RECOMMENDED ACTION:
Adopt Resolution No. for approval and acceptance of Amendment No
Malcolm-Pirnie, Incorporated to provide additional design services for Vista/(
Interceptor Sewer, Reaches VC5B to VC8, CMWD Project No. 91-403, Contract No.
ITEM EXPLANATION:
The original agreement between Malcolm-Pirnie, Incorporated and the City of Carls
approved and accepted on the City Council agenda of August 26, 1998 by Agc
14,315 and Resolution No. 97-566.
The Vista/Carlsbad Interceptor Sewer (Reaches VC5B to VC9) consists of appro
2,900 lineal feet of 36-inch diameter pipeline along Jefferson Street and 2,900 line;
42-inch pipeline along Jefferson Street and Oak Avenue. Of this described ali
Malcolm-Pirnie originally contracted with the City of Carlsbad for development of PI
Specifications for Reaches VC5B to VC8. Progression through engineering desigr
lighted several significant issues, for which Amendment No. 1 provides additiona
services in an effort to mitigate social impacts and minimize costs during cons
Amendment No. 1 includes an additional 900 lineal feet of 42-inch pipeline alc
Avenue (Reach VC9), adds micro-tunneling as a bid alternative to the Contract Doc
and includes design of a sewer tie-in at Grand Avenue and Roosevelt Street. The e
construction cost for Reaches VC5B to VC9 is $3,600,000.
Reach VC9 lies between Roosevelt Street and the railroad right-of-way along Oak
This reach connects the new sewer interceptor with the existing interceptor in the
right-of-way. This reach was initially included in the joint design project with th
Carlsbad Village Storm Drain to lump the construction effort into a single event. \
determined that design and construction of this reach with this contract facilitates SI
pass and improves upstream constructability. The additional design services as
with this work include additional surveying, design drawings, connection det;
specifications. The South Carlsbad Village Storm along this reach will also be inc
this contract.
Reach VC9 will also include coordination with the railroad right-of-way officials tl
approval of the design and permission to construct on railroad property. This cool
adds additional pipe jacking or micro-tunneling in order to cross under the railroac
Amendment No. 1 includes design effort to provide these services.
We have also concluded that two separate bid schedules will be the most beneficia
arrangement for the City. The two bid schedules, one for open cut trenching and
micro-tunneling, will allow the City to weigh social impact against increased con
costs after opening bids. The additional design efforts include a second pipeline c
second set of traffic control drawings, The design services associated with develol

FISCAL IMPACT:
The proposed budget for the additional work is $72,595. The budget includes $2;
work associated with the addition of Reach VC9, and $44,869 for additional work as
with adding the micro-tunneling alternative to the project. Carlsbad will be rei1
$17,384 by the City of Vista for design services associated with Reach VC9. To1
requested are $72,595.
Funds in the amount of $3,920,000 have been appropriated for this project, therefo
are sufficient funds available for this project.

the City of Carlsbad, a municipal corporation, hereinafter referred to as "City", and Malcolr
Pirnie, lncoroorated , hereinafter referred to as, "Contractor" for providing additional desig
services for Vista/Carlsbad Interceptor Sewer Reaches VC5B throughVC8, CMWD Project Nc
93-401, Contract No. 31821.
RECITALS
WHEREAS, the initial agreement, dated Auaust 26. 1997 identified a scope
work to Drovide desicln services for Reaches VCSB to VC8 bf the VistdCarlsbad InterceDti
Sewer
; and
WHEREAS, the parties to this aforementioned agreement desire to alter tt
scope of work as follows: to Drovide additional desian services for VistalCarlsbad InterceDt
Sewer Reaches VCSB to VC8. CMWD Proiect No. 91-403, Contract No. 31821; and
WHEREAS, a supplemental scope of work and fee schedule have bec
negotiated and agreed to between the parties hereto, and as shown on Exhibit "A" Scope
Services and Fee;
NOW, THEREFORE, in consideration of these recitals and the mutual covenar
contained herein, City and Contractor hereby agree as follows:
1. Contractor shall.provide services as outlined on the attached Exhibit "A".
2. City shall pay Contractor for all work associated with Paragraph 1 above,-

basis, copies of invoices sufficiently detailed to include hours performed, houriy rates, an
related activities and costs for approval by City.
3. Contractor shall complete all work outlined on the attached Exhibit “A t
Auaust 26. 1998 or by expiration of the agreement amended hereby.
4. All other provisions of the aforementioned agreement entered into on AUQU!
27, 1997, by and between City and Contractor shall remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor sh:
include coverage for the amended assignment and scope of work.
