a diversity of types, prices, tenures, densities and locations. This General Plan Amendment increases the diversity of densities to meet that goal. The Residential Guidelines of the Land Use Element limit multi-family development to those areas where they are compatible with the adjacent land uses, and where adequate and convenient commercial services and public support systems such as streets, parking, parks, schools, and utilities are adequate to serve them. The Master Plan proposes a day care center, a community recreation center, the public park, and the public school to meet these needs. All multi-family sites abut Circulation Element Roadways. In the lone instance where a multi-family site abuts an existing multi-family site, the sites are separated by a significant landscaped slope and the Master Plan conditions the future development to ensure compatibility through synonymous product type. The Ranch0 Carrillo Master Plan provides for adequate facilities in conformance to the development requirements established in the Zone 18 LFMP, as required by Policy “A” of the General Plan Land Use Element which states that development should only be permitted after adequate provisions for public facilities have been provided. In recognition of the WHEREAS, on July 20, 1993, the City Council approved, MP 139(E), as described and conditioned in Planning Commission Resolution No. 3504. The proposed development as described by the Master Plan is consistent with the provisions of the General Plan as identified within the findings for GPA 96-05, Resolution No. 4166 and all findings of said resolution are incorporated herein by reference. 2. All necessary public facilities can be provided concumnt with need and adequate provisions have been provided to implement those portions of the capital improvement program applicable to the subject property. The Master Plan has language in the test stating that all future development shall comply with the public facility performance standards and phasing requirements of the Local Facilities Management Plan (LFMP) for Zone 18. Public facilities are required to be constructed as development in the Master Plan creates demand for additional facilities. A frnancing plan approved by the City Council for the Zone 18 LFMP will provide the mechanisms for the financing of the required public facilities. 3. The residential and open space portions of the community will constitute an environment of sustained desirability and stability, and that it will be in harmony With or provide compatible variety to the character of the surrounding area, and tbat the sites proposed for public facilities, such as schools, playgrounds, and parks, are adequate to serve the anticipated population and appear acceptable to the public authorities having jurisdiction thereof. On April 15,1997, the City Council approved the Reinstated Parks Agreement for the accepting of the park land dedication as offered by the property owner. On February 23,1993 the Sari Marcos Unified School District Board directed their staff to pursue the dedication of the school site as so identified within the Master Plan. In the case of institutional, recreational, and other similar nonresidential uses, such development will be proposed, and surrounding areas are protected from any adverse effects from such development. The Rancho Carrillo Community Park, the Public School Site, and the Day Care Site and Community Recreation Area are all located adjacent to each other. They are bound to the north and east by Circulation Element roadways, on the west by Open Space, and to the south by collector streets and significant landscaped slopes and setbacks to ensure that surrounding areas are protected from any adverse effects. The streets and thoroughfares proposed are suitable and adequate to carry the anticipated traffic thereon. Traffic studies have been completed for the Local Facilities Management Plan for Zone 18 and the previously certified EIR 91-04. Compliance with the mitigation conditions required by these studies and plans would ensure that all circulation infrastructure is in place to serve the traffic demands generated by buildout of the Master Plan. Appropriate measures are proposed to mitigate any adverse environmental impact as noted in the adopted environmental impact report for the project. All findings of EIR 91-04, certified by the City Council on July 27,1993 are incorporated herein by reference. The area surrounding the development is or can be planned and zoned in coordination and substantial compatibility with the development. The project has extensive open space buffers on the east, west, and south. The proposed Master Plan Amendment will increase the size of these open space areas, especially along the eastern boundary of the Master Plan. Where the project abuts existing single family it is proposing single family. Where the project abuts existing multi-family it is proposing multi-family or less intensive land uses. Where the project abuts Circulation Element Roadways it has been conditioned to comply with the City's adopted noise policies. The amendment is therefore consistent and compatible with the surrounding land uses and with the policies of the General Plan. The Open Space is also being adjusted to reflect input fiom the Fish and Wildlife Service and the California Department of Fish and Game. Although the applicant proposed amended standards regarding separation of structures, staf€ opposes such an amendment. Consequently the attached resolutions do not include the amended standards. 