RECOMMENDED ACTION:
Adopt Ordinance No. NS-435, amending Title 10, Chapter 10.44, of the Carlsbad Municipal
Code, by the amendment of Section 10.44.320, to establish a 40 mile per hour prima facie
speed limit upon Faraday Avenue fiom College Boulevard to its westerly terminus.
ITEM EXPLANATION
Ordinance No. NS-435 was introduced and first read at the City Council meeting held on
December 9, 1997. The second reading allows the City Council to adopt the ordinance which
would then become effective in thirty days. The City Clerk will have the ordinance published
within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF
SECTION 10.44.320 TO ESTABLISH A PRIMA FACIE 40 MILE PER
HOUR SPEED LIMIT UPON FARADAY AVENUE FROM COLLEGE
BOULEVARD TO ITS WESTERLY TERMINUS.
WHEREAS, the City Council of the City of Carlsbad, California, hereby ordains as follov
SECTION 1: That Title IO, Chapter 10.44, of the Carlsbad Municipal Code is amend
by the revision of Section 10.44.320 to read as follows:
"10.44.320 Faraday Avenue:
a. Upon Faraday Avenue from College Boulevard to its
intersection with Orion Street, the prima facie speed limit shall
be forty miles per hour. b. Upon Faraday Avenue from College Boulevard to its
westerly terminus 4,500 feet west of College Boulevard, the
prima facie speed limit shall be forty miles per hour."
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adopti
and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it
be published at least once in a newspaper of general circulation in the City of Carlsbad wit1
fifteen (1 5) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on t
9th day of December , 1997, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Coun
held on the 16th day of December , 1997 by the following vote, to wit:
