TITLE- TRANSFER OF FUNDS FOR LEGAL SERVICES
IN~NECTION WITH THE DRAFTING AND
IMPLEMENTATION OF THE HABITAT MANAGEMENT
RECOMMENDED ACTION:

Adopt Resolution No. ee3/ authorizing the transfer of $30,000 from the general fund
reserves into the City Attorney’s budget to cover the continuing costs related to the Habitat
Management Plan.
ITEM EXPLANATION:
Attorney David E. Moser of the law firm of McKutcheon, Doyle, Brown & Enersen, has been
providing legal services regarding the implementation of the Habitat Management Plan and the
Endangered Species Act, since 1996. This agenda bill requests the Council to transfer an
additional $30,000 from the general fund reserves into the City Attorney’s budget to cover the
continuing costs of these services.
FISCAL IMPACT:
Staff is recommending that the Council authorize the transfer of an additional $30,000 from the
general fund reserves into the City Attorney’s budget (00112107410) to cover these costs, In
certain instances it may be possible to recover a portion of these legal costs and others
associated with the program through the implementation of a fee or other charge for the take of
habitat under our long term plan.

ACCOUNT TO PAY FOR LEGAL SERVICES REGARDING
THE DRAFTING AND IMPLEMENTATION OF THE CITY’S
HABITAT MANAGEMENT PLAN
6 The City Council of the City of Car&bad, California, does hereby resolve as
7 follows:
8 1. That the amount of $30,000 is hereby transferred from the General Fund

10 Reserve Balance to the City Attorney’s professional services account (11012107410) to
11 support the cost of these services.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City
Council of the City of Carlsbad on the 10th day of February 1998, by the