111. PROJECT DESCRIPTIO N AND BACKGROUND The applicant is requesting approval of a General Plan Amendment and Master Plan Amendment on 690 acres of property located south of Palomar Airport Road west of the eastern City limits, east of Bressi Ranch, and north of Local Facilities Management Zone 6. Currently, a substantial portion of the Master Plan is being graded in conformance with the existing Rancho Carrillo Master Plan. This gdmg does not include the Carrillo Ranch Community Park site or those sensitive habitats being preserved as a part of this project's approved Section 7 Permit. Surrounding land uses include agricultural and native vegetation to the west, single and multi- family residential to the south, and the Carlsbad Raceway to the north, and single-family residential, fallow agriculture, and native vegetation to the east. The Rancho Carrillo Master Plan was originally adopted by the City Council in 1972 and subsequently amended in 1973, 1982, 1984, and 1993. The existing Master Plan which was GPA 96-05/MP 139(F) - RANCHO CARRILLO MASTER PLAN SEPTEMBER 3,1997 PAGE 2 approved in 1993, includes residential, open space, school, and park land uses and allows for i 8 16 dwelling units to be constructed. The revisions proposed by this Master Plan Amendment will not require any modification to the previously approved grading that is currently occurring on this site. The applicant is requesting the following discretionary approvals: 1. A proposed Master Plan Amendment which involves revising the residential land use designations in the northern half of the site. 2. A proposed General Plan Amendment to reflect the uses of the Master Plan Amendment and to adjust land use boundaries on the General Plan Land Use Map. Since the proposed Master Plan Amendment will not change the amount of development, no revision to the approved LFMP will be required. IV. ANALYSIS General Plan Amendment - GPA 96-05 Planning Issues 1. Are the proposed land use designations appropriate for the site and consistent with the policies of the General Plan? 2. Are the proposed land uses consistent and compatible with the surrounding land uses? DISCUSSION Development of the land uses proposed in the Rancho Carrillo Master Plan Amendment requires the approval of a General Plan Amendment which changes the types and locations of specific existing land use designations on the General Plan Land Use Map. The existing General Plan Land Uses for the amendment area are divided as follows: RLM 268 acres, RM 108 acres, RMH 42 acres, RH 6 acres, and OS 250 acres. The proposed General Plan Land Uses for the amendment area result in the following totals: RLM 256 acres, RM 107 acres, RMH 12 acres, RH 36 acres and OS 252 acres. The exhibit attached to the General Plan Amendment resolution graphically illustrates the applicant's proposal. . In addition to the 252 acres of open space provided within the boundaries of the Rancho Carrillo Master Plan an additional 17.5 acres of wetland mitigation will be provided adjacent to the westerly edge of the project on the Bressi Property. This wetland mitigation will be provided based on input fiom the Wildlife Agencies as a part of Continental Homes' Section 7 Permit for this project issued by the US Army Corp of Engineers. Exhibit 33 of the Rancho Carrillo Master Plan Amendment shows the location and type of wetland mitigation being proposed in this area. -. -7 ! 1 GPA 96-05MP 139(F) - RANCHO CARRILLO MASTER PLAN SEPTEMBER 3,1997 PAGE 3 The following changes to the existing General Plan Land Uses are evident: a change to the boundaries of the different land use densities in the northern portion of the Master Plan resulting in an increase in the amount of RH designated land with a corresponding decrease in the amount of RMH designated land and a increase in the amount of open space in the eastern portion of the Master Plan with a slight decrease in the amount of open space in the southern portion of the Master Plan. The slight decrease in open space in the southern portion of the Master Plan was in response to the Wildlife Agencies preference for additional offsite mitigation in the central riparian corridor. Open Space While the Open Space Element has as a goal the exploration of all means of providing for Open Space needs (2.A.l), and as such the additional Open Space acreage is in keeping with that goal, the following findings are required for the approval of a boundary adjustment to the map titled "Open Space and Conservation Map": The proposed open space is equal to or greater than the area depicted on the Open Space and Conservation Map since the Map shows approximately 250 acres while the General Plan Amendment would provide approximately 252 &res; and The proposed open space area is of environmental quality equal to or greater than that depicted on the Open Space and Conservation Map since the revision to increase the amount of open space along the eastem edge of the property has been made in response to input fiom the US Fish & Wildlife Service, US Army Corp of Engineers and California Department of Fish & Game's review and approval of the proposed biological mitigation for this project. The proposed adjustment to open space, as depicted on the Open Space and Conservation Map, is contiguous or within close proximity to open space as shown on the Open Space Map as confirmed by a review of the General Plan Amendment graphic. Multi-Family As explained in the staff repod for the previous amendment to the Rancho Cadlo Master Plan, the Housing Element of the City of Carlsbad has as a Goal 2, new housing developed with a diversity of types, prices, tenures, densities and location and in sufficient quantity to meet the demand of anticipated City and regional growth. Section One of the Housing Element reviews the previous element and concludes that the City failed to meet its go.als due to a variety of reasons; insufficient multi-family vacant property being a significant factor. A graphic illustration of this is that the amendments proposal for a 30.2 acre increase in the amount of RH (h~gh density 15-23 dwelling unit per acre) is a 46% increase in Carlsbad's vacant land within that category. The Residential Guidelines of the Land Use Element of Carlsbad's General Plan (page 44) limit medium and higher density residential developments to those areas where they are compatible with the adjacent land uses, and where adequate and convenient commercial services and public 2 G J 1 I GPA 96-05/MP 139(F) - RANCHO CARRILLO MASTER PLAN SEPTEMBER 3,1997 PAGE 4 support systems such as streets, park, schools, and utilities are adequate to serve them. The proposed increase in RH is located adjacent to the southeast comer of Palomar Airport Road and Melrose Drive which is in close proximity to public transportation and jobs along the Palomar Airport Road comdor. Single Family Residential Guideline Number One of the Land Use Element is to retain the present predominance of single-family residences throughout the community. Of the plan's 405 acres of residential land, 257 acres are devoted to RLM. In addition, a significant portion of the 107 acres of RM may also be expected to be developed with single family homes. Master Plan Amendment - MP 139(F) Planning Issue 1. Does the proposed Master Plan Amendment comply with all requirements of the Planned Community Zone (Chapter 21.38 of the Carlsbad Municipal Code)? DISCUSSION The proposed Master Plan Amendment only makes minor modifications to the existing Rancho Canillo Master Plan. There will be no revisions to the alignments of the Circulation roadways or noticeable modification to the previously approved grading. The developable acreage of the Master Plan will be slightly reduced in response to input from the Wildlife Agencies. The maximum number of units allowed by the existing Master Plan (1,8 16) will not be increased. As previously mentioned, the majority of the modifications occur in the northerly half of the Master Plan. The proposed land use revisions in the northern portion of the Master Plan will allow for the residential high density land uses to be located adjacent to jobs and public transportation along the Palomar Airport corridor. Open space will be increased along the easterly edge of the Master Plan. The only don in.the southerly portion of the Master Plan will be a slight decrease in the amount of open space between Villages 0 & Q. Based on input bm the Wildlife Agencies potential wetland mitigation that was considered in this area was relocated to the western edge of the Master Plan and offsite on the Bressi Property along the main riparian corridor. Accompanying this report is a copy of the proposed Rancho Carrillo M&er Plan. The majority of the text in the Master Plan is the same as the existing Rancho Carrillo Master Plan. The only revisions being proposed are shown by the strikeout and highlighted text. Exhibits within the proposed Master Plan have been revised to reflect the proposed changes. Other than strikeout and highlighted text and revised exhibits no changes to the previously approved Master Plan are being proposed. The essential changes within the Master Plan amendment, besides the redistribution of densities without increasing the overall number of dwelling units and the reflection of the input fiom the responsible agencies, include: an updated affordable housing section, a community park entrance exhibit, and the redesign of the connection between Villages 2 ( GPA 96-05/MP 139(F) - RANCHO CARRILLO MASTER PLAN SEPTEMBER 3,1997 G and F to minimiZe the environmental impact. Since the proposed Master Plan Amendment is basically only a minor revision and update to the previously approved Master Plan most of the findings and justifications made for the previously approved Master Plan are still applicable and have been provided below. The Rancho Carrillo Master Plan Amendment has been prepared consistent with the Carlsbad Municipal Code, Title 21, Chapter 21.38, "PC Planned Community Zone". The Master Plan includes the following required elements. a. Graphic plans of the proposed development including a map and legal description of the property, the location of various land uses, a map of the open space area, specific development provisions and standards the location of major circulation systems, the locations of facilities for water, sewer, and drainage, and a phasing schedule for various public improvements. b. A text to accompany the graphics that include a description of each type of land use, development regulations, a public facility plan, a phasing schedule, an open space plan, measures to mitigate adverse environmental