ITEM EXPLANATION: The proposal involves changing the site plan and architectural elevations of a 70,000 square foot office project. No change of land use is proposed. The Specific Plan designated the site as office and the proposal is for an office building for office uses. The new design includes an increase of 4,688 square feet of gross floor area, an increase in the number of parking spaces required commensurate with the increase in floor area, and a decrease in the overall building height. Parking is provided at a ratio ‘of one space per 250 square feet of gross floor area and the building height is 30 feet versus the originally approved 32 feet. The site has also been redesigned to eliminate access from Camino Del Parque. The Planning Commission conducted a public hearing on October 15, 1997, and voted 4-O approving the Coastal Development Permit and recommending approval of the Specific Plan Amendment. Some residents of Alta Mira, including a representative from the Homeowner’s Association, spoke in Favor of the project primarily because no access is designed to be taken off of Camino Del Parque. ENVIRONMENTAL REVIEW: An environmental analysis of the proposed project was conducted and no significant impacts were identified. Specifically, the changed site plan and elevations were assessed as being in conformance with the previously approved Negative Declaration. Therefore a Notice of Prior Compliance was issued by the Planning Director for SP 23(G) on July 29, 1997. FISCAL IMPACT: Development of the site is at the expense of the developer. CASE NAME: CARLSBAD CORPORATE PLAZA , CASE NO.: SP 23(G) WHEREAS, Carlsbad Corporate, LLC, “Developer”, has filed a verified application with the City of Carlsbad regarding property owned by Carlsbad Corporate, LLC, “Owner”, described as Parcel 3 of Parcel Map No. 3415, in the City of Carlsbad, County of San Diego, State of California, filed in the office of the County Recorder of San Diego County, January 21,1975 a file No. 75-014212 of official records. W That based on the evidence presented at the public hearing, the Commission RECOMMENDS APPROVAL, of Specific Plan amendment SP 23(G), based on the following findings and subject to the following conditions: Findiws: 1. The Planning Commission finds that the project, as conditioned herein for SP 23(G), is in conformance with the Elements of the City’s General Plan, because the proposed plan will contribute to the balance of land use so that local residents may work in the community in which they live. 2. The project is consistent with the City-Wide Facilities and Improvements Plan, the applicable local facilities management plan and all City public facility policies and ordinances since: a. The project has been conditioned to ensure the building permits will not be issued for the project unless the District Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the District Engineer is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. b. Statutory School fees will be paid to ensure the availability of school facilities in the Carlsbad School District C. All necessary public improvements have been provided or are required as conditions of approval. 3. The Developer has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. 4. The proposed plan would not be detrimental to the public interest, health, safety, convenience or welfare of the City. 5. All necessary public facilities can be provided concurrent with need and adequate provisions have been provided to implement those portions of the capital improvement program applicable to the subject property. The proposed commercial use will be appropriate in area, location and overall design to the purpose intended. The design and development standards are such as to create an environment of sustained desirability and stability. Such development will meet performance standards established by this title. The development site is zoned in coordination and substantial compatibility v&h the area surrounding the development. The project has no new significant environmental effect not analyzed as significant in the prior Negative Declaration. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that the project proposes the construction of an office project within an area designated for commercial development. The LCP Land Use Plan designates the subject site for N (Neighborhood Commercial). The site has not been used for agriculture, is not adjacent to the shoreline nor is it adjacent to coastal bluffs, and is located east of the I-5 freeway and therefore will not affect coastal access. Conditions: Planning: 1. The Planning Commission does hereby RECOMMEND APPROVAL of Specific Plan Amendment SP 23(G) for the project entitled Carlsbad Corporate Plaza (Exhibit(s) ‘bA” _ “N” dated October l&1997, on file in the Planning Department and incorporated by this reference, subject to the conditions herein set forth.). Staff is authorized and directed to make, or require Developer to make, all corrections and modifications to the Specific Plan document(s), as necessary, to make them internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the approved Exhibits. Any proposed development substantially different from this approval, shall require an amendment to this approval. 2. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless the City of Carlsbad, its Council members, offkers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney’s fees incurred by the City arising, directly or indirectly, from (a) City’s approval and issuance of this Conditional Use Permit, (b) City’s approval or issuance of any permit or action, whether discretionary or non- discretionary, in connection with the use contemplated herein, and (c) Developer/Operator’s installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. 3. The Developer shall provide the City with a reproducible 24” x 36”, mylar copy of the Site Plan as approved by the final decision making body. The Site Plan shall reflect the conditions of approval by the City. The Developer shall include, as part of the plans submitted for any permit plan check, a reduced legible version of the approving (resolution(s)) on a 24” x 36” blueline drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal Development Permit and signed approved site plan. 5. Building permits will not be issued for development of the subject property unless the District Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. 6. The Developer shall pay the public facilities fee adopted by the City Council on July 28, 1987, (amended July 2, 1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or Facilities and Improvement Plan and to fulfil1 the subdivider’s agreement to pay the public facilities fee dated April 9, 1997, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid, this application will not be consistent with the General Plan and approval for this project will be void. 7. The Developer shall provide proof of payment of statutory school fees to mitigate conditions of overcrowding as part of the building permit application. The amount of these fees shall be determined by the fee schedule in effect at the time of building permit application. 8. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 4 Local Facilities Management Plan and any amendments made to that Plan .prior to the issuance of building permits, including, but not limited to the following: a. No special conditions for Local Facilities Management Zone 4 are required. 9. Trash receptacle areas shall be located away from the existing residential buildings of Altamira and shall be enclosed by a six-foot high masonry wall treated to reflect the materials used on the principal buildings with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director. 10. An exterior lighting plan including parking areas shall be submitted for Planning Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. No outdoor storage of materials shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. The Developer shall prepare a detailed landscape and irrigation plan in conformance with the approved Preliminary Landscape Plan and the City’s Landscape Manual. The plans shall be submitted to and approval obtained from the Planning Director prior to the approval of the grading permit, or building permit, whichever occurs first. The Developer shall construct and install all landscaping as shown on the approved plans, and maintain all landscaping in a healthy and thriving condition, free from weeds, trash, and debris. The Developer shall submit and obtain Planning Director approval of a uniform sign program for this development prior to occupancy of any building. Signage is prohibited on the west elevation facing the freeway. Signage facing east shall be designed with minimal lighting so as not to visually impact the existing residences in Altamira. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. Prior to any grading of the project site, a paleontologist shall be retained to perform a walkover survey of the site and to review the grading plans to determine if the proposed grading will impact fossil resources. A copy of the paleontologist’s report shall be provided to the Planning Director prior to issuance of a grading permit. The Developer is aware that the City is preparing a non-residential housing impact fee (linkage fee) consistent with Program 4.1 of the Housing Element. The applicant is further aware that the City may determine that certain non-residential projects may have to pay a linkage fee, in order to be found consistent with the Housing Element of the General Plan. If a linkage fee is established by City Council ordinance and/or resolution and this project becomes subject to a linkage fee pursuant to said ordinance and/or resolution, then the Developer, or his/her/their successor(s) in interest shall pay the linkage fee. The linkage fee shall be paid at the time of issuance of building permits, except for projects involving a request for a non-residential planned development for an existing development, in which case, the fee shall be paid on approval of the final map, parcel map or certificate of compliance, required to process the non-residential PUD, whichever pertains. If linkage fees are required for this project, and they are not paid, this project will not be consistent with the General Plan and approval for this project will become null and void. The developer shall comply with all applicable provisions of federal, state, and local ordinances in effect at the time of building permit issuance. This approval shall supersede previous approvals for the site as described in Planning Commission Resolution No. 3461 and adopted by City Council per Ordinance NS-224. Engineering: 19. Prior to issuance of any building permit, the developer shall comply with the requirements of the City’s anti-graffiti program for wall treatments if and when such a program is formerly established by the City. 20. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 21. Prior to issuance of a building permit for any buildable lot within the subdivision, the property owner shall pay a one-time special development tax in accordance with City Council Resolution No. 91-39. 22. The developer shall pay all current fees and deposits required. 23. Prior to approval of any grading or building permits for this project, the owner shall give written consent to the annexation of the area shown within the boundaries of the subdivision plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided by the City. 24. Prior to the issuance of a grading permit or building permit, whichever occurs first, the developer shall submit proof that a Notice of Intention has been submitted to the State Water Resources Control Board. 25. Prior to issuance of building permits, the developer shall underground all existing overhead utilities within the project boundary, with the exception of the single pole on the northern boundary, to the satisfaction of the City Engineer. 26. The developer shall comply with the City’s requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The developer shall provide best management practices as referenced in the “California Storm Water Best Management Practices Handbook” to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be approved by the City Engineer. Said plans shall include but not be limited to notifying prospective owners and tenants of the following: a. All owners and tenants shall coordinate efforts to establish or work with established disposal programs to remove and properly dispose of toxic and hazardous waste products. b. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be PC RESO NO. 4184 -6- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 - -4 discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. 27. The structural section for the access aisles must be designed with a traffic index of 5.0 in accordance with City Standards due to truck access through the parking area and/or aisles with an ADT greater than 500. The structural pavement design of the aisle ways shall be submitted together with required R-value soil test information and approved by the City as part of the building site plan review. 28. If any of the foregoing conditions fail to occur; or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke or further condition all certificates of occupancy issued under the authority of approvals herein granted; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City’s approval of this Specific Plan Amendment. 29. Prior to issuance of building permits, the applicant shall obtain a City right-of-way permit to perform the following: a. Install a sidewalk underdrain on Paseo De1 Norte, as shown on the site plan. b. Construct a pedestrian ramp on the southwest corner of Paseo De1 Norte and Camino De1 Parque. C. Install the driveway aprons on Paseo De1 Norte and on Camino De1 Parque. d. Relocate the fire hydrant on Paseo De1 Norte from its existing location in the sidewalk to 18” behind the sidewalk Fire: 30. Prior to the issuance of building permits, complete building plans shall be approved by ‘the Fire Department. 31. Additional onsite public water mains and fire hydrants are required. 32. Applicant shall submit a site plan to the Fire Department for approval, which depicts location of required, proposed and existing public water mains and fire hydrants. Applicant shall submit a site plan depicting emergency access routes, driveways and traffic circulation for Fire Department approval. An all weather, unobstructed access road suitable for emergency service vehicles shall be provided and maintained during construction. When in the opinion of the Fire Chief, the access road has become unserviceable due to inclement weather or other reasons, he may, in the interest of public safety, require that construction operations cease until the condition is corrected. All required water mains, fire hydrants and appurtenances shall be operational before combustible building materials are located on the construction site. Prior to final inspection, all security gate systems controlling vehicular access shall be equipped with a “Knox”, key operated emergency entry device. Applicant shall contact the Fire Prevention Bureau for specifications and approvals prior to installation. Prior to building occupancy, private roads and driveways which serve as required access for emergency service vehicles shall be posted as fire lanes in accordance with the requirements of section 17.04.020 of the Carlsbad Municipal Code. Native vegetation which presents a fire hazard to structures shall be modified or removed in accordance with the specifications contained in the City of Carlsbad Landscape Guidelines Manual. Applicant shall submit a Fire Suppression plan to the Fire Department for approval. Plans and/or specifications for fire alarm systems, fire hydrants, automatic fire sprinkler systems and other fire protection systems shall be submitted to the Fire Department for approval prior to construction. An approved automatic fire sprinkler system shall be installed in buildings having an aggregate floor area exceeding 10,000 square feet. A monument sign shall be installed at the entrance to the driveway or private street indicating the addresses of the buildings onsite. Water: 42. The entire potable water system, reclaimed water system and sewer system shall be evaluated in detail to insure that adequate capacity, pressure and flow demands can be met. The developer shall be responsible for all fees, deposits and charges which will be collected before and/or at the time of issuance of a building permit. The San Diego County Water Authority capacity charge will be collected at issuance of application for meter installation. 