RECOMMENDED ACTION:

Service Area 135.
ITEM EXPLANATION
On February 15, 1994, the City Council approved Resolution No. 94-59 gr
consent to the inclusion of the City of Carlsbad in the proposed County 5
Area 135, formed to provide a tax base to fund a regional public safety 80
radio communication system. Then on March 21, 1995, the City C
approved a budget and operating agreement for said system which is CUI
being installed and tested throughout the County.
Subsequently, Proposition 2 18 was approved by the electorate in Novem
1996 and as a result it was the consensus of County Counsel an(
Attorneys that further CSA 135 charges after July 1, 1997, would require
approval of a special tax. Knowing this, the Regional Communication S
(RCS) group of administrators, finance directors, counsels and other al
parties met over the course of several months and discussed alter
methods of funding the RCS debt. The conclusion of those discussion
that the only viable funding alternative is to ask the Board of Supervis
hold an election for voter approval of the CSA 135 charges as a special t
is anticipated that the Board will determine when such an election will b
at their December 17, 1997, meeting.
Recommendation
Staff recommends that the City Council approve the attached reso
A of CSA 135. This will provide a consistent funding source of approxir
$22.89 per single-family residence, per year, for developing and maintair
regional communications system.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA7 REQUESTING THE COUNTY OF SAN
DIEGO BOARD OF SUPERVISORS TO CALL A SPECIAL TAX
ELECTION IN ZONE A OF COUNTY SERVICE AREA 135
WHEREAS, on December 6, 1994, the Board of Supervisors
County of San Diego formed County Service Area 135-Regional 8(
Radio System, and with the consent of this City Council, included t
of Carlsbad within County Service Area 135; and
WHEREAS, with the consent of this City Council, the B
Supervisors, on December 6, 1994, established Zone A of Ct
consisting of all territory within the boundaries of this City; and
WHEREAS, the Board of Supervisors pursuant to Governmen
section 25210.77a, levied a county service area charge with
boundaries of County Service Area 135 to pay for the "backbone"

WHEREAS, due to the provisions of Proposition 218, the Bc
Supervisors ceased to levy both the county service area backbone
and the zone charge as of July 1, 1997; and
WHEREAS, it is the desire of the Board of Supervisors and th
Council to allow the voters to decide to replace these previously
county service area charges with special taxes in the same amount; a
WHEREAS, the Board of Supervisors is willing to call an e
within Zone A of CSA 135, for the voters to determine whether a spec
shall be adopted to replace the county service area zone charges
Council so requests:
NOW, THEREFORE, BE IT RESOLVED by the City Council of tk
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. The Board of Supervisors is requested to call an election
the boundaries of County Service Area 135 Zone A for purposes of I