impacts, and a community identification sign program- The following findings of fact must exist prior to recommending a master plan for approval: a The proposed development as described by the Master Plan is consistent with the provisions of the General Plan and any applicable specific plan. This amendment would be consistent with the General Plan Amendment. However, there are other goals that are also achieved by the implementation of this amendment as identified by the following: The Land Use Element Gods which are pertinent to this amendment include: A. Preserve and enhance the environment, character and image of the City as a desirable residential, beach, and open space oriented community. The project is residentially and open space oriented. F. Protect and conserve natural resources, fragile ecological areas, unique natural assets and historically significant features of the community. within the 252 acres of open Space, the hgile, unique natural assets and historically significant features of the community have been preserved. Additional acreage along the central stream corridor will be enhanced offsite to create additional wildlife habitat in conformance with the goals of Carlsbad's Habitat Management Program and the goals of the Resource Agencies. I. Encourage and promote the establishment of child-care facilities in safe and convenient locations throughout the community to accommodate the growing demand for child-care in the community caused by demographic, economic, and social forces. The Master Plan Amendment provides a synergistic experience between the passive Open Space, and the community park site, the school site, and the daycare and community recreation area. Preserve and create an Open Space system of aesthetic value that will maintain community identity, achieve a sense of natural spaciousness, and provide visual relief in the Cityscape. Assure new development provides for the Open Space needs of their occupants. The Master Plan includes passive and active Open Space that exceeds the 15% standard required by the Local Facilities Management Plan and the Planned Community Ordinances. Approximately 37% of the Master Plan is Open Space. In addition, approximately 17.5 acres adjacent to the western boundary of the Master Plan will be provided as permanent wetland mitigation. Protect and preserve visually attractive and/or significant natural areas. Through the use of the EIR, the Master Plan has been able to identig and preserve this area in such a manner as to provide both private and public viewsheds and access. Preserve Open Space area in as nad a state as possible. A review of the Open Space plan indicates that this is the intent of the document. Encourage larger and connected Open Space areas that than numerous and disconnected areas. Master Plan has successfully strived to meet this objective by constricting development to congruent conjoined discrete areas to allow for larger connected Open Space areas. Create natural man-made links between Open Space areas. In general with this plan, such linkages are not required because of the connectivity of the Open $pace. However, where possible the lmkages have been provided. The trafiic study that was prepared as a part of the previously certified EIR, concluded that there would be no negative impacts on streets and .= GPA 96-05/MP 139(F) - RANCHO CARRILLO MASTER PLAN SEPTEMBER 3,1997 PAGE 8 intersections outside of the boundaries of the Master Plan by traEc generated by properties within the Master Plan. An updated traffic study prepared by Kimberly-Horn and Associates concludes that traffic generated by the proposed amendment will not increase the volume of traffic outside the boundaries of the Master Plan. f. The area surrounding the development is or can be planned and zoned in coordination and substantial compatibility with the development. The determination of substantial compatibility has been made previously within the discussion of the General Plan Amendment. g. Appropriate measures are proposed to mitigate any adverse environmental impact as noted in the adopted environmental impact report for the project. Mitigation was identified in the previously certified EIR 91-04 . Much of this mitigation has occurred or is ongoing such as archeology, paleontological monitoring and biological enhancement. Staff and the applicant are in agreement with all aspects of the proposed Master Plan Amendment, except for potential building separation on two streets in Village F. Attached to this staff report is a letter hm Continental Homes proposing revised wording for page 145 of the Master Plan to address this issue. The applicant has indicated that they will provide detailed exhibits at the public hearing in an attempt to justiQ the proposed revision. Staff does not support this request as it does not meet the requirements of Note C of City Council Policy No. 44, “Guidelines for the Development of Small Lots.” Upon approval the Master Plan will become the controlling document for the Rancho Carrillo area. It implements the General Plan and the Planned Cornmunity Zone by establishing land uses and maximum development intensities based on a detailed analysis of the opportunities and constraints of the site. The Rancho Carrillo Master Plan includes General Plan and Land Use Provisions, specifications for the Development Review Process, General Community Development