44. Sequentially, the Developers Engineer shall do the following: a. Meet with the City Fire Marshal and establish the fire protection requirements. Also obtain GPM demand for domestic and irrigational needs from appropriate parties. b. C. Prepare a colored reclaimed water use area map and submit to the Planning Department for processing and approval. Prior to the preparation of sewer, water and reclaimed water improvement plans, a meeting must be schedules with the District Engineer for review, comment and approval of the preliminary system layouts and usages (i.e., GPM-EDU). 45. This project is approved upon the expressed condition that building permits will not be issued for development of the subject property unless the water district serving the development determines that adequate water service and sewer facilities are available at the time of application for such water service and sewer permits will continue to be available until time of occupancy. This note shall be placed on the final map. 46. All landscape and irrigation improvement plans shall be submitted to Larry Black at the City of Carlsbad, Planning Department, 2075 Las Palmas Drive, Carlsbad, California 92009. Code Reminders: 47. This approval shall become null and void if building permits are not issued for this project within 18 months from the date of project approval. 48. Approval of this request shall not excuse compliance with all applicable sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance, except as otherwise specifically provided herein. 49. The project shall comply with the latest non-residential disabled access requirements pursuant to Title 24 of the State Building Code. 50. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Community Development and Planning. The developer shall exercise special care during the construction phase of this project to prevent offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. I. RECOMMENDATION That the Planning Commission adopt Planning Commission Resolutions No. 4 184 and 4185 RECOMMENDING APPROVAL of Specific Plan Amendment SP 23(G) and APPROVING Coastal Development Permit CDP 97-l 0 based on the findings and subject to the conditions found therein. II. INTRODUCTION This proposal includes a request for an amendment to a previously-approved site plan and architectural elevations for an office project of approximately 75,000 square feet on a 4.59 acre site. The developer has requested the approval of a new site plan and elevations more attractive to today’s office market. The proposed amendment will increase the aggregate total size of the buildings by approximately 5,000 square feet. III. PROJECT DESCRIPTION AND BACKGROUND Specific Plan 23 was adopted in 1972 for what was then known as Campobello, today the area is called Altamira. Later that same year an amendment was adopted to expand the Specific Plan area by 3.05 acres to create a total of 8 acres of Neighborhood Commercial Zoning within the Specific Plan. In 1985 SP 23 was amended (SP23E) to include specific development plans for an office complex on the southern portion of the Neighborhood Commercial 8 acres. The project was never completed and the property has been purchased by the current owner who has requested approval of changes to the site plan and building design. The 1985 approval included three two-story buildings with an aggregate of approximately 70,000 square feet of building and the provision of 282 parking stalls. The site design was a cluster of the three buildings in the central portion of the site with parking provided along the entire SP 23(G)/CDP 97-10 CARLSBAD CORPORATE PLAZA October 15, 1997 perimeter. The architectural style was typical of its time with black spandrel glass, gray vision glass and brick veneer. The project is subject to the following regulations: l Specific Plan 23(F) l Local Coastal Program IV. ANALYSIS The recommendation for approval of this project was developed by analyzing the project’s consistency with the applicable policies and regulations listed above. The following analysis section discusses compliance with each of the regulatory documents utilizing both text and tables. A. SPECIFIC PLAN 23(F) Office use was determined to be appropriate for this site with the adoption of Specific Plan Amendment SP 23(E). At that time both a mini-warehouse and an office complex were approved for the 8 acres of Neighborhood Commercial within the Campobello Specific Plan. Development standards for the site were established by Specific Plan SP 23(E) which in essence is a site plan and elevations. Following the same logic, approval of the proposed amendment will establish the development standards. The proposal is not inconsistent with typical office development. The building height is limited to 35 feet at its highest point and setbacks from property lines are at least 20 feet from side and rear property lines. Parking has been provided at one space per 250 square feet of gross floor area resulting in 300 spaces. More at issue is the site and architectural design of the office complex. Following is a comparison of the proposal with the existing approvals. General DesiPn The proposed buildings are a total of 74,866.5 square feet. That is 4,866.5 square feet larger than the existing approval. As can be seen in Table I, parking is provided with a total of 300 spaces. Both the existing project design and the proposed project design comply with current parking requirements. Although a 35 foot height is allowed, the building height has been reduced with the proposal. The existing approvals include a building height of 32 feet, while the proposed building height is 30 feet. However, upon review of the site plan it is shown that the building is moved to the north and northwestern edges of the site which are the furthest distances from any of the Altamira residences. Of the fourteen residences along the south property line and the six along Camino de1 Parque, 17 will enjoy a much greater separation from the proposed buildings, one will be equally affected and two will be brought closer than previously to the proposed buildings. Although this may seem like a negative impact, one still has to consider the fact that the buildings will in no case be closer than 80 feet and the building is no taller than 30 feet. Physical compatibility will not be an issue with regard to the buildings. Circulation An issue has been raised as a concern of residents within the Altamira development. The proposal includes an open access point to the project from Camino De1 Parque. The existing approvals have a circulation design which depends on a single point of access off of Paseo De1 Norte and an emergency access point off of Camino De1 Parque. Staff has required the additional open access point on Camino De1 Parque because a single point of access will be too great of a burden on a project which is anticipated to have an ADT of 1,500. The residents prefer the existing design which prevents daily traffic from using Camino De1 Parque. Views The City does not have a view preservation policy, and in this instance there are no’ existing views enjoyed by the residents of Altamira adjacent to the project to be impacted. B. LOCAL COASTAL PROGRAM . The site is located within the Mello II segment of the Carlsbad Local Coastal Program. As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. The project proposes the construction of an office project within an area designated for commercial development. The LCP Land Use Plan designates the subject site for N (Neighborhood Commercial). The site has not been used for agriculture, is not adjacent to the shoreline nor is it adjacent to coastal bluffs, and is located east of the I-5 freeway and therefore will not affect coastal access. 2. As a reminder to the applicant, Commissioners, and the public, Chairperson Nielsen announced that if the Commission approves this item, it will be fonrvarded to the City Council for its consideration. Chairperson Nielsen asked the applicant to approach the podium and asked if he had any objections to this item being heard by the four Commissioners present. Ron Jenkins, Smith Consulting Architects, 5355 Mira Sorrento Place, San Diego, responded with an affirmative answer. Project Planner, Christer Westman, presented the staff report and described the project as follows: The applicant has requested approval of an amendment to Specific Plan 23 and a Coastal Development Permit for the development of approximately 75,000 sq. feet of office building. In 1985, Specific Plan 23E a3 PLANNING COMMISSION October 15. 1997 Page 15 established the location and design of three office buildings on the site. The applicant has requested the amendment in order to move the buildings to the northwest and west and to reduce the number Of buildings on the site from three to two. The proposal is consistent with development standards. Three hundred parking stalls are proposed where two hundred eighty-two are required. The building height is thirty-five feet to the top of a skylight but the rest of the building is predominantly thirty feet where the allowed height is thirty-five feet. Access is designed to be taken only from Paseo Del Norte. The original design included an emergency access onto Camino Del Parque. However, that has been removed and the buildings have been designed on the site to be placed approximately eighty feet (minimum) from the nearest residence. Staff is recommending approval of this project ana also asks that two conditions be modified on Resolution No. 4184. The modifications are as follows: Condition #13 - Modified to say that signage will not be allowed on the west facing wall only. Condition #25 - Modified to add the phrase, “. . . to the satisfaction of the City Engineer” to the end of this condition. Commissioner Compas asked if Mr. Westman would discuss the trash enclosure situation. Mr. Westman stated that the site plan shows a pair of trash bins in an enclosure on the south side of the project, adjacent to the Alta Mira residences. There is a condition in the Resolution which requires those trash enclosures to be moved elsewhere, on-site, to the satisfaction of the Planning Director. The intent of that condition was to eliminate any potential conflict with the use of those trash enclosures. Mr. Jenkins