HD. %+ MTG. l/6/98 MANAGEMENT ;DEPT. RM RECOMMENDED ACTION: Adopt Resolution No.98 -3 authorizing destruction of certain records kept by Risk Management. I ITEM EXPLANATION Section 34090 of the Government Code provides authority for the destruction of documents that are more than two years old and no longer required. The consent of the City Attorney and authorization of the City Council also is required prior to the destruction of any document. The documents proposed for destruction include a log book and certain liability files. A log book was used during the years 1983,1984,1985,1986 and 1987 to list claims, incident reports, damage to City property and safety referral reports. This book was used as a tracking system prior to the establishment of the Risk Management Office. The listings contained in the log have been reviewed in accordance with the provisions of Section 34090 of the Government Code and meet those requirements, and the City Attorney has consented to their destruction. The liability files are general liability claims and tort law suits and have been closed more than 5 years beyond the deadline for all legal remedies available to the claimant/plaintiff. They have been reviewed by the City Attorney and he has consented to the destruction of these files. FISCAL IMPACT None. EXHIBITS 1. That pursuant to Section 34090 of the Government Code, Risk Management is authorized to destroy a log book and general liability claims and tort law suits and have been closed more than 5 years. 2. This resolution shall not authorize the destruction of any record which the City Attorney deems is necessary for the ongoing or current activity of the office of the Risk Manager.