Standards, grading plans, an Open Space Plan., a Public Facilities and I~tructure Plan, and Village and Open Space Development Standards. SUMMARY The Proposed project is consistent with all policies and ordinances governing the subject site. In addition, it provides a development plan that is comprehensive, cohesive, and well-integrated with the surrounding environment. Staff, therefore, recommends approval of all the previously mentioned actions. V. ENVIRONMENTAL REVIEW An environmental analysis of the proposed project was conducted and no significant impacts were identified. Specifically the change of land use was assessed from an environmental impact standpoint as being in conformance with the previously approved Environmental Impact Report I 1 GPA 96-05/MP 139(F) - RANCHO CARRILLO MASTER PLAN SEPTEMBER 3,1997 PAGE 9 (EIR 91-04) for the project and the Master Environmental Impact Report for the 1994 General Plan update. GPA 96-051MP 139(F) - RANCH0 CARRILLO MASTER PLAN, A request for the approval of a General Plan Amendment, and Master Plan Amendment on the property located south of Palomar Airport Road, west of the eastern City limits, east of the Bressi Ranch, and north of Local Facilities Management Zone 6, in Local Facilities Management Zone 18. Chairperson Nielsen announced that if the Commission recommends approval of this item, it will be forwarded to the City Council for its consideration. Project Planner, Brian Hunter, presented the staff report and described the project as follows: This is a General Plan Amendment and a Master Plan Amendment request for the Ranch0 Carrillo Master Plan area. A projection of both the site and the proposed general plan designation maps was shown on the -) 3 PLANNING COMMISSION September 3, 1997 Page 2 overhead. The General Plan and Master Plan Amendments essentially reflect the consolidation of the ownership of this property and an update of the actions that have occurred since 1993. When this Master Plan was last amended, in 1993, this property was owned by Continental Homes and three (3) other separate private owners. Since that time, the Continental Homes Group has become the sole owner of the entire property. There is no change with this General Plan Amendment in the total number of dwelling units that will be allowed at the Carrillo Ranch site. What is proposed iS an increased density at the intersection of Melrose and Palomar Airport Road. At the same time, there is a decrease in density in the projects to the east. What is proposed is an RH designation at the intersktion of Palomar Airport Road and Melrose and then an RM designation on three (3) villages to the east. Previously, with the multiple ownerships, multiple family affordable housing sites were strung along Palomar Airport Road. However, now that there is single ownership, an economy of scale can be used and as a result, the majority of the inclusionary housing will now be at the intersection of Melrose and Palomar Airport Road. The General Plan also reflects a change in the open space designations. Essentially, the on-site open space has been increased by a couple of acres to bring it back to its original plan. Approximately 37% of the site was open space and of the total area of the site, 28% of the open space is performance standard open space. The Growth Management Program only requires 15% open space, and this project is providing nearly twice the required performance standard open space and the total amount of open space is 37% of the entire property. The change in the open space was brought about by input from both the State Department of Fish and Game and the Federal Fish and Wrldlife Service. There was some increased riparian mitigation in the stream area that was done, and the Federal Fish and Wildlife Service has determined that in accordance with what they are trying to do with their habitat management programs and habitat conservation plans, they need to get as wide a corridor as possible. This has resulted in some increase of open space along the eastern boundary of the site. The General Plan Amendment will affect both the Land Use Element of the General Plan as well as the Open Space and Conservation Element. The Master Plan itself is, essentially, an update of the affordable housing section that is going to reflect the maps that have been approved, to date. The city has allowed up to 20% of the required affordable units to be provided as second dwelling units and the rest will be provided in the inclusionary site previously identified. The Master Plan Amendment also reflects that the school district (San Marcos Unified) has indicated that they want the school site as shown on the plan. However, their fiscal responsibility prohibits them from funding it until access is available and since Melrose is not expected to be completed until 1998, the funding will take place when that access is complete. Also, the Master Plan has been amended to reflect this reality. The applicant has requested.some standard modifications that are site specific and relate to planned unit developments. They requested that these modifications be inserted into the Master Plan. However, staff does not support the request at this time as the maps are presently being processed. Upon approval of the Master Plan Amendment, those maps will be presented to the Planning Commission and staff feels that it will be more appropriate, at that time, to discuss the modifications that the applicant is requesting. Additionally, there is nothing in the Master Plan, at this time, that would preclude the consideration of those requested modifications at a later date. Mr. Hunter then displayed a map indicating the areas of the requested modifications in the Master Plan. Commissioner Compas, comparing the overhead display and the drawing on the wall, indicated that the drawing shows a piece of land where El Fuerte and Poinsettia come together, as being part of Ranch0 Carrillo and the overhead does not reflect the same. Mr. Hunter explained that part of what is happening with the open space adjustment is that there was a riparian area adjacent to the southern edge of the park site that was proposed by the applicant. However, the California Department of Fish and Game did not support the proposal primarily because they felt it was 24 -.I------- --- .___----. -. ~~._ _~ - PLANNING COMMISSION , September 3, 1997 Page 3 jUSt too constrained by development on either side. When it came to the riparian mitigation, (mitigation for areas that were essentially impacted by the construction of Melrose as it crossed the drainage area), their direction was that the mitigation area should be acquired off-site (on the Bressi Ranch property) which is not a part of the Master Plan. However, a condition of the maps and of the environmental impact report essentially ties that to this property in perpetuity. Commissioner Welshons pointed out that in the Table of Contents and in the report, it is noted that Village “I” has been eliminated and there is a strike-out, and then it refers to Villages “A” through “R”, and asked how many residential villages there will be in the completed Carrillo Ranch project. Mr. Hunter stated that he is told there will be seventeen (17). Commissioner Welshons then stated that that number needs to be changed throughout the document. Regarding open space area #9, Commissioner Welshons questioned the relevancy of the RV lot providing =x” number of square feet per residential unit, to the open space discussion on page 193. Mr. Hunter responded by saying that it is meant to act as a code reminder to show that that is the minimum requirement. Commissioner Compas asked what the “T” stands for in the southwestern portion of the map. Mr. Hunter explained that it is meant to designate a future community services site, such as a Boy’s and Girl’s Club, or some other community service. Chris Chambers, 12636 High Bluff Drive, San Diego, representing Continental Homes, stated that there are no momentous changes being proposed now that there is only one owner. He pointed out that his organization voluntarily agreed to leave a very large portion in the north and easterly portions of the site, ungraded and undeveloped so as to leave a relatively large amount of Coastal Sage undisturbed. As a result, he pointed out that the development, overall, will be a much better planned community and will allow them to build the affordable housing in the first phase of this community rather than in a later phase. Mr. Chambers stated that after due consideration of staffs thoughts regarding their request for some standard modifications (as mentioned earlier), they will withdraw their letter of request and take that matter up when the maps come before the Commission. Mr. Chambers gave a brief overview in which he stated that most of the infrastructure for the project has been completed and that by the end of the first quarter or the beginning of the second quarter of 1998, Melrose will be very near to being opened to the public. This in turn will give access for the construction of Carrillo Park and ultimately the use and enjoyment of the park by those who wish to avail themselves of its use. He also explained that the importance of the riparian mitigation is also significant, as it adds an additional eighteen (18) acres to that which they have already contributed to the City of Carlsbad. They were given the option to acquire some off-site locations and do some in-kind mitigation out of the area. However, they felt it would be appropriate to enhance the habitat for a number of species and elected to acquire the site immediately adjacent. In answer to Commissioner Compas’ question, Mr. Chambers further stated that Continental Homes now owns the property in question and will treat it as a part of Ranch0 Carrillo. He said that they feel it is an amenity to Ranch0 Carrillo and will be completing hiking trails in and around that area to be enjoyed by all. Mr. Chambers stated that if the weather cooperates (El NiAo not withstanding), they hope to be able to open Phase I with seven (7) new neighborhoods, including the affordable housing area. /yeas that remain to be completed before the first final maps are recorded, which they anticipate to be before the end of . PLANNING COMMISSION September 3, 1997 Page 4 1997, are the finalization of the Affordable Housing Agreement, the Site Development Plan for the affordable housing site which has been submitted and finally, the finalization of the school agreements with the San Marcos School District. Commissioner Compas, for clarification, asked how many phases there will be, what will be in Phase I, and when Mr. Chambers thinks the project will be completed. Mr. Chambers stated that the “worst case scenario” calls for a seven (7) year build-out. There will be 3 phases but they will all overlap in some manner and indicated which of them would overlap by pointing out the specific areas on the drawing on the wall. Commissioner Monroy asked what would happen if San Marcos ultimately decided that they did not want Parcel “E”. Mr. Chambers replied that it is a hypothetical question that he has not had the time to think about, but that San Marcos seems very excited about the opportunity and already have their state approvals and are ready to go. Chairperson Nielsen opened the Public Testimony and issued the invitation to speak. Barbara Craven, 2602 La Golondrina Street, Carlsbad, stated that she has absolutely no objection to the Ranch0 Carrillo project, in general. However, she further stated that she is concerned about the site that has been chosen for the RV storage, as it is directly below her home and causes visual pollution. Ms. Craven also expressed concern for the placement of the community services site. In her opinion, she went on, a community service facility should be more appropriately placed in or near the park. Ms. Craven pointed out that one of the main Land Use Element goals outlined in the report to the Planning Commission is, “. . .to preserve and enhance the environment, character, and image of the City, as a desirable beach and open space oriented community.” This project is residentially open space oriented. . Larry Thurston, 2616 La Golondrina Street, Carlsbad, stated that he also objects to the RV storage area and community services site, as they are planned. He asked if El Fuerte, which is immediately below his home, is going to be paved and extended into Ranch0 Carrillo. Mr. Thurston also stated that, upon inquiry regarding the starting and quitting times for the construction crews, he was told that Code does not allow them to begin before 7:00 a.m. and they must be finished by sunset, at the latest. However, he continued, machinery is started at 6:30 a.m., which is very disturbing and asked that the code be enforced in the future. Commissioner Welshons asked Mr. Thurston if he would step over to the drawing of the project and point out where his home is located. Mr. Thurston did as was requested, and indicated that the proposed RV lot is approximately 100 feet from his home. Commissioner Heineman asked Mr. Thurston to clarify his statement that the area he is objecting to is “an RV and Maintenance area.” Commissioner Heineman stated there is no reference to that area that would indicate that it will be used for maintenance. Mr. Thurston explained that while at the counter at the Planning Department, he was told that the area would store maintenance equipment in addition to RV storage. Seeing no one else wishing to testify, Chairperson Nielsen closed the Public Testimony. Commissioner Noble asked staff what is going to happen to El Fuerte Street. Principal Engineer, Bob Wojcik responded that it is his understanding that it will be opened when Village “Q”, in Phase I, is opened. ,’ .I’ I - . PLANNING COMMISSION September 3, 1997 Page 5 Commissioner Monroy asked staff to comment on the fact that men and machinery are starting their workday at 6130 a.m., instead of 7:00 a.m., as required by Code. Mr. Wojcik replied that the lawful time is, in fact, 7:00 a.m., and that his office has received several calls with complaints similar to those of Mr. Thurston. Additionally, he stated that he has asked the inspectors assigned to this project, to speak with the contractor(s) and remind them of the lawful hours of operation. He further stated that it is obvious that compliance has not been forthcoming and as a result, the inspectors will be instructed to contact the contractor(s) again and mete out more serious warnings regarding continuing non-compliance with the appropriate ordinance(s). Commissioner Welshons asked staff to explain why these Master Plans include provisions for RV storage, the locations, the distance from surrounding homes, and efforts made to screen these areas. Project Planner, Hunter, explained that the intent of a Master Plan is, as much as possible, to accommodate a variety of uses and to anticipate the needs of the residents. Typically, an RV storage area is included in a project of this size. The original plans for this project, with the RV facility located further to the southeast, were. brought to the Planning Commission and City Council in 1993, and in the public hearings that followed, several nearby residents voiced their complaints regarding that location. Consequently, the developer redesigned the plans and placed the RV facility in the location currently indicated on the map. Through the redesign, the facility is further down a hillside and is in an area distant from any development. As for screening, Mr. Hunter stated that large trees will be planted in an effort to screen the area as much as is possible. In response to the question of distance, Assistant Planning Director, Gary Wayne, stated that the distance from the edge of the RV storage area to the property line, is in excess of 400 feet. Chairperson Nielsen specifically asked if there will indeed be maintenance performed or maintenance equipment stored along with the RV’s. Mr. Hunter stated that there will not be any maintenance equipment or activities at that site and added that he has no idea what the counter person was referring to when he/she was speaking to Mr. Thurston.