pointed out that the intent of the design is to get the buildings as far away from the residential area as possible, and still build the site so that it is financially feasible. He added that they have kept the buildings profiles very low and have kept both the front and back facades very interesting so as to compliment the area. As for the parking lot, Mr. Jenkins stated that it will contain many trees so that it will take on a park-like atmosphere. There is a thirty foot high parapet that will conceal all of the mechanical units, such as air conditioning, up on the roof. Mr. Jenkins also pointed out that the only view that would be lost to anyone, is the view of a portion of the freeway. Mr. Jenkins made reference to a parking lot exit that was in the original design, but at the request of the neighboring residents, it has since been removed and the original entry way has been made enlarged larger to allow for both ingress and egress through the same driveway. Chairperson Nielsen opened the Public Testimony and issued the invitation to speak. Ken Perkins, 6406 Camino Parque, Carlsbad, stated that his home is one of four or five that are directly affected by this project, and unlike having to fight every project that has come along before this one, he wholly agrees with this one. He went on to point out that the developer has shown unusual consideration for the neighboring residents.not to mention the fact that they will be removing a very unsightly area and replacing it with something that will please the eye. Mr. Jenkins urged the Commission to approve the requests as presented. Al Coke, 6511 Camino Paque. Carlsbad, the official representative of three hundred fifty-four homeowners in the area, stated that they have met with the developers and the city, at which time they presented three concerns. He further stated that he was happy to say that those concerns have been addressed and implemented in the new map, they are very please with the results and have no objection to the project. Betty Miller, 908-E Caminito Madrigal, Carlsbad, stated that her reason for attending this Planning Commission meeting was her concern regarding the potential height of the buildings. However, she continued, she has been very pleased with the presentation and extremely pleased that the buildings will only be thirty feet high. Ms. Miller went on to say that a number of her neighbors have also been concerned about the possibility of losing their views and she is pleased that she will have a positive report for them. Ms. Miller also asked what types of trees will be planted. Seeing no one else wishing to testify, Chairperson Nielsen closed the Public Testimony. - PLANNING COMMISSION October 15,1997 Page 16 Mr. Westman, in response to questions regarding the views and the impairment Of those views, stated that because of the varying elevations and locations of all of the different condominiums that surround this proposed project, there will have to be varying degrees or levels of what may or may not be obstructed and that staff needs to be a little cautious about “guaranteeing” that only the freeway will be blocked by the building, Mr. Westman also pointed out that it is possible that the building will be a buffer for the noise rising from the freeway. Mr. Wayne suggested that Mr. Westman show the Commission and the public, a rendering of the parapet and its height. Mr. Westman pointed out the parapet, stating that the height at the edge of the roof (including the parapet) is thirty feet. He also called attention to a triangular shaped skylight which, at its highest point, is thirty-five feet high. He quickly pointed out that although the skylight is thirty-five feet in height, it makes up a very small percentage of the roof. Mr. Wayne pointed out that the roof is technically lower than thirty feet so the parapet is able to screen the equipment installed on the roof. Regarding the trees, Mr. Westman stated that there will be Liquid Amber (60 feet at maturity), Melaleuca (40 feet at maturity), Yew pine (50 feet at maturity), and Brisbane Box (40-60 feet at maturity). ACTION: Motion by Commissioner Compas, and duly seconded, to adopt Planning Commission Resolutions No. 4184 and 4185, recommending approval of SP 23(G) and approving Coastal Development Permit CDP 97-10, based on the findings and subject to the conditions found therein, including the amendments to Conditions No. 13 and 25, identified by Project Planner Christer Westman.. Mr. Westman repeated the amendments to Conditions No. 13 and 25: condition No. 13 would read as follows: “Signage is prohibited on the west elevation (strike AND NORTHWEST). Mr. Westman agreed with his interpretation. Mr. Rudolf pointed out that the addition of the phrase means that it will be completely undergrounded, to his satisfaction, and partial undergrounding cannot be to his satisfaction. He continued by stating that if the Commission wishes to delegate some authority to the City Engineer, some parameters will be needed regarding what authority the Engineer has as to what, if anything, is not going to be underground. Mr. Rudolf suggested that the language should be as follows: “The developer shall underground all existing overhead utilities within the project boundary, with the exception of the pole on the northern boundary, to the satisfaction of the City Engineer.” Chairperson Nielsen reopened the Public Hearing.
