PW CITY ATTY. 4 CANNON ROAD WEST WETLAND MITIGATION - Q Q L3s Y 2 4 z 0 F 0 d 1 Ts z 3 0 0 RECOMMENDED ACTION: Adopt Resolution No. 73- 3oAapproving plans and specifications and authorizing the to advertise for bids for the construction of Cannon Road West Wetland Mitigation Cor Project No. 3184. ITEM EXPLANATION: Staff recommends approval of the plans and specifications to create a wetland mitigatic Macario Canyon for the construction of Cannon Road. This project involves the plant acres of land within Macario Canyon that is owned by the City of Carlsbad. The land USE is agricultural. The location was selected because of its proximity to existing wetland ha its proximity to the area of wetland impact for the construction of a bridge spannins Canyon. This wetland mitigation area is required by the conditions of the Biological Opi the United States Fish and Wildlife Service to mitigate wetland impacts made necessi construction of Cannon Road West from LEG0 Drive to El Camino Real and is a condii Army Corps of Engineers 404 Permit. The construction of the wetland mitigation are: fencing and a one year maintenance program. ENVIRONMENTAL REVIEW: It has been determined by the Planning Department that sufficient study has been undc as evidenced in the following documents on file with the Engineering Department Planning Department: Final EIR for Kelly Ranch: August 1983; Final EIR for Reac Cannon Road: March 1989; USFWS Biological Opinion: April 1992; City of Carlsbad EIR: September 1994; Biotechnical Report for Cannon Road Reach 2: January 1996; Pocket Mouse Assessment Cannon Road Reach 1: September 1996; Del Mar Mal Biological Survey: April 1997; Wetland Delineation: April 1997; least Bell's vireo Bit Survey: July 1997; Endangered Species Field Surveys at Cannon Road: July 199i Check for Pacific Pocket Mouse: July 1997; Mitigated Negative Declaration for Cannol Reach 2: October 1997. The original environmental documents updated by subs studies and surveys are the basis for a determination that the potential environmental i: created as a result of implementing the mitigation measures required for the construc Cannon Road Reaches 1 and 2 have been previously reviewed with previously c environmental documents and, therefore, no additional environmental review will be r( and a notice of determination will be filed. FISCAL IMPACT: The Engineer's Estimate for the construction of this project is $300,000. I CANNON ROAD WEST WETLAND MITIGATION CONSTRUCTION, WHEREAS, the City Council of the City of Carlsbad, California has determir necessary, desirable, and in the public interest to construct the wetland mitigation arc Cannon Road West ; and WHEREAS, the City Council has found that this project was described in the MElR 9 EIR 87-02, and EIR 83-04 as within their scopes; AND there will be no significant unmiti! effect, not analyzed therein; AND that therefore this project is within the scope of the prior E and 11 WHEREAS, the City Council of the City of Carlsbad has reviewed, analyzed 13 considered the Mitigated Negative Declaration EIA 96-02, the environmental impacts th identified for this project and said comments thereon, and the Mitigation Monitoring Reporting Program, on file in the Planning Department, prior to APPROVING the project; anc 14 15 16 11 WHEREAS, based on the EIA Part II and comments thereon, the City Council finds 17 there is no substantial evidence the project will have a significant effect on the environment the implementation of the mitigation measures identified and described in MElR 9; 18 19 11 EIR 87-02, EIR 83-04 and the Mitigated Negative Declaration EIA 96-02; and 20 11 WHEREAS, the plans and specifications for furnishing of all labor, material, t 21 22 23 equipment, transportation and other expenses necessary or incidental for said project have prepared and are on file in the Engineering Department of the City of Carlsbad and 24 incorporated by reference herein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carls 25 California, as follows: 26 1. That the above recitations are true and correct. 2.